Portsmouth judgeship could close over dispute

Portsmouth could lose one of three judges for its busy General District Court because of a feud between local state legislators over who should be appointed to an opening on the bench.

Del. Johnny Joannou, D-Portsmouth, wants his law partner to get the job, but two state senators want the city's Republican Party chairman.

Joannou, stifled in getting attorney W. Thomas Knowles appointed, has suggested to a legislative leader that the judgeship may not be needed, according to several lawmakers.

That option isn't acceptable, said Sen. Louise Lucas, D-Portsmouth.

"It's unconscionable that backroom dealing would get this seat decertified, placing an inordinate workload on our judges," said Lucas, who along with Sen. Fred Quayle, R-Suffolk, wants GOP leader Bryan K. Meals for the post.

The effort to eliminate the seat is "being done for political reasons because I wouldn't agree to naming his partner to that position," Quayle said, referring to Joannou.

Joannou did not return multiple calls this week seeking comment.

The debate over the judgeship was so heated in the final days of this year's legislative session that the issue was left unresolved when the General Assembly approved other judges last month.

House courts committee Chairman Dave Albo, R-Fairfax, said recently that he called for a review of whether the Portsmouth seat should be abolished after being approached by Joannou.

"I have no clue who supports who for what seat because, frankly, I don't care," Albo said. "It's a dollars and cents thing for me."

Albo said it's hard to justify hiring a judge in a recession when Portsmouth has seen a drop in traffic cases in recent years.

The salary and benefits for a General District judge is $221,965 annually, plus expenses for a staff, according to the Supreme Court of Virginia.

If the seat is abolished, the case load would be split between two judges instead of the three that the court has had for decades.

At present, substitute judges are helping pick up the slack after Judge S. Lee Morris retired on Feb. 1.

Chief District Judge Morton V. Whitlow said losing a judge "would simply delay justice pretty dramatically."

"All of our legislators are aware of the intensity here in General District Court," Whitlow said.

"I think they all appreciate this court could not function with two judges."

Whitlow acknowledged that traffic cases dropped 26 percent between July 2006 and July 2007 - they can fluctuate from year to year depending on the number of police working traffic patrols.

He said, however, that there was no significant drop in overall cases.

Portsmouth City Councilman Steve Heretick, a Democrat and an attorney, said he wishes local legislators had talked with city leaders because he believes the court "has one of the busiest dockets in the state."

"I get real frustrated with the city of Portsmouth and its General Assembly delegation living in parallel universes," he said.

Legislators will have another chance to fill the post when they meet for their veto session next month.

If they fail to act, Portsmouth's Circuit Court could fill the seat on an interim basis.

However, that outcome could create more problems because the Senate next year would likely refuse to confirm an appointment made by the court, said Sen. Ken Stolle, R-Virginia Beach.

"It's a time bomb waiting to happen," said Stolle, a longtime member of the Senate Courts of Justice committee.

Its a sad day

I know Bryan Meals and he would make a fine judge. He is a man of character, level headed, and principles. Even Louise Lucas sees that. However it seems that Del Joannou thinks his law partner needs to be on the state retirement plan instead of his own. Why does the Republican House and the Republican Speaker seek to put a Democrat on the bench here in Portsmouth and personally someone who is not qualified as Bryan Meals for the job. What deals did the delegate make? What Republicans did he sell out to help his buddy. I watched Del Melvin, after he promised to support HB 1588 (Mandated Autism Insurance coverage) sell out 7500 kids with autism in Virginia in the Commerce and Labor committee this year for a judgeship and Del Joannou also was on the same committee. I wonder did the Delegate sell out those same 7500 kids or what other deal did he make. Abolish the position. Wow Delegate... how much more crime do you want in this city. This is not some political thing that you can fight about not getting your way. This impacts the lives of all of us in Portsmouth... Democrat, Republican, and just regular folks trying to live their lives. Reconsider your position and show the leadership

Bryan Meals is competent thoughtful choice for the very busy Portsmouth Court system. Politics can muddy the waters and confuse a reasonable solution.

I would feel comfortable knowing that he was rendering judgementi in our fair City.

Is Anyone Concerned

About which candidate is better qualified for the job? or even qualified at all? Why don't we just eliminate all of the judges and let the members of the General Assembly directly handle all matters that now come before the courts? Or since its all politics anyway, why are we bothering to pretend, let's just elect the judges or automatically make the party chairmen or legislator's law partners next in line for judgeships by statute, so that we don't have to keep seeing what a dirty business the administration of "justice" really is in Virginia? Better yet, to balance the state budget, why don't we just sell the positions to the highest bidder in a more direct way? Portsmouth and the State could share the revenue. It could help with the new courthouse and to pay the Lucas defense tab.

Once again, Portsmouth is being disserved by Johnny Joannou. Bryan Meals would make a very fine judge. He is fair, honest and professional. I have known Bryan for ten years. He would be a wonderful addition to Portsmouth's courts. Joannou is just another politician in my judgement. He will do anything to promote his self interest regardless of the effect that his actions have on our judicial system. Senators Quayle and Lucas are demonstrating true statesmanship. Sen. Lucas has redeemed herself in my opinion.

Be very, very afraid. If Lucas is supporting a Republican for a Judgeship there must be some awesome deal going on in the background to enrich her and her family. Here was another chance for the Pilot to dig deeper and report the details but they didn't.

Well, for once I agree with Louise Lucas. We certainly would NEVER want any type of backroom dealings going on, would we? Thank goodness she is keeping an eye on things and keeping us honest! (yes, that is sarcasm) I'm betting already there is a little more to this story than we can see here in this article. Why is she pulling for a Republican judge? Portsmouth should do all it can to protect its citizens and I can't see how eliminating a judge could possibly help. We have real issues here and need the best solution. I hope they do the right thing for us.

About the rest of Portsmouth (not P-Town in my book) but who cares what LL wants. After the crap she has put the city through, again WHO cares. Maybe she is trying to set herself another pawn in place.
