When Hampton Roads residents start paying a new tax on car sales on April 1, they might not be able to add the tax to their payment to the car dealer.
Instead, they would have to write a check for potentially hundreds of dollars - depending on the vehicle's price - directly to the state Department of Motor Vehicles, under legislation approved Tuesday by the Senate.
The new titling fee, which is 1 percent of a car's value, is part of a package of taxes and fees approved by the General Assembly last year to help pay for major transportation projects in the region. For example, someone buying a $30,000 car would have to pay a $300 titling fee.
The bill, HB649, which was approved 39-0 by the Senate on Tuesday, prohibits car dealers from collecting the titling tax or any other fees to be controlled by the Hampton Roads Transportation Authority, which was established to finance and oversee the major local projects. The bill was sponsored by Del. Clarke Hogan, R-Halifax.
Senate Majority Leader Richard Saslaw, D-Springfield, said car dealers are asking for the change because their customers may misunderstand the tax.
"People are interpreting that as part of the price of the car, and they want to ship it over to DMV," Saslaw said.
"What difference does it make? They still have to pay it."
Gov. Timothy M. Kaine would prefer to see car dealers collect the fee.
Paying the fee separately at the DMV is "an unnecessary inconvenience, and it takes away from consumer choice," said Gordon Hickey, a spokesman for Kaine.
The change required by HB649 would increase collection costs for the DMV by an estimated $3.4 million, according to a legislative impact statement.
Don Hall, president of the Virginia Automobile Dealers Association, which has lobbied for the change, said the governor's office doesn't understand the car business in 2008.
Five years ago, banks would have rolled the fee into the cost of the loan, said Hall, whose organization represents 550 new-car dealers.
But because of how the lending business has tightened up, "for most car buyers in Virginia, banks will not finance the extra fees," Hall said.
Hickey disputed Hall's argument and noted that he recently bought a car and was able to roll fees into his financing package.
"I don't know that I understand the car business, but I understand what I paid," Hickey said.
Car dealers already collect state motor vehicle sales and use taxes and the state portion of the registration fee.
Del. Chris Jones, R-Suffolk, who helped develop last year's transportation package, said the intention was always that the DMV would collect the
titling fees in a lump sum, but Kaine amended the bill to allow for the dealer collection.
"This is just putting it back in the original form," Jones said.
Hickey dispute s Jones' explanation and says that when the legislation arrived on the governor's desk in 2007, it said car dealers would collect the tax.
Kaine did not amend anything to move that fee over from the DMV to the car dealers, he said.
State campaign finance records show that Jones, Hogan, Saslaw and Kaine each received contributions from car dealers in 2007.
According to the Virginia Public Access Project, car dealers gave Saslaw $33,000, Jones $5,750, and Hogan $3,000 in campaign contributions.
Kaine's campaign for governor and political action committee received a total $289,000 from auto dealers, according to the VPAP.

Let us know when Bush vetoes the budgets with your supposed dem pork. Every bit of that supposed dem pork was rep approved when Bush had rep majorities. And rep approved when he signs budgets submitted by dems. Keep pretending that reps are any better fiscal conservatives. So far all you can show is that reps refuse to pass a balanced budget unless led by a dem Prez.

I have more respect for someone (even if we disagree) who at least attempts to answer harmless questions than someone like you who has no real philosophy, no ideas and no manhood to answer up. Maybe you're young or uninformed? I answered YOUR question at least. Let's see the Dems had control of congress for 40 years before the Contract With America, how many times did they balance it? Ooops! That's another question. I forgot Democrats and Liberals don't have answers. And in that time the Democrats and Liberals had control of the White House and Congress on occasion. Remember President Carter? There I go again, reminding you of your party and the failures of its philosophy. Thank God for President Reagan who reversed the tailspin that Carter spearheaded. I make excuses? Where in my comment did I offer ANY excuses? Show me. You won't find any excuses in my comments. You are the appologist not me. Yeah leadership from Clinton. Gutted the military. Reduced military R&D. Gave missile technology to the Communists in China. Received illegal money from Buddhist monks. He was dragged kicking and screaming into a balanced budget. Don't forget NAFTA. Having a hard time answering these questions aren't you? Ha-ha Typical! I don't want anyone in VIRGINA raising taxes and fees on me and my fellow hard working residents. If you like having your money taken from you go ahead and don't file a return if you are due one. Let the Mark Warners, Tim Kaines and others like them find a way to spend it. Don't answer the questions, go right ahead and make excuses if you want to. I don't like not having a balanced federal budget either. I wish to God, yes I said God, that we didn't have to spend the money we do in the middle east. I wish my old shipmates and current Navy friends didn't have to be deployed so often as they are. I wish we had a minimal presence there. If the President didn't do what he did after 911 the Democrats and Liberals would have said he isn't doing enough to protect us from another attack. Classic tactic, take the oppposite political stance of your opponents and pound it home. Yeah we should have a balanced federal budget. Tell us how long it has been since repubs have done a balanced budget in Congress? Over half of Bush's eight years have been with repub majority control of both houses of Congress.
No Difference
The politicians always think they are entitled to raise fees or taxes or whatever they chose to call them. There is no difference between the Democrat or Republican parties. They all think there is no limit on the taxpayers and always figure out a new scheme to fleece us. They never figure out how to make do with what money they already take from us or reduce spending.
Taxes & DMV fees
Why do you Democrats and Liberals think it is good for the us to have less money? Why are the only ones who remain relatively unaffected by tax increases and fees the same people who can demand a pay raise (teachers unions for example) and get it at the expense of the taxpayers? How could we have a $500 million dollar surplus not too long ago and now this? Why don't Democrats and Liberals believe in balanced budgets? When there is a surplus of money there is an imbalance. That is the money of us hard working Virginians, not Governor Kaines! It should have been returned to the taxpayers. You democrats and liberals will (if allowed to) turn us into mini versions of Michigan and New York with high taxation, high unemployment and low paying jobs. Yeah! That's a great idea! What you really believe in is redistribution of wealth (aka socialism/commmunism), yeah that really works well too! Good Job Democrats & Liberals!
