Teen gets life for shooting young mother in front of her kids

NORFOLK

Mike Weiss looked at one of the teenaged boys who shot and paralyzed his wife and then made a request of the judge. “All I ask is the same mercy they showed my wife and kids,” Weiss said. “The same mercy. Which is none.”

Weiss testified Thursday during the sentencing hearing of Keyanta Moore, one of four youths charged with shooting Dawn Weiss on May 2 during a home invasion robbery in the 8100 block of Redmon Road.

The robbers shot Weiss five times in front of her daughters, Kayla and Destyni, now 10 and 6. They were unharmed. The bullets fractured two of Weiss’ vertebrae and damaged her spinal cord, leaving her paralyzed from the chest down.

Circuit Judge Karen J. Burrell sentenced Moore to life in prison plus 173 years for the shooting and robbery of Dawn Weiss and for another home invasion a block away the day before. The guns used to shoot Weiss were stolen during the May 1 robbery, according to prosecutor Jim Entas. Moore and his cousin, Michael Moore Jr., shot Weiss.

The sentence far exceeded guidelines that suggested a term of 23 to 31 years. Moore was 15 at the time of the shooting; he is now 16.

Mike Weiss, a sergeant first class in the Army, was in Kuwait when it happened. When word reached him, he was told his wife was not expected to live.

Both Mike and Dawn Weiss testified about how the shooting has changed their lives.

“We’re no longer just husband and wife and daughters,” he said. “We’re her caretakers.”

In some ways, he said, she is like a newborn.

“She can’t do anything by herself,” he said. “She can’t get her own food. She can’t go to the bathroom. Just to roll over in bed she has to wake me up and I have to do that for her.”

Nerve damage makes her feel as though she has been doused with gasoline and set afire, he said. While the Army’s health insurance pays for many of their costs, they have spent thousands of dollars on the medicines she needs, her wheelchair and therapy.

They live in fear that a simple cold could lead to pneumonia, because her diaphragm is paralyzed and she cannot cough. Dawn Weiss testified Thursday that she had been strong and independent before the shooting.

Now she fears that she won’t be able to protect her daughters. She thinks about the shooting every day, she said, and asks why.

The shooting happened in a car as Weiss and the girls tried to escape. When Weiss was shot, she slumped over in the front seat. Her daughters honked the car horn to get help. Trey Cooper lived nearby. At first, he said, he thought a rainstorm had caused a fender bender. When the horn continued to sound, he went outside and found Weiss.

Dawn’s blood soaked through the towel he had used to staunch the flow from the bullet wounds at her neck, Cooper testified, so he used his shirt.

“She was giving me her good-byes to say to people,” Cooper said.

He thinks about seeing the girls, one clutching a teddy bear, both covered in their mother’s blood.

“I’ll never forget what a heinous scene it was,” Cooper said, “how callous it was. She was left to bleed out in the pouring rain with her children.”

One of Moore’s lawyers, Henry Sadler, told Burrell that his client’s youth affected his ability to make decisions. “He’s a child,” Sadler said, “he’s still a child in many ways.”

Before Burrell pronounced her sentence, Moore turned to face Dawn and Mike Weiss, who held hands in the front row of the courtroom.

“I’d like to say I’m sorry to Ms. Weiss and her family,” Moore said. “I didn’t mean for you to get shot. It wasn’t all on me. But at the same time I accept full responsibility for what I done.”

Two others charged in the crimes, Michael Moore Jr., 18, and Vicktor Stine-Cunningham, 18, are scheduled to be sentenced today. The fourth, Randell Barkley Jr., 16, is scheduled to be sentenced Monday.

All the folks who are

All the folks who are spending big money on politics, or perhaps hating of the other party, would be well served to tender their money, and their energies, to help this young family overcome this horrible incident.
We know it will not be too long before some liberal person will suggest that these kids were railroaded and did not have a chance due to their upbringing. We know, because they have done the same so many times in the past with little regard for the victim. In this case, the entire family is the victim, and we should do whatever we can to help. Forget Republicans, Democrats or whatever administration. Lets for once help the victims.

Why?

Why? The one word that I can't get out of my head. These individuals took something, a lot of something's! Like one of the judges said yesterday, I wish their legs could be taken and given to Dawn. Mike, Dawn and family...what a road you have been forced down. A road not of your own will but one you had no choice in taking. The guys that did this made the choice to do it, they made this happen, they are responsible for themselves sitting in a jail cell. It is way past time for young people to realize consquence follows action. No matter how hard I try I just can't wrap my mind around this...I will forever ask Why?

Justice?

I cannot even begin to say that justice was truly served here. I can never fix what has happened to my family, never. These kids took away something that can never be replaced. I will never be able to forgive myself for not being there for my family when they needed me the most. Even though I feel that justice hasn't been served here I can atleast be at peace knowing that these kids will never be able to act upon anyone else again. My family and I will not let this stop us from living our life to the fullest. Even though we have had to adapt to life a little differently, we shall be strong, and with the Lord at our side nothing is impossible. Just Believe.

Hate Crimes

I initially wondered why no one was charged with a Hate Crime, (Shot five times!). Then reality returned. The Victim was White, the Offenders were Black. Remember the Nun who had her Head cut off? If there was ever a case for a Hate Crime, that was it. In other words,the "Hate Crime statute is a very, very Stupid "Politically Correct" Law.

Parents????

To all those wondering about the parents role in the lives of these young men, you are far too optimistic. Human spawn such as these young men are normally the result of baby daddy hooking it up for a night or maybe a week. Baby daddy is likely in jail or dead. We as a society have been supporting these young folks since their first breath, and it looks like we will be supporting them until their last as well. We, as a civilized society are truly responsible for the lack of charachter in these young people. We have made it acceptable, profitable, and easy for a 15 year old young lady to drop out of school and give birth. We provide housing, food, medical care, and even Air Jordan's to these young people and their offspring. Put an end to this support, and such senseless violence from youth will be less evident in a few generations.

Here's to "K" rotting in jail for the rest of his life. I hope more judges take this no nonsense approach to putting away these lowlifes. It is crazy how you have to get a license to drive a car, fill out an application to rent a movie or have a complete background check to rescue a dog but any moron can have a kid....

Young Men

So this little "child" who dosen't quite know right from wrong,and is "sorry" for pumping five bullets into a womans body, injuring her so badly that her blood is all over her daughters' clothing,becausr he was too lazy to go out and get a job like any decent 15 year old would do, He had to do a home invausuin one day before to steak a gun,then use it on the mother the next. I'll bet this little black rat went out and bragged to all his friends that night about what he did.As for hts parents rasing him,what parents???? Show me one of these morons who have both a mother and a father, mom is around,mabye but da-da,he's out on the production circut,producing one here and nabye another 200 miles away, Yeah. Good for the judge,it;s nice to see a judge with some backbone for a change insted of being so scared that the people they sentence will come back to get them if and when they do Get out. This idiot won;t get that chance.

Weiss

I also am a young mother of a two year old and four month old. I couldn't imagine not being able to play hide and seek with my kids or chase them around the back yard. So I as a young mother, I as a young woman, I as a wife and I as a human being fully support this judges decision. I would glady pay my taxes to see these individuals rot in prison and have them wake up in prison every day for the rest of their life and know they are there because of a stupid choice on their part. Death is an easy way out. God bless the Weiss family.

Sentence

Due to the seriousness of Mrs. Weiss' injuries, her life will probably be cut short, causing her family yet more heartache. Maybe, these thugs' sentences should include that when she passes, so should they. This family did not deserve this. My thoughts and prayers go out to you, Mr. and Mrs. Weiss and family. May God bless you all. It's too bad that the money to incarcerate these thugs cannot be used to ease the unnecessary burden placed upon this family.

The only thing that scum is sorry for is the fact that he was caught! He would be out there tonight doing this to other innocent people. To think that those 2 little girls saw what happened to their mother. I hope they get what is coming to them in prison! Kudos to the judge!
Everyday, I see this trash come through the school system. No one is ever told they are wrong or have done anything wrong. The kids are pampered and coddled, told they are good and wonderful and didn't mean any harm when they struck out at an innocent student. They are counseled and given 2nd, 3rd, 4th chances, readmitted back into the classroom after threatening or pummeling others. I don't care what anybody says, I'm a 'baby-boomer', I was disciplined by my parents and taught what was right and wrong. We never had the issues or problems that we see today and they are only going to get worse. Nobody takes responsibility for their actions and nobody is ever turned down, rejected, or told 'no'. Why do you think, when a girl breaks up with a guy (or vice-versa), is fired from a job, or can't get their way, they go on a shooting spree and take out a school, mall, or business? They have never heard the word "No"

For all you other people think about this it will cost the tax payers $50,000 a year to keep those four pieces of vomit behind bars. that money could go to the family and pay for the girls college. Wow

I'm surprised by this sentence. I'm surprised that the judge was allowed to exceed the sentencing guidelines by that much. These young men definitely need to be held accountable and punished for what they did to this woman and her family.

I lost my son to violence to years ago through no fault of his own..an innocent victim of a random crime. His shooter got 15 years. 15 YEARS! My son was only 15y/o at the time of his murder. Imagine how I must have felt when his killers got such a paltry sentence in the so called justice system.

This family says things have changed in their lives...I know that...but I'd trade their problems for mine in a heartbeat! They should be thankful their loved one is still with them.

Life is the wrong answer!

Our society is full of responsible people and we have these parasites still living. We as tax payers will pay for the electricity, medical, food three times a day, and education for these morons to live in prison the rest of there lives. What is the normal live time for humans now, mid 70's for males? They should be terminated for their actions and take their lives as they attempted to take HERS. She was innocent and they were not, filthy waste of tax money!

How about the parents?

I know that you cannot watch your kids 24 hours a day, but you can instill some values in them. It doesn't matter if you are a single parent or work all of the time. Kids live by example. Teach them the value of life. Teach them to treat people with respect. Teach them to care about their community. Teach them right from wrong. Most importantly, show them love and respect and be involved in their lives. Obviously, there was no adult guiding these young people.

WELL

Guess the saying goes the apple don't fall to far from the tree. When you have a corrupt mother and father what kind of children will they produce or influence. The whole situation is a let down.

I'm happy to have them off

I'm happy to have them off the streets forever. Our tax dollars would have paid their way in or out of jail anyway.

Penalties

This is exactly what should be done. Lock these stupid kids up and set an example to the other hoods/thugs. Just how stupid/young do you have to be to shoot/stab someone and not know that they may die or have permanent injuries? I don't know how many times I've heard, I shot/stabbed him but didn't mean to kill him. It even sounds stupid! The stupid part is that their are some people out there that are foolish to believe them. This is the type of thing that should be taught once or twice a year in school in a large forum. Expose them to some of their potentially stupid actions. Tell them if they shoot/stab someone they may kill them, and get to spend the rest of their life in jail. Tell them about life and it's pitfalls, call it Reality 101, straight talk, whatever you want to. Enlighten these people to the penalties of their actions, personal and criminal. By the way, if anyone thinks that sentence of life+ will stand are insane. It will be appealed and reduced. Just too many bleeding heart liberals out there. Some of their family members need to become victims and then see what they say!

is the fact one of these 'sorry' thugs shot her FIVE times! But yeah, they're just kids and didn't know what they were doing. They robbed and stole on 5/1/07 --- turned around the next day and did it again. Um....why weren't they in school? Or if it was after school, that's some homework they were doing eh?? When are PARENTS going to STEP UP and take care of their kids? I don't care if parents are single, married, divorced, widowed, work, don't work -- none of this is an excuse for not taking care of your kids. You had 'em take care of 'em. Raising YOUR KIDS is not the village's job.

Finally, a judge saying enough is enough. I am thrilled to see this thug locked away for life. He left that woman there to die in front of her children, saying her last goodbyes. Maybe he will get his just punishment in prison. Maybe the guards will ignore his pleas for help when he is the victim in prison. Let him feel what it felt like. It feels sorry because he was caught. Nothing more, nothing less. I wish more judges would follow this lead and lock up more wayward juveniles. I spent 14 years as a police officer and know firsthand the juvenile justice system is a joke. They courts are trying to save someone who usually is unsavable. They know what they are doing. They feel they will not get caught.

A sad situation all around :(

I actually feel bad for the shooter and his family. I'm sure they are feeling grief too. BUT, I'm glad he is safely locked up for the rest of his life.

I feel even worse for the victims. It makes me so sad to read such a tragic story just before the holidays. Unfortunatly, they have to live with the daily reminder of what was done to them and closure will be difficult. I hope they can come to peace one day :(

Youth

I had a few youthful indiscretions, but never came close to murder. Some things can be excused, some cannot.

Senseless

These boys may have been kids when they committed this senseless crime. But in my opinion, they gave up that right when they made the stupid decision to go through with this. They have ruined their lives, not to mention how they scarred those two beautiful little girls who had to watch their mother suffer that day and for the rest of her life.

This story is just so horrible

I am shocked each and every time I read an article at the sorts of people breathing my air. I agree with every other poster so far. I'm glad he was tried as an adult. The way I see it, if he's that hateful at 16, what would he be at 30? Of course he knew not to do that -- good job on the verdict.

As to the parents of all, don't you know what your children are up to? Do you realize being a mom or dad is far more than just squirting out a child? Don't have children if you don't want to spend a couple decades exhausting yourself on bringing them up to be fine adults.

Everyone is entitled to life, liberty and the pursuit of happiness. There are too many people walking around who believe they are entitled to someone else's happiness (no, you have to make your own with your own two hands) and have no qualms about stealing the right to life from others.

The fact that they got caught...now that I bet they are sorry for. Had they not been caught do you think they would be sitting around feeling sorry for killing (as far as they know) a woman in FRONT OF HER KIDS? No. They wouldn't. They wouldn't give it another thought.

Good on the judge for locking them up.

To all of the "kids" out there reading this. Make your choices based on what you want to be, not on what you want. If you do not EARN 'it', 'it' can be taken away from you. That goes for anything from respect & stolen handguns to your life.

SO LONG

Good to see those poor children getting locked up for life. Maybe the parents should join them for raising a bunch of felons. Naturally the lawyer has an excuse, he has to get paid for defending a murderer...I hope he sleeps well collecting that paycheck. But, no sympathy from me...if the thug is so unable to determine for himself that an armed robbery and attempted murder with stolen firearms taken during a previous burglary is a bad thing, then prison is just where he belongs. Too bad the victim of the burglary wasn't home when the "child" broke into his house to steal his guns. He could have done society a favor by snuffing out the worthless thug. Good parenting job though, hope they are proud to have raised a child felon.

Mr. Moore's attorney said that he's a child and that effects his ability to make decisions. He robbed and shot someone, who doesn't know that is the wrong thing to do? I agree with Mr. Weiss, these thugs should be shown the same mercy as his wife.

I only hope and pray that

I only hope and pray that this young thug will never, ever get out for so called "good behavior" or any other reason. He deserves to spend his entire life behind bars. Not only did he shoot this young wife and mother, but he shot her 5 times. Why? There is no possible way that someone that rotten, mean and cruel should ever be released or forgiven! Imagine being away in Iraq while serving your country, having to receive that kind of news from home. I am 100% with the husband, there is no punishment too harsh for this thug! The previous comments were right on! HE MUST BE HELD ACCOUNTABLE FOR HIS ACTIONS!
