Suffolk prosecutors drop charge in 1998 murder case

SUFFOLK

City prosecutors on Monday dropped a murder charge against Demetrius Neely in a 10-year-old slaying.

Neely, 31, was charged in connection with the death of Malik Powell, who was killed at the Whitemarsh Plaza Shopping Center on Whitemarsh Road in November 1998.

Neely and Dedric Sherrod, of Covington, Ga., both were charged with first-degree murder. A jury convicted Sherrod of second-degree murder two weeks ago.

Prosecutor Will Jamerson said in court that all witnesses involved in Sherrod's trial pointed to him as the man who pulled the trigger.

The arrest of the two men after 10 years was the first by the Police Department's cold case investigation team.

Neely already is serving 41 years in prison for gun and drug charges in Portsmouth. His jury trial was to begin Wednesday.
