Two pit bulls invade N.C. home; family's dog killed

KITTY HAWK, N.C. 

Mark and Diane Kent fenced their yard on Poor Ridge Road so their two dogs could romp outside while they were at work. If their Labrador retriever and bichon frise wanted to go inside, they could head through a dog door to a ground-floor room with heat and air conditioning and two fleece dog beds.

On Monday, two pit bulls got inside the fence and chased the Labrador, Jazz, through the door. She was found in a pool of blood on the floor of the room.

A neighbor spied a bloodied pit bull behind the fence and scooped up the bichon, Zack, the Kents said.

On Wednesday, according to the county, Nikki Canady, the pit bulls' owner, paid the Dare County Animal Shelter a $25 fee for each dog and took them back home. On Friday, however, the dogs were seized under a court order.

Canady does not have a listed phone number to contact her.

"It's unconscionable that these dogs were released back to their owners one day after the attack," Mark Kent said. "I can't understand it. "

Shelter Director Denise Lambiotte said her hands are tied.

"There is nothing in the ordinance that says the county or the animal shelter can hold an animal that's been involved in an animal-on-animal attack," she said.

"I can guarantee you that the Dare County Animal Shelter did everything it could do to persuade the animals' owner to relinquish the dogs to the shelter for euthanasia. She would not do it, and I had no lawful means for keeping the dogs in the animal shelter."

The town police issued a citation to the owner, Lambiotte said.

The pit bulls, 1-1/2-year-old male "Shine" and 4-year-old female "Isabel," each weigh about 50 pounds and are fixed, Lambiotte said.

They had been seen loose in December, were impounded and were released to the owner, Lambiotte said, but there had not been reports of other aggressive incidents.

Even if the dogs had attacked a child, Lambiotte said, the county would be able to do little more than hold the dogs for the state-mandated 10-day quarantine period.

The county health department has begun the process of declaring the dogs "potentially dangerous" as defined in the state statute, said County Attorney Bobby Outten.

Although the law makes the owner of a dangerous dog liable and would require the dog to be confined properly, Outten said, it does not give authorities the right to confiscate the animal.

Outten said the district attorney is reviewing the case, and the county is investigating whether it can draft an animal control ordinance stricter than the state statute.

As a "one-bite" state, liability is not assigned to a dog owner in North Carolina until after a dog bites someone a second time. The state statute, he said, does not deal with the severity of the biting incident or whether the victim is an animal or a human.

Kent said golden-colored Jazz had survived a bout with throat cancer two years ago after undergoing treatment in Raleigh. The 7-year-old dog was doing well.

Now, the couple is so shaken, he said, they plan to put their house up for sale and move. Zack, the bichon who adored Jazz, is depressed and mopey.

An autopsy of Jazz is being conducted by her veterinarian, Kent said. He said he plans to consult a lawyer.

Pit bulls not God's creatures

Diane, I am the person who called you from Mobile AL where I am fighting like a crazy person for pit bull legislation. I have the ear of the city council, the mayor, the chief of police and animal control. It is not an easy thing to do but I would be happy to give you any info I can to help get this done where you live. You can email me at pitbulltruth@yahoo.com or kathybrown200@comcast.net. Let me say this: Pit bulls are not one of God's creatures. God did NOT create pit bulls. Mant did! And the sole purpose for their creation is a felony in ALL 50 states. There are so many overwhelming statistics that prove this I can't believe they aren't banned from this country as they are in 12 other countries, over 250 cities in the US. 11 state supreme courts have ruled they are more dangerous than any other breed and can be regulated accordingly. Pit bull owners; if you tell me your pit has never been aggressive, my response is "YET!"

Justice for Jazz

Let me begin by saying that I have signed the petition to have the two pits euthanized bc what they had done was inexcusable! But what a lot of you have failed to see is that this is not an issue with a specific breed, it is an issue with two dogs and irresponsible dog ownership. As Theresa J had said, the only reason this has been made a bigger ordeal than if it was a husky is bc they were PIT BULLS that committed this act. My heart truly goes out to the Kents and Jazzy, but you need to keep in mind that THESE two dogs and the owners are responsible! If it was a husky, this all would have been over with and chalked up to as an "unfortunate accident". Yes, people with a bad reputation may use these dogs as status symbols but it is not a reason to single this breed out. I have several pits in my neighborhood that are as sweet as the dog next door. I let my kids roughhouse with them and I let the pits play with my dogs. These dogs even sleep with my cat in the sun. I would not for one moment think twice about letting my kids hug these dogs. What are we fighting for?

In reading all the comments I feel that everyone has lost sight of
what has happened. The Kents have lost something very precious to them. If for one moment all of you that are waging a war about "Pit Bulls" vs. Labs" stop to imagine had this happened to your own dogs. I personally think that this story should have brought a dog community together to help these people get justice over what they have lost, not create a place for idiots to determine what breeds of dogs do the most damage. As a pet owner myself I personally would not care what breed took the life of any of my dogs if this ever happened to me. I would feel the same anger, and hurt, and loss, as I am sure the Kents do. I believe that the Canady's including daughter and father need to do what is right here. YOUR DOGS TOOK ANOTHER DOGS LIFE!!!!! It was a brutal vicious attack. It was not an average dog fight. If Mr. Canday is a real dog trainer, he should know this. So I ask all of you reading this, to stop turning this story into your own dog fight, and use your anger to write letters to get better laws that will help protect all of us that love our pets!

Killing of Family Pet Jazz

I am a pet owner. All of my pets are mixed breeds, nothing fancy. Our pets are part of our family. We have two cats both strays. The oldest just showed up one day on our door step and the younger is from a no-kill foster program out of the Newport News area. Then there are our two dogs. The older is 101% mutt that we got from the Meherrin Indian Pow-wow 10 yrs ago and our puppy is cross breed between a Boston terrier and a French bulldog.
I'm not against the Pitt bull breed but I don't care to own one. I live in town and have neighbors on either side and across the street. I respect that fact so therefore I don't want such a dog.
Pitt bulls unfornately have become a 'status quo' symbol. Oh, see what I have mentality! For what ever reason, other than people must have some deep rooted insecurities of weakness about themselves to want to own a breed with a history of violence tied to it. I'm sure some do make good pets but apparently they are a dog that needs to be closely watched at all times especially when more than one is owned.

Aren't you guilty of the same thing you accuse those "SHEEPLE" of by posting a rant on this board without one word of concern or sympathy for either dog owner? Isn't your rant just as insensitive? Some one's beloved pet was killed in a horrific fashion and someone else stands to lose two pet because of it and all you have to say is Yes, but it is not as bad as X and since you are not talking about X you are all "SHEEPLE? Who exactly are these "SHEEPLE?" People you happen to be upset with? Anyone you hate? Anyone you feel superior to? People who are afraid of big dogs? Anyone who doesn't buy into your particular world view?

Get your own house in order. If you are really so concerned about the dog attacks you named (the ones that aren't part of this story) do something about them. Seriously.

More selective caring from the Sheeple

Funny, not one of the Sheeple crying over this "OUTRAGEOUS!!" Pit Bull attack has expressed any sadness over the death of 3 week old HUMAN Olivia Rozek the day before this incident occured. Little Olivia was killed by a dog, but nobody seems to know or care about HER. Strange. Of course, Olivia was killed by a Husky, so I guess her death wasn't "sexy" enough to be reported by the papers, or for the fine Pit Bull alarmists (Sheeple) to care about.

First and foremost, you people should try to educate yourselves on the difference between animal agression and human agression. Secondly, you should try to show some care and compassion for ALL attack victims, not just those whose suffering suits your myopic agenda. Did you know that a four-year old boy was also killed by a dog on January 11th? I'll bet not. Since he wasn't killed by a Pit Bull, his death and suffering also wasn't "sexy" enough to rouse the media or you Sheeple.

Thanks for once again proving how capable of selective caring the gullible Sheeple are! You folks never fail to marginalize the suffering of those who do not further your ideals.

Another loose Pitt on Poor Ridge Road

I am almost shaking too hard to type this. I just tried to go on my daily run. While heading down the road I heard a dog barking and turned in time to see a Pitt mix running at me. He came out of his yard, across the street to where I was - luckily standing next to someone's trash can. The dog chased me around the trash can 3 times before the owner came out of his house and called it. Luckily the dog responded. The guy hollared "did he scare you?". YOU BET! No run today. Shook me up pretty good.

I called the owner once I had calmed down and they were very defensive. Blew me away. Even with what happened to poor Jazz folks just don't get it. I was lucky.

Dog Responsibility

The owner of these pits should know the responsibility of owning a breed as these. NEVER! are these dogs out of complete 100% control of their owners, NEVER!, or any other dog. Also, knowing that this persons dad calls himself a dog trainer here in the outerbanks, she should of unequivocally known this. The owner of these pits are 100% trully irresponsible and should be held liable. It is apparent that both Canidays, daughter and father show this lack of responsibility because this wasn't instilled nor followed through with. Hopefully, the owners of the poor dog killed "inside their home" will take this to the extreme in court to show all that it is our responsiblity to have are dogs in 100% control on or off leed AT ALL TIMES! Legislation has been successful in several states and the US Supreme Court backed them up. Your rights end where another's safety begins. It's in the Constitution and the govt's job to ensure that. Pit bulls are unpredictable and have killed too many already, you can't bring them back. They have escaped high fences and invaded people's homes through screen doors or broken out of theirs all over this country. Google it. Collies were overbred in puppy mills, that's happening to pit bulls now, too. These breeders are like the worst of the hard drug dealers, money first, no matter how many lies they have to tell or who dies. Hoping yours doesn't maul you, good luck, buddy.
