Twist involving Norfolk lobbying firm clouds port deal

Norfolk wants more revenue from a company that has proposed taking over the state's port operations.

But the lobbying firm the city expects to make that case to state officials also represents CenterPoint Properties, the very company proposing the $8.9 billion port takeover.

Mayor Paul Fraim said that poses a problem.

Asked if Kemper Consulting, a public relations and consulting firm, can represent both Norfolk and CenterPoint at the same time, Fraim said: "Probably not."

Fraim said he will meet this week with Kay Kemper, a former Old Dominion University vice president who founded the firm. Kemper was out of the country last week.

"I told them I think that they have a conflict of interest," Fraim said. "Their quick response was that they've been asked to represent CenterPoint only on a limited basis.

"So we're going to talk and figure this out."

CenterPoint's proposal calls for the Chicago industrial real estate firm to take over all Virginia Port Authority facilities, including the authority's 1,200 acres of land. Currently, the state's three waterfront terminals - the biggest of which is in Norfolk - are state property and thus exempt from taxation.

The state provides Norfolk $1.1 million for wear and tear on city streets and lost tax revenue.

CenterPoint has proposed increasing that payment to $3 million. However, Fraim said that is not enough to pay for the services the city provides the port.

Fraim has said he'd like to take the city's case to CenterPoint and to state officials, who ultimately will decide whether to accept CenterPoint's proposal.

The group that would likely do that is Kemper, which the city is paying $111,096 in 2009 for providing advice, drafting legislation and lobbying.

"We have a lot of faith in Kemper Consulting," Fraim said. "They've done a great job for the city.

"But with this issue, it looks like there's a conflict."

Kemper has offices in Norfolk and Richmond and a high-profile list of clients. Kemper's son, John-Garrett Kemper, is vice president of the organization, which also employs former Virginia Beach Democratic Del. Glenn Croshaw as a consultant.

Among its clients are the Virginia Beach schools, Arlington County, Virginia Natural Gas, Eastern Virginia Medical School, the Southeastern Public Service Authority, the Virginia Community College System, the Alliance of Automobile Manufacturers and the 3M Corp.

John-Garrett Kemper said that with the large number of groups the company represents, perceived conflicts sometimes arise.

"We have a process of dealing with these issues in an open, honest and direct fashion with the parties involved," he said, adding that he believes the issue will be resolved quickly.

Too funny

The term 'conflict of interest' seems to be absent from a number of local city councils these days, especially Norfolk's. This is just another example of the bumbling city leaders manage to do. I say let's get them all clown suits so they can look the role they act out.

Kemper Consulting has represented the interest of Norfolk

This consulting group has represented the City for decades so they are already in a conflict of interest. The mayor can state that the consulting firm cannot represent both but they already have and do.There is no way to avoid this fact. This old boys network has got to cease and transparency must be primary in this time or we are bound to the same unprincipled systems that have created disproportions.Enough is Enough. The group is already guilty and I believe both Kay Kemper and son are technically attorneys. Consultants or lobbyists should be held to the same accountability and transparency or there is simply no place in our government for them . Surely this is the root of the entire problems that exist on local, Sate and federal levels. Here is the public having the stay power to demand ethics at long last. Surely, these consultants have benefited by the lack of open government in this state and amassed huge sums of wealth from this network

Will there be an editorial?

Hmmm. Think there will be an editorial from the Pilot about this? I will be stunned if there is. Why? Because Norfolk's leadership is overwhelmingly populated by Dems, the Pilot's chosen party. We had their selective outrage over the $9k that was spent for a speech by VaBeach's mayor recently. In these tough economic times, are these elected officials so inept that they have to hire an OUTSIDE firm to chat up the city's case? Geezz...

Profit at Terminals

Let me see if I have this right??. A private company is willing to take over the Ports and pay the state and city's million's of $$$$$$ for use of these ports. If a company can be able to make this kind of $$$$$$ in profit maybe what the State should do is FIRE everybody that is CURRENTLY in charge and HIRE Professional Managers!!!! This is a typical case of let the TAXPAYERS pay for BUILDING it then my GOOD ole Buddy (KickBACK) can take over!!!.

Kemper fees

Can the city not make its own decisions ? Don't they have an entire staff of attorneys in Pishko's office that can decide whether the deal is worthwhile or not ?
Someone at the pilot needs to investigate all fees paid to Kemper over the last two decades and for what purpose. I'd bet you will find on there some fees for helping decide what to do with Waterside, or a fee to help decide if Winn conflicted with Town Point bid for landscaping, or help decide if George Shinn is worhty of bringing the Hornets here, or if they should move greek fest to Norfolk state or not. C'mon Pilot, take some action. It has to be public record .

I invite you to spend some time observing port traffic lumbering over city streets. In addition to air and sound pollution it is Norfolk that has to repair the streets. What if Norfolk were to close the streets to container trucks and require them to use Terminal Blvd. to the Interstate?

What city services are provided to the ports? I thought they were state property and self supporting?
