Michael Vick's state dogfighting trial rescheduled for June

Michael Vick’s state trial on dogfighting charges was rescheduled today for June 27.

Vick, the suspended NFL quarterback from Newport News, was originally scheduled to be tried April 2, but Surry County Commonwealth’s Attorney Gerald Poindexter asked in a joint motion with defense attorneys to push the date back.

Circuit Court Judge W. Allan Sharrett set the new dates today for Vick and two of his codefendants, Court Administrator Sally Neblett said. Quanis Phillips is now scheduled for June 13, followed by Purnell Peace on June 20. Vick’s trial is to be heard by a jury.

Poindexter cited logistical problems with transporting the men from federal custody as the reason for the continuances.

Vick is serving a 23-month prison sentence on a federal conspiracy charge that centered on his involvement in a dogfighting operation based on land he owned in Surry County. Peace, Phillips and a third man, Tony Taylor, also pleaded guilty in the case.

A Surry County grand jury indicted the men on state charges of dogfighting and animal cruelty in September, after the federal convictions. All but Taylor, who was recently released after a two-month sentence, are currently serving time in federal prisons.

Taylor is scheduled for a May 7 trial in the state case.

Vick is charged with two counts in Surry County, each punishable by up to five years in prison.

Mr. Poindexter will never really go after Vick. He may go through the motions to please us people, but Vick will be found NOT GUILTY. The ONLY reason Vick is in jail now is because of the Feds.

Time served

If Vick is found guilty, his sentence will be for time already served.

Double Jeopardy?

I do not know all the details, but would this not be like double jeopardy here? He is being tried for the same crimes twice, is that not what that means? I am not a lawyer and don't know how that works, but from appearance that is what it seems like. Does it make a difference of federal vs. state? I don't know, but on top of that, personally I don't think the taxpayers should be burdened with another trial for something he has already paid time for.

Come June

The Surry County Prosecutor will then encounter other issues preventing prosecution.

How much more should citizens accept from a Commonwealths Attorney whom continues to postpone and ignore a serious crime. Why isn't the NAACP protesting this matter.............
