Verdict reached in Ryan Frederick trial; details to come

UPDATE: The jury deciding the fate of Ryan Frederick in the fatal shooting of Chesapeake Detective Jarrod Shivers has reached a verdict. There's no information yet about when it will be announced. Stayed tuned to PilotOnline.com for details as they become available.

Just before today’s lunch break, jurors in the Ryan Frederick murder trial asked to see the DVD video of Frederick’s interrogation in the hours after the shooting death of Detective Jarrod Shivers.

The jury had already asked to hear an audio recording of Frederick’s initial interview with police in the back of a police vehicle outside his home right after the shooting. Jurors could be heard listening to the tape at least three times today and Tuesday.

Deliberations have been ongoing since Tuesday morning. Frederick is charged with capital murder, use of a firearm and manufacturing marijuana in the death of Shivers. Detectives raided his home the night of Jan. 17, 2008, looking for Frederick’s marijuana growing operation. They found no plants and between one-third and one-half ounce of dry marijuana.

Detectives James Thomas and Tom Downing interviewed Frederick at the Chesapeake police headquarters two to three hours after the 8:30 p.m. raid. Frederick told them he fired in self-defense. Prosecutors have maintained that Frederick lied to police about whether he was growing marijuana, and thus could not be trusted about whether he knew he was shooting at police officers.

One can

be questioned after asking for an attorney because he or she continues talking about the subject which led to the arrest. By that action, he or she has implicitly waives that right. His or her attorney can invoke once they arrive. Yet all the defendant voluntarily said prior to that can be used against the defendant.

I talked to about 35 people today about this case ...

Total strangers.But they've been foloowing along.. At the Doctors office, At PetSmart, At Foodlion, And every one of them had the same sentiment. Ryan Frederick should go free. He should be Aquitted. CPD did a bad thing here.

The Judge Should Be Ashamed. Her decision to offer up "any number of lessor charges" - Is beyond reason.

I hope the sentence he recieves is "time served" and he is released quickly.

RF if you do go free, please move somewhere you can live in peace... You will not be at peace in Chesapeake... you can count on being harassed when they fail and look bad... I do insist though you file an immediate civil suit against the city...

Not guilty of using a gun
Guilty of possession of Mary Jane.

I think that's fair enough.

The sentence is 1 to 10 years. He's already served one.

In this case it was probably better he didn't have his attourney present. If RF had clammed up then the jury would not have seen his emotional state and how he regretted what happened and how he did not believe it was the police at his door, etc.

There would be no way to recreate that during the trial. The prosecution proved that with their re-creation of the police raid. It didn't quite add up after the fact.

Anyway the verdict is in, but not announced yet.

Wow..

For those of you that are saying that he asked for a lawyer a few times..Why the hell did he keep answering questions then?!?! If he wanted a lawyer, he could have said so and SHUTUP..As far as Ryan goes, I think he's guilty as hell and I hope he really gets what he deserves. I dont believe for one second that a)He was asleep that early b)He was probably even sober at the time of the shooting c)The police werent yelling "search warrant OR Police!" ..And for everyone that is blaming the police and you state your hatred for the police so much, when you are being robbed or murdered, dont call the people you hate so much!

The verdict was determined when they picked the jury.

What followed was a dog and pony show for the court of public opinion.

I think I need to talk to a lawyer. They say, "Well, at some point you will." Then they continue to interrogate him. How is this possible?

Well during that time, he was under a custodial interrogation which would require that he had been read his Miranda rights. After previously being read his rights, he knew and understood he had the right to remain silent. However, he chose to continue speaking to detectives without a lawyer present, even though he knew he had a right not to speak at all. That is how it was possible.

Here it comes

We will soon see the cheaspeake police dept at fault for the death of one of their own. hopefully, their faulty practices of raids for weed will end. this is also going to open a huge door for a civil suit. justice for the common person.
