Rivers back in Elizabeth City council seat - for now

Nearly a month after the City Council declared his seat vacant, Kirk Rivers was granted a stay Monday that temporarily put him back on the council.

Superior Court Judge W. Russell Duke Jr. granted a motion to stay the Pasquotank County Board of Elections' order that changed Rivers' registration to an address outside the city. Duke said Rivers could return to his seat Monday night, and the June 24 special election to fill his seat was temporarily on hold.

Duke said he did not have enough information to rule on an appeal of the board's decision and suggested the parties request a special court session.

In March, the board determined that Rivers no longer lived in the 4th Ward.

He married last year and said he and his wife were waiting to move to another house under construction in the 4th Ward. In the meantime, the elections board concluded, he was living outside the city at the house where his wife is registered to vote and his registration card was changed as part of the decision.

The couple moved into their new house in April. Rivers attended Monday night's City Council meeting.
