Claims that his police officers used racial slurs while on duty angered police Chief A.M. "Jake" Jacocks Jr., spawning one the most contentious periods in his more than eight years of leading the force.
Jacocks became angry and defensive after a lawsuit filed last year accused police of repeatedly using epithets when referring to blacks, according to e-mails and other messages obtained recently through the Freedom of Information Act.
The police chief seemed especially upset by a lawsuit filed against the department by Hammerheads nightclub. The messages suggest that while Jacocks disputed the claims, he took them seriously enough to initiate a department wide investigation.
"With all the prejudice and discrimination that unfortunately still occurs in our country and needs to be addressed, 'playing the race card' without just cause has always irritated me," Jacocks wrote to a note from Oral Lambert, the city's former chief operating officer.
"This instance, where it is being played for purely financial gain, and by a Caucasian, has pushed me to anger. Of course, our officer's revelation that he and others have used racial slurs in the workplace sent me over the edge."
The response came a day after Jacocks testified at the civil rights lawsuit trial brought by the Hammerheads nightclub against the city.
In December, a federal judge dismissed all claims made by Hammerheads.
On the witness stand in the Hammerheads case, Jacocks maintained that the use of derogatory terms was not widespread. He said he wasn't aware of previous complaints about the use of racial slurs by his officers.
According to department memorandums, 34 complaints of bias-based profiling by Beach police have been made since 2005, including six in 2008. In at least three cases, an officer was alleged to have made derogatory comments and/or racial remarks during an arrest or traffic stop.
All complaints were investigated, and none was sustained, according to city documents.
As the city's top cop, Jacocks is considered a professional who has taken pride in his department's accomplishments while shouldering blame for incidents that might cast his roughly 810 sworn officers in a negative light.
Such was the case in August 2008 when Officer Steven Kennedy, in a video deposition in federal court, acknowledged that he and other Beach police officers had used racial slurs when referring to blacks.
"When you're in a position and you're doing what you know is the right thing and you have people who are critical, it can get discouraging," said Lambert, who now runs Bay Creek Resort and Club in Cape Charles. "I tried to encourage him to stick to his principles. If you're going to characterize Jake, he has the right stuff."
In his first public statement after the officer's court testimony, Jacocks expressed his disappointment and promised to continue efforts to maintain an environment free from any indication of bias. By then, he'd already ordered an investigation to determine who might have used the words.
The investigation isn't over yet, and Jacocks has declined further comment, saying related cases in Circuit Court at two other Beach nightclubs, Chicho's and Crazy Charlie's, are pending.
Jacocks, 56, has been involved in Beach law enforcement since 1971, when he served as a civilian precinct desk officer. Over the next 29 years, he rose through the ranks, serving assignments in the detective bureau, special operations and professional standards before being appointed chief in 2000.
"I have never seen him, as you say, 'over the edge,' " said Lt. J.W. "Max" Hayden, the chief's executive aide for seven years. "Upset, yes, but in control always. While the allegations like the use of racial slurs embarrass and disappoint him, he remains on task and committed to ensuring that whatever may be broke is fixed."
Critics claim Beach officers using derogatory language to minorities is not isolated. To bridge mistrust between police and segments of the city, the department should admit mistakes, said John Bailey, a community activist.
"I should publicly applaud the Virginia Beach chief of police for taking immediate action to resolve the matter," he said. "But I find that hard because he did not say that steps would be taken to see how pervasive the problem was and resolve it."
Results of the Police Department's internal investigation will not be made public, according to a spokesman. That has upset Tom Palumbo, a member of the Hampton Roads Peace and Justice Coalition.
"The long-standing, all-white, city administration has essentially ignored the issue," he said.

Less than 5% of all Civil Rights cases are won....Until the Race card is eliminated It should and will continue to be played. Prejudices in any form from those elected to represent or protect the people is unacceptable.PERIOD

Oceanfront Bars
As a former bar owner/mgr. down there, I can say from experience that the PD at the oceanfront is guilty of alotta things, but I doubt racism.They are ANTI-EVERYONE!!! I truly believe they are reacting to the culture that exists in certain groups down there and the pressure from city hall. Hense the hot under the collar of the chief. Anyone who has tried to make a living down there know exactly what Im talking about. There were times down there when I thought for sure a war was gonna break out.OH, WAIT IT DID.(ofcoarse it didnt make it thru the news black out thats in place at the oceanfront,but thats a whole other story) Im in a different part of the city now, and can honestly say that the atmosphere is totally different. The city has wanted to close "THE BLOCK" for years and I think They put extra pressure on the Dept. to do whatever it takes to make the area unpleasant enough to hit the bar owners in the cash register so they would just close up.. Name me anywhere in the city, or anywhere in hampton roads for that matter that has an avg of 15 uniformed officers,horse officers, not to mention the plain clothed ones at any given time within a 1 block area. Please read the article and don't skim
If you read the article, it stated that the investigation is not complete, and due to the pending court cases, he won't comment. Stop complaining about the results not being made public when the investigation is ongoing. If he had said that the investigation was complete, then I would start to complain. Stop jumping to conclusions.
Virginia Beach Police Chief
Please allow me to speak as a retired Beach Police Officer. I joined the department on March 23, 1959 when Jim Ed Moore was chief. I have had the pleasure of knowing three additional chiefs since that time. Virginia Beach has been fortunate to have had these four chiefs serving the city.
I knew each one to be the most honest and dedicated persons I have ever met. The Virginia Beach Police Department has never had a scandal or any corruption to my knowledge. The department is well known across the country as one of the best if not the best department in the United States. The citizens of the city are blessed to have lived in a city where they had a department like this one. I live outside the city at this time but I brag about it every chance I get.
As far as Chief Jack goes I was a Lieutenant in the first precinct when he was hired and assigned to it. I supervised him untill he entered the academy. From day one I realized that he was an outstanding person. He was the most honest, deticated and responsible recruit I had ever met. I worked with him for over twenty years and never knew of him being racial or tolerating it when he became a supervisor. If he had ever experienced

I am a white female, who WAS interested in joining the local law enforcement. I passed the physical portion of the training as well as the testing portion with flying colors, however, I was looked over because there was one black woman who passed the physical portion and barely passed the testing phase and was offered a spot in the academy. This is something we have to get over, it is called quotas. They are required to hire on a certain percentage of each race that has applied regardless of ones scores. Did it piss me off? Why of course, I felt it was unfair, but to consider that racists...no..it was not the black females decision and she had just as much of a right to be there than I did. Case closed......get over the race card people! As many african americans I know, none of them were subject to slavery.

Disappointed in the PILOT
Whoever from the pilot decided to take jayd's comment down but leave all the responses to it up is not playing with a full deck. His comment was racist, but not offensive. Leave it up so that with can see it for what its worth, and get a good laugh. Besides, all the comments after it make no sense to new readers who haven't seen it.
