Va. Senate OKs bill to let people carry guns in restaurants

RICHMOND

The Senate has passed a bill that would allow concealed weapons permit holders to carry hidden guns into restaurants that serve alcohol as long as they don't drink.

But Sen. Emmett Hanger's bill only cleared the body 24-16, three votes shy of what would be needed to overturn a veto.

Gov. Timothy M. Kaine vetoed the bill last year, and the Senate couldn't muster the votes to overturn it. Administration officials have said Kaine likely would reject it again.

Under the legislation, those who carry a concealed weapon into a restaurant and either drink alcohol or fail to inform management that they're armed could be charged with a crime.

Currently, guns can be taken into restaurants as long as they are out in the open.

You cannot possibly lump ALL CC permit holders as "FOLLOW" the law gun owners. That's like saying ALL police officers are honest and law abiding, like saying all teachers are the best, because they have been educated, that ALL politicians are honest because they were elected. I could go one....

I'm not impressed with any CC permet holder just because YOU think they ALL FOLLOW the law. Absoluteism never did work!

Gertz, do you lock your car

Gertz, do you lock your car when you go shopping or out to eat? If you ARE a CHP carrier with anough disreguard for the law as to drink, why would one follow the way the law is now and conceal carry anyways? If we wanted to brake the law we would, and it would not be important to us at all if a law alows us to do so. Why would one who wants to obey the law break it by drinking?

You and others make a terrible assumption. You assume that every person that has a CC permit is a responsible adult and they ARE NOT.
Just what NEED to you have to carry a gun to a restaurant in the first place. God, I hope I never live in such fear as you guys do. If I did I would never leave my home.

So here is my thing, as a business owner, you DO have the right to ban fire arms from your property, just make sure it is posted in plain site. from experience you get more problems and attention OC than you do CC, I had a gentleman come into the restaurant I worked at once and he was OC and some of my staff were concerned, I explained that it was his right to carry a firearm openly like that, and I have seen other situations were open carry has made others feel uncomfortable. But if you have jumped thru the hoops to have the right to legally CC, then no one is the wiser. And how do you, as a manager, determine "just so you know I have a gun" as a threat or a notification? and if this doesn't pass lets take it one step further, and require that people notify someone that they are driving so they will not be served, more ppl get injured or die from DUI related incidents, than people legally carrying a gun. When you get a license weather a drivers or a CC you are accepting the responsibility that comes with it.

As for the bill and vote, I'm glad to see it advanced, but it needs to be modified to remove the notification clause. The whole idea behind concealed carry is for others not to know you're carrying.

You do realize that this bill deals w/CC and drinking alcohol not just your ability to CC in a restaurant right? If you CC in a restaurant and don't tell anyone, how will they know NOT to serve you alcohol? This only applies if this bill passes of course. Again why is OC not good enough? If you're gonna carry...carry it so everyone can see it and then there'd be no question whether you get served alcohol or not.

Nothing

beats a failure but a 2nd try. Hopefully the Gov will icksnay this again. Why isn't open carry good enough?

This bill should not pass.....As a business and property owner

I should have the final say as to whether my guests should be able to carry a gun into my establishment. I have a bar restaurant and I require any patron that is packing including undercover officers to either leave their weapon behind the bar or not be served. I KNOW that guns and alcohol DON'T MIX. I will not serve anything to anyone packing a gun except officers in full uniform and they won't order any alcohol.

You have the right to carry a concealed weapon. However you don't have the right to carry it where the property owner has made the decision to ban weapons. The property owner/proprietor should always have the final say. If you as a weapons carrier feel otherwise you can take your business elsewhere.
I don't know how Busch Gardens handles it now but they used to ban weapons no matter who you were. It didn't matter that you were a member of law enforcement. If you want to play at Busch Gardens then lose the weapon and that is how it should be.

I could just imagine walking into Pasquale's Original Ristorante, and asking quietly for the manager. Here comes Giuseppe...who looks apprehensively at me. "Buongiorno", he says, "is there a problema?"
"No, no", I say. "I just wanted to tell you that I have a Glock .45 semi-automatic pistol under my jacket", as I reach for my CWP.
"Madonna Mia!", Giuseppe says, "taka the money, all of the money.....no shoot, mister....please!"
At which time, a waiter overhears the conversation, and calls 911. Three minutes later....I'm on the floor and handcuffed. My wife, who slapped the blond lady cop, gets tasered.
And I never got my damned Veal Marsala! (Do you get my point?)
All kidding aside, I'm not crazy about "announcing" to the manager, but I guess it's better than leaving it in the car.

I'm curious, Ted...where'd you get one of those? Except for a federal agent's badge and credentials, I've never heard of one of those.....

If a judge trusts me enough to grant me the permit, then I shouldn't have to announce it to anyone but a cop in the line of duty.

A permit in itself is respect, not disregard, for the law

I and other permit holders have exhibited, under the laws of our land, that we are competent about gun safety because it was a requirement to get the permit. A permit in itself is respect for the law, your neighbor, and more proof of training than it takes to get a driver's license. Gun control wants "sensible" laws but avid gun owners know the real agenda of gun control has which is to start with one and build up to a complete ban. I mean a permit was supposed to be the "sensible" law that gun control wanted for years and yet they want to even restrict the constitutional right of permit holders in the name of "feeling good" despite knowing it doesn't make you any safer. Most gun control advocates feel they should actively restrict things they dont share an understanding of but God forbid should something they DO like get infringed. Do you want your self-defense abilities to be administered by the same people who are managing the bailout that is only making corporate america richer and us poorer? God help us!
