Bill to let restaurant patrons carry weapons passes House

RICHMOND

The House of Delegates on Tuesday passed a bill that would allow people to bring legally concealed handguns into restaurants and clubs that serve alcohol but would restrict patrons with guns from drinking.

Sen. Emmett Hanger, R-Augusta County, introduced SB1035, which passed 66-33.

The House removed a provision in the bill that would have required the person who carries a concealed gun in to notify the establishment's manager. The law would still allow businesses to ban guns inside by posting signs, said Del. Morgan Griffith, R-Salem.

The measure has been sent back to the Senate, where the House amendment would have to be approved before the bill could be sent to Gov. Timothy M. Kaine.

Similar legislation passed the House and Senate last year but was vetoed by Kaine.

Actually, you are the clown. NYC has no problem with anyone who has a permit to carry going out to eat with their firearm. Massachusetts is the same way. I have a MA class A LTC. I can go out to eat anytime I want in that state. In VA, I also carry anytime I go out to eat. I just have to expose it for the world to see and for little old librel ladies to notice and get all huff puffy about. Actually never had that problem but then again, Gertz must not have been around. I'll cue the music, and may the old clown dance to their own ignorance.

with the discussion of banning cigararettes in bars/restaurants was being discussed, NTY was often brought up. It's ony fair to bring it up during gun rights discussions.

Try this stunt in NYC and see how far you get.

Kaine needs to VETO, and the house and senate need to ban all guns from bars and restaurants. Period!

Correction on current law

Current law allows anyone who can legally carry a firearm elsewhere to carry openly in a restaurant. However, they are NOT barred from drinking while carrying openly, only from carrying openly while intoxicated.

The proposed law would require concealed carriers with permits to not drink at all. This is MORE restricted than current law with regard to carrying if drinking.

A person carrying concealed could still drink in moderation simply by removing their jacket and carrying openly, just as they can right now.

Common Sense

Many have already stated the obvious here, but here's just a little more common sense. Current law allows open carry by ANYONE in a restaraunt/bar, as long as that person is not drinking. But what about the other drinker who decides it's funny to start a fight with the gun owner, to prove how "tough" he is or whatever his reason. Or two drunks fighting, see the gun and with perfect drunk logic decide they want it. One of the main reasons I obtained my CHP was because I don't want to advertise. I prefer not to be obvious about my intent and ability to defend myself or my family. And as already stated, those who go through the proccess of obtaining a CHP are among the most law-abiding citizens. If criminals had any shred of concern for ANY laws, these conversations would never happen. Criminals will do anything they believe they can get away with, no matter how many laws exist. As far as the Constitution goes, no matter how you slice it attempt to twist it "the right of the people to keep and bear arms shall not be infringed.", is very clear and very explicit.

MJBOOHER, I can tell too do not know what you are talking about except what the media feeds your little head with. The law states, and every permit holder knows, that you cannot carry concealed in any business that prohibits it with a sign on the door and certain federal offices, schools, and churches. However, you probably will not see too many of these signs because then it would be an invitation for robbery. If a business does prohibit firearms then the permit holder has a legal responsibility to patronize another establishment. Also, a permit holder knows that ANY alcohol in your system during the commission of self-defense is almost a guarantee to be deemed a lack of judgement so you wont often see a permmit holder drinking while armed. There is always an idiot in a crowd but then again I share the road at 60+mph with a bunch of them everyday. The fact is permits respect your privacy and fears so respect ours respecting yours and stop assimilating us to criminals.

MCSEVA, how do you know if someone is concealing a firearm? The whole premise of permits was to appease anti-gun folks and yet there is STILL a problem? I am offended that you assimilate a thug with a permit holder. Until you are put into a situation where a firearm DOES save your life, you get to choose your stance on the issue. But when a firearm saves your life, you learn how insurance CANNOT be guaranteed by anyone but yourself. You have a right to dine where you wish but you DO NOT have a right to dictate my ability to defend myself or my family. If you think you do then I think I have a problem with Bill Gates and think your MCSE is threatening to my OCP and therefore you should have it taken away. Fair? OF COURSE NOT! because your right is more “logical” than mine. To parallel thugs and CHP holders is just as ridiculous as my last statement especially when you cannot cite even one example of a permit holder going postal or doing a drive-by!
