The construction company that finished the first part of the Virginia Beach Convention Center 68 days late will be charged a $1 million penalty.
The company had asked that the fee be forgiven, but the City Council decided in private last week to assess the full penalty, known in the construction industry as liquidated damages.
Basically, it means the city will not pay $1 million of the $160 million contract it reached with Turner Construction, the national company that built the glass-and-steel facility at the Oceanfront.
"We need to hold all of our vendors to the terms of their contracts. Period," said Councilman Jim Wood, vice president of a commercial construction company. "... It is tax dollars. It's not my money to deal with."
Turner Construction asked for "financial relief" from the damages and blamed subcontractors for the delays. A Turner official would not comment on the issue, but the other companies have been identified as Kovach Inc., Century Concrete Inc. and Bay Mechanical Inc. The latter two are Beach-based companies.
Ben Short, an official at Turner's office in Arlington, wouldn't discuss details and said, "That's just between us and the city and the subcontractors."
Representatives from the subcontractors could not be reached for comment, but interviews with city leaders and a review of documents indicate that Turner delivered the first phase of the $207 million convention center later than the contract allowed.
Dave Hansen, deputy city manager, said the first portion of the building was ready 43 days late in the summer of 2005, and another portion was 25 days late. Under the contract, the company accordingly owed $1,004,750 in damages.
Hansen said the damages couldn't be settled until Turner completed its "punch list," a tally of finishing work common to construction projects. Turner's list had about 7,400 items.
Before that work finished, though, Turner asked to pay less, or nothing, in damages and blamed other companies for the delay, according to an April 2 memo to City Manager Jim Spore.
Some of those companies have filed claims with bonding companies and complained to council members, the memo stated.
"This situation is creating a 'catch 22' situation for Turner in that these subcontractors will not complete punch list work... without being paid, and we can not pay Turner until all of these requirements are fulfilled," the memo read.
Turner finished the work in the past few months. Once that happened, council members said city staff recommended in a closed session last week to reduce the late fee, which might help local companies who have a dispute with Turner.
Councilwoman Barbara Henley said she couldn't justify a reduction with no guarantee that local companie s would reap that benefit.
"We didn't have that assurance," she said.
Hansen said council members were presented options because the final decision was theirs.
"This is a chunk of change," he said. "Quite frankly, it was staff's position that they did not want to move forward without... the endorsement of city council."

Yes Turner is involved in all 3 projects you outline, however you do not know details. VBCC had many weather delays, subcontractor problems, material delivery problems, etc. Blair was delayed due to the asbestos and changes made by the CITY - not Turner, and we all know where the blame lies with the now infamous Granby Tower, don't we....the lenders...or Buddy Gadams - Not Turner. Turner is a builder, no a bank. Get your facts right.
Dont get too giddy folks
After 30 years in the business and having estimated countless projects let me let you in on a little seceret......when LD's are in the contract, we always include a contingency line item in our bid to cover it. Turner probably had at least 60 days worth of potential LD's built into the quote as did all of the competitors. VA Beach taxpayers already overpaid around $2M before the job started just do to the fact that LD's were a potential in the contract documents. You cannot just shift risks unilaterally. Contractors are in the business of covering risks.
Coincidence?
Virginia Beach Convention Center is late, it is the subcontractor's fault.
Blair Middle school is late, it is the Norfolk's fault.
Granby Tower has stalled and may go belly up, the bank's fault.
There is one common factor here - Turner.

Yes - something smells fishy about this article - Jim Woods is probably the one who called The Pilot for the story. Knowing some people in the construction business - do you think it was a very good idea to actually name the 2 local Virginia Beach companies involved in the delay...how do you think they are feeling right now? I'm sure there will be more to come...stay tuned!
Oh geez...what's next?
Now that our illustrious city council found a way to spend more of our tax dollars...what's the next project? Rip out the concrete portion of the boardwalk and replace them with boards? SPEND $$$ on the roads...there are more potholes and messed up roads in Virginia Beach than anywhere else! After all with the photo stoplights City of Va Beach will be raking in more $$$...time to move!

45 days late on 3 year contract????
Doesn't seem all that out of line. I'm sure that the city did not make any changes to the original Scope of Work, Architects and Engineer's Plans were perfect, the weather was perfect, and City inspectors's didn't hold up the work by not making it onsite in time to inspect. I'm sure it is all Turner's fault for being behind essentially 15 Calander Days per year. Good luck City of Virginia Beach fighting this out in a court room with one of largest General Contractors in the world completing over $8 BILLION in Construction last year. In the meantime, local subcontractors will suffer by not getting paid and the citizens of VB will get to pay for the lawyers, the only ones who will make out like bandits in the end.
City Council, do the citizens a favor and get your head out of the sand.
A Couple of Months is not the worst
There are many road construction projects or otherwise, those that have been or are way past due. This will turn bidders OFF. There are delays in construction: weather, materials slow to arrive... Turner will put contingencies in his future contracts if smart.

This is a first!!! No wait now I know why they are making the contractor pay the fine .... No One on the City Council works or owns stock in the company.. If they did the city would pay the Mil back and more for the contractor's problems with meeting a dead line.

As I read this, it appears that henley was leaning toward a reduction in the penalty? She would have voted to reduce the penalty if it would have helped her local buddies huh? Typical!
