Chesapeake will pay $275,000 to settle suit over death

CHESAPEAKE

The city has agreed to pay $275,000 to settle a wrongful death lawsuit stemming from a 2005 crash that involved a Chesapeake animal control vehicle.

The estate of Elwood Couther filed the wrongful death suit after the October 2005 crash at the intersection of North Battlefield Boulevard and Oak Grove Road. The 65-year-old Norfolk man was a passenger in a vehicle that was struck by the animal control truck, according to the complaint.

Some witnesses said the animal control truck sped through the intersection as the light turned yellow, said Chesapeake City Attorney Ron Hallman. He called the settlement a "fair result" and added that the driver of the truck is no longer working with the city.
