A woman is suing the city, the Sheriff's Office, Sheriff Paul Lanteigne and three sheriff's deputies after her 19-year-old son committed suicide at the city jail more than two years ago.
Sarah Hartshorn-Turner claims in the negligence lawsuit filed in Circuit Court last month that jail officials did not provide the medical and psychological care that Chestley C. Plummer needed, despite being told he had been treated for depression.
The lawsuit is seeking $10 million in damages.
Plummer, who was serving a six-month sentence for assault, was found hanging from a bedsheet sometime between 11 p.m. and midnight on Jan. 28, 2006.
Police ruled his death a suicide, and jail officials began looking into whether the proper security procedures were followed.
Hartshorn-Turner claims officials were notified at least twice that Plummer, a carpenter and aspiring musician, had received psychological care for depression and was suicidal. However, in the weeks before his death, Plummer was not placed on suicide watch and did not receive treatment.
Tina McCree Orr, Hartshorn-Turner's attorney, wrote in the lawsuit that the jail did not take any precautions to remove items in his cell that could be used in a suicide attempt. She also claimed that two deputies who were supposed to check on the inmates every 20 minutes did not reach Plummer's cell for more than 39 minutes on the night he died.
At the time of the incident, Lanteigne said documents and videotapes would determine the last time deputies checked on Plummer before his death.
In an interview Monday, Lanteigne said he could not comment on pending litigation. "As long as I am the sheriff, we are not going to settle frivolous lawsuits," he said. "I expect we will defend ourselves in court and will be successful."

Negligence claim made in teen's 2006 Beach jail suicide
I guess if Chestley Plummer was a rich kid like those in the media of late he would not have needed to be on suicide watch for him to get the type of treatment a human being deserves. At the end of the day it is about our penial system getting it right! Our taxpaying dollars should get more than neglect toward inmates. It is there job to run those facilities like the inmates are human beings. The real sentiment of the Sheriff come through in the actions toward Chestley and other neglected inmates. Being in jail does not give them license to treat them like sub-humans. Chestley would be ALIVE today if a member of the Sheriff's staff was committed to doing their job the right way. Sheriff Lanteigne should be glad that the family is only asking for 10 million dollars a far cry from what they should have asked for. If it wasn't for the Sheriff and his staff not only would Chestley be alive he would already have served out his sentence and would be a productive member of society. This injustice deserves more than the money the Sheriff should be punished for his contributing to Chestley's death!

You mean to tell me, someone in your Public Relations Department allowed you to open your mouth and spew such fowl and venomous words towards this child Chestley C. Plummer. You should be the one arrested and incarcerated for six months do to stupidity and lack of tact. This is a direct verbal attack, against Ms. Sarah Hartshorn-Turner and her family. This is not the lottery we are talking about her son.
If your office was so squeaky clean you would not have gotten mad. Can any body say “Anger Management Classes”. Yes, Sheriff you need to take a few.
You need to stop being mad at this woman, she has suffered enough, and pay attention to the problems that you have at the Virginia Beach jail.

As Chestley's friend, classmate,labelmate, and hairdresser, I would like to say that I am myself irrate at the comment the sherriff had to make. He said no comment he should've just kept it that way. because,In no way has his death been frivolous to me, my fiance Chad Freeman, nor his family. His daughter now has to grow everyday without him because of this negligence that was forced upon him. This case gives all Virginia residents a chance to stand up for the improper care that is given to the inmates. The only thing Ms. Sarah wanted was the right as a mother to be told the truth. but in this case which it seems to me that.. The truth was never a factor..but lets get this clear. $10 million dollars is never enough money to replace a human life. and Chestley Plummer aka CP will never be forgotten.

I gasped when I read Sheriff Lanteigne's use of the word frivolous when describing a lawsuit against the negligence of his employees that resulted in the death of a young man. Nothing can bring Chestley back, but kudos to the Plummer family for standing up for VA families! We must not let such negligence continue, nor should we devalue any human life to the point of referring to it as frivolous. If you are enraged over this comment, please read Anthony Davis and Jeffrey Jackson's book, "Yo, Little Brother". As Americans, we should each be appalled at the plight of young black males. We fought for freedom for what? To let a whole race of young men put themselves down? And we jump on the bandwagon and beat them when they try to improve? Help a brother out; find out what it takes for him to succeed in this "land of opportunity". Then just do it.

the audacity of the comment that sheriff Lanteigne made using the word frivolous to describe the life of a 19 year aspiring youth. I feel that the Virginia Beach Jail System should have provided protection for the young man, when he and his family asked for help and by placing him under suicide watch.I feel that the virginia Beach Jail system is negelent, because they did not make sure that he received the medical attention that was needed to assure him of his life.I understand from recent stories that the jail system is abusive to the mentally ill and totaly ignores ther cries for help. Example The Johnson case, where a elderly, mentally ill women was beaten severely by Virginia Beach jailers. I feel that the mentally ill should be given the correct help needed to sustain there life when in crisis,and not ignored by the Virginia Beach Jail system. It is a shame that sherrif Lanteigne would make such a calous statement. I feel that he should be removed from office. Virginia Beach jail suicide
For anyone to say that this case is frivilous or to even go as far as to compare someones death to winning the lottery is inhumane. Im outraged that this is what our society has come to . If this was a family memeber of yours I dont think you would feel the same way. This was someones son,garndson, brother, uncle, cousin, nephew and friend, to all that he came in contact with. His family and friends have suffered such a great loss. I hope that this young mans life does not go unnoticed and I hope that no other family has to through this. If the Virginia Beach jail was following the state policies for someone threatning to commit suicide then he should have been on suicide watch. I feel that the city jail was negligent in doing their job.
Court room lottery
It looks like someone else trying to cash in on the court room lottery. Even worse it's her failure as a parent that caused the issue in the first place. That's $20 from every man, woman, and child in Virginia beach.

Settling Frivolous Lawsuits
Frivolous :characterized by lacking of seriousness or sense. without value or worth. If the story that the Sheriff's Dept was notified twice that the man had suicidal tendencies prior to his death is true, it may be wise to settle. I doubt his mother, or her attorney consider the matter frivolous. It would cost the Dept & City a lot less than 10 million dollars, if the victim's mother wins the case.
