CHESAPEAKE

Belinda Tillmon told a jury in Chesapeake Circuit Court about a child named Ny-Asia, a little girl whose life ended at the age of 1.

"She was a precious little girl," Tillmon said. "Anybody who seen her would love her to death. She brought joy to everybody."

She took the stand Thursday hoping to persuade the jury to give a stiff sentence to the men convicted of killing her daughter.

Earlier in the day, the jury found Shawn Sir Charles Ward and Julian "Ramel" Barksdale guilty of second-degree murder in the fatal shooting of Ny-Asia, who was killed Nov. 10 during a South Norfolk home invasion. The jury also found Ward, 22, and Barksdale, 20, guilty of the malicious woundings of two others in the house.

The jury deliberated on a sentence for less than three hours before court adjourned. The group will resume this morning. Judge Randy Smith will formally sentence the two men at a later date.

Ward and Barksdale face a minimum of 55 years in prison.

The jury deliberated for two days before finding both men guilty of second-degree murder, burglary while armed, two counts of malicious wounding, attempted murder, wearing a mask in public and four felonies involving the use of a firearm in the commission of crimes. The two had been charged with first-degree murder, but the jury opted for the lesser charge.

The baby was killed when as many as three masked gunmen forced their way into a first-floor apartment in the 3700 block of Bainbridge Blvd. and opened fire. The third person has not been identified or arrested.

The baby's grandmother Mary Arnold was shot in the left hand. The baby's uncle Bernard Person was shot in the arm.

Person caused the intruders to scatter that Saturday afternoon when he returned fire after retrieving his mother's gun. A motive for the home invasion remains unclear.

Before the six-man, six-woman jury returned to the deliberation room Thursday afternoon to determine a sentence, it heard from the victims in the home invasion. Mary Arnold testified that she lost a grandchild, job, home and full use of her hand because of the incident.

"It's been a hard life change for all of us," she said. "It's been a nightmare. I still don't feel safe in my home."

Deputy Commonwealth's Attorney D. J. Hansen showed the jury documents about both defendants' criminal histories, but he did not go into detail.

"These men are no strangers to the criminal justice system" he told the jury.

Ward and Barksdale, cousins, cried when their family members took the witness stand to testify on their behalf. Ward's mother told the jury: "He's not capable of doing this."

Real Justice

It interesting to see how naive so many people are. I'm glad none of these idiots actually wears a black robe. We already have enough of them. When you consider the dozens of people in VA and the hundreds across the country who have been wrongfully convicted, I wouldn't feel comfortable finding anyone guilty of anything. Prosecutors routinely lie and judges are too incompetent to tell. This idiot Judge Randall Smith is the same one who ruled in favor of the homeowners in the Chesapeake airport trial. He's already been reversed by the Court of Appeals numerous times even though he's only been a judge for 3 years. We may never know if these guys were guilty or not because of justice system is a mess.

What these two monsters did to that family and more importantly, the life they took from that baby, isn't fair. If you want to forgive them, then by all means, please do so. I, however, am of the belief that even though you may not have been dealt the most pleasant hand in life, you can still make wise decisions on what to do with the cards you were dealt. These two monsters didn't make the wise decision and took the life of an innocent child in the process. 78 years is too lenient for these two. Our justice system needs a new set of teeth and cojones...

I feel the same way about the other man recently convicted for killing his baby. I'm disgusted he only received 35 years with 15 years suspended with supervised probation instead. The punishment for serious violations such as murder and rape should be much harsher, especially when these crimes are committed against defenseless children.

look at the brighter side my brothers of color. 3 hots and a cot. keep your noses clean for the entire time your locked up and you will see your sentence reduced from 78 to 65. now that your thieveing hind parts are locked up dont be worrying your mom or grandma or your baby mother with those expensive prison collect calls they would much prefer a letter. also instead of worrying them for money each month take advantage of the 20-25 cent jobs offered by the dept of corrections. also you dont have to worry about us law abideing citizens who supported no parole just eat right and work out and you may still have time to enjoy some free air. dont know how fast you will be able to move with the walker since you will be only 85 or so. and last but not least remember big bubba is like tom bodet from motel 6 he'll leave the light on for ya.

It runs in my family. We tell it like it is. I call it like I see it. I say what I mean, and mean what I say. I don't care about being "politically correct" just because it offends someone else.

It's people like you and your feelings towards these monsters that cause people like them to do the things they do without regard. You need to step back and think for one moment about what if that one year old was your child or grandchild. Because unfortunately you don't care when it's not a part of your family. These two guys continue to stick their noses in the air by refusing to identify the third subject involved. I guess you are glad he/she is still out there getting a "break" from his buddies that DID get caught. See, you still have someone to fear...I mean cheer for!! Give US a break!!!!!

Try the victim side...

For the person who's sat on the jury, try sitting on the side of the victim and see how you feel. There is no excuse for what happend and the most severe penalty should be handed down. There should be no room for negotiation because there was no negotiation when the shots were fired. I am sure the grandmother asked for their lives and even said "please dont", so there will be no bleeding heart here for the shooters. As one poster put it "these are someones babies", no these are grown men who knew better, they were not hocked up on drugs and they were not under duress. They did it because they thought they would not get caught. Now that little girl will never realize what life had in store for her and what she could have been. These two should be deprived of life just like her.

A waste

A waste of lives all the way around. No parent or grandparent should have o bury their child. I would still like to know who the third gunman was, maybe Sir Charles and Mr. Barksdale will cooperate and bring the other male to justice. When the two men get out of prison three generations of people will pass them by.

South Norfolk Murder

In response to FYI, how about starting at home. Teachers can only do so much. Parents need to take an active part in their children's lives and most don't for many, many reasons. Values, morals and many other things begin at home. I haven't seen anyone,let alone teachers who can make someone learn if they do not want to. How about volunteering at a school and see what teachers actually do. Don't critize if you haven't walked in their shoes. This is the 21st. Century students have changed it is not the same, believe me you would be surprised.

They chose to invade a home and open fire. They are responsible for their own actions. Those actions murdered a 1-year-old little girl. And now they will pay their debt to society for killing an innocent member of it.

My thoughts....

While I do indeed hope that these two criminals find Christ and seek forgiveness through true faith, I don't think that these things change the fact that we all have to face the consequences of our choices in the here and now.

Justice is justice, and forgiveness is forgiveness. They are two separate issues.

More lives lost

It sadens me to read that yet two more young black men has thrown away their lives. When I grew up, the neighborhood took/ played a major role in raising children. This does not seem to be the case now. What is America coming to? My prayers go out to all three families. I cant imagine loosing a child, let alone one as young as a year old. May GOD give you all strength.

Expect more of the same

The Democrats are already talking how the USA has such a small percentage of the worlds population yet we have 1/4 of the total # of incarcerated folks in the world. "They" say we are locking people up for crimes that are small in comparison to the rest of the world. Va. has already reduced the sentences for many crack dealers because when compared to sentences for those busted for "powder cocaine" (white man's drug)the penalties are "disproportional".I know drugs and murder are 2 different crimes but one cultivates the other. Instead of holding people accountable, we routinely just lower the standards and the morals follow suit. Typical response for the liberals. Release all the criminals because they are unfortunate types that didn't get a fair chance, make owning a handgun a crime, prosecute the heck out of a law abiding citizen that tries to defend his home and family. I just don't understand some peoples thinking...

Think before you post

I and the rest of you all should think before you post something here. I for one have sat on a jury and I have to say that you have to see all the material that both sides give you.

If you also do not agree with what the jury had to say then when you are called to sit on a jury do not try to get out of it.

They should own up to what they did!

I'm glad they have been taken out of my neighborhood so they can't do anymore harm. It's not my job to forgive them, that's God's job. I agree that they should have received more of a sentence. They are still young enough to walk out someday and when that day comes, I'm hoping that it won't be this area that they come back to. They can take the blame for what's happened to them, the pain they are causing the baby's family and their own family. I see time and time again that people don't own up to what they did wrong and will fight it till the end. Own it and appoligize and take it like a man. They are such wimps when they get caught.

I didn't flag 'em, but really, folks, isn't this a place to practice trying to find civil ways to say things? Telling someone to do something obscene to themselves or calling them an idiot is the lowest form of discourse and I am really tired of hearing and seeing it every day. It doesn't matter whether someone else wrote something worse. You are responsible for you. Ask yourself why *you* needed to write that. Ever since Montel Williams and Jerry Springer, we Americans think that every thought that comes into our brain needs to come out of our mouths or our fingers. Not so. Restraint is a wonderful thing. Find a creative way of saying what you hope happens to these guys. I happen to hope they will find salvation in Christ, that we all will. So many harsh comments for

So many harsh comments for the jury...just how many of you sat in on the trial and heard all of the evidence or possibly lack of evidence??? Before you start throwing stones, be sure you have all of the facts.

Let's blame their teachers too...

After yesterday's comments on the 58 schools that failed to meet AYP, why not start pointing the finger at their former teachers. Maybe their former teachers didn't do enough to decrease the "achievement gap" between the black and white students. Or maybe, they didn't differentiate their lessons. Maybe they gave them too many zeros for work they didn't do and ruined their self-esteem so they dropped out. Having no education, they turn to a life of crime. Now, the jails are filled with young black men. Oh yeah..don't forget this one, there are more black men in jail than in college. I'm so sick of it. Society blames everyone but the criminal for their crimes. China may have cheated in the Olympics and have a bad human rights record, but there is something to be said about their way of punishing criminals.

Well, my post got deleted too, and all I did was ask if he was for real or out trolling. So, I'll post it again and see how long it lasts. :)

I do think that if a poster is being facetious, he or she needs to be aware that it doesn't always come across that way.

A tiny girl whose life was little more meaningless to a jury, in a nation-state that has even less regard for the unborn, two murderers who were given all the opportunity in America by a slain civil-rights, his followers, and America's wealth-payers to rob a family of life, liberty and the pursuit of happiness. Perhaps YOU and I will think twice before shooting our mouth off about that potential juror questionaire and Call to Duty notice thinking about what we would have done as jurors. Are you built to fight, or built to flight? Does the word Duty make you reel, or make you real?

Just how stupid are we?

This has got to stop! We can no longer take pity on these corrupt punks, hoods or whatever you want to call them. All they do is take the 2nd chance they are given and waste it by performing a worse crime than the first. We need to prosecute to the fullest extent and be prepared to fullfill their punishment. I can not believe that the jury found them guilty of 2nd degree murder. Is it because they shot the wrong person that it was 2nd degree? They need to be put to death! I think this would be a perfect time for the prosecution to file an appeal and retry them on the more serious charge! It's a shame its not allowed. Lock them up, throw away the key, and to their family. Live with it, because the other family is living without theirs.

First of all, it does not matter whether the killers were former altar boys for the church, nor does it matter that they are someone else's "babies." The fact remains, these two opted to break into an occupied home, fired a weapon with no regard as to the consequences of pulling that trigger. Secondly, the community does not need to forgive anyone. If the parents/relatives of the dead infant choose to forgive, so be it. Have a nice day.

I'm sure they've been through alot and need some forgiveness from the community. These two are "babies" of someone and to lock them up for life or give them both the death penalty just wouldn't be fair. Give me a break!!

what a shame

Ya know its sad to say, but I'm starting to get use to this. You can kill and pretty much get away with it. Its not fair and what a twisted world we live in. I have one question whos really the guilty one the killers or our so called justice system?????
