Attorneys questioned as ex-SEAL trainee seeks freedom

RICHMOND

Three judges and two attorneys continued to plow new legal ground Tuesday in the case of an ex-Navy SEAL trainee who says he was wrongfully imprisoned in a sensational 1995 Virginia Beach murder case.

Attorneys for both sides in the Dustin Turner case faced vigorous questioning from a three-judge panel of the Virginia Court of Appeals, which is expected to rule soon on Turner's petition for release after nearly 14 years behind bars.

If he succeeds, Turner will be the first person convicted of murder in Virginia to be freed under a 2004 law allowing consideration of new nonbiological evidence of innocence after sentencing.

Last year the appeals court referred the matter to Virginia Beach Circuit Judge Frederick Lowe for a ruling on the credibility of a 2002 confession by Turner's co-defendant and SEAL "swim buddy," Billy Joe Brown, that he alone was responsible for the murder of Georgia college student Jennifer Evans.

After hearing testimony from Brown and Turner and reviewing the trial transcripts, Lowe ruled Brown's confession credible.

That finding was at the crux of sharp, repeated questioning at Tuesday's hearing by two members of the panel, Judges Larry Elder and Cleo Powell.

Turner's lawyer, David Hargett, told the judges that since they delegated the credibility issue to Lowe, his ruling on Brown's confession should stand.

"If it's credible, then it's true," Hargett said. "That was the whole purpose of this exercise."

In his confession, Brown said he had become a Christian in prison and could no longer allow an innocent man to pay for a crime he committed.

Assistant Attorney General Robert Anderson argued that Lowe's finding should be overturned, branding it "plainly wrong" and "a fortune-cookie finding - one-sentence statements with no explanation."

"Are you suggesting that this court should now search the record for evidence that Brown was not credible?" Powell asked.

"It's up to this court to determine if the finding was fatally flawed, and I submit it was," Anderson replied.

Evans, a 21-year-old premedical student at Emory University, was staying with friends in Sandbridge on summer vacation. She was choked to death in Turner's car after the two met at the Bayou, a now-defunct Oceanfront nightspot.

After several days of questioning by police, Turner led them to Evans' decomposed body in a wooded park in Newport News.

Turner, now 34, and Brown, 36, were convicted in separate jury trials that attracted intense media coverage. Turner was sentenced to 82 years and Brown 72 years. Since Virginia has abolished parole, both are effectively life terms.

Turner has proclaimed his innocence from the start, acknowledging only that he is guilty of being an accessory after the fact - a misdemeanor punishable by no more than a year in jail - because he helped Brown dispose of Evans' body and cover up the crime.

Brown gave several accounts of the murder but always blamed Turner until his 2002 confession.

Turner's mother, Linda Summitt, who has campaigned tirelessly for her son's release, said after the hearing that her hopes were buoyed by the judges' tough questioning of the state attorney.

"Innocence is innocence," she said. "It's time for justice. It's time to free Dusty."

Delores Evans, the victim's mother, said she was "dumbfounded" by Lowe's finding that Brown's confession was credible.

Evans noted that Brown has admitted consuming as many as 50 alcoholic drinks the day of the murder: "He was so drunk, how he can remember anything with any specificity is well beyond me."

A waste of tax money! This man may not have physically killed the beautiful young woman, who had a life to live, but he sure didnt do anything to stop the murder! She didnt have a chance to save herself and the one person that could have.. should have.. Dustin Turner, did NOTHING but assist with the heineous crime. Why should this man be given a second chance at living a free life? She never had a chance..
This is absolutely disgusting. I am a mother myself and have tried to place myself in his mothers shoes, God fobid, and I still dont see how you can fight to free someone, even your own child, who did such a horrible thing. Solution send him to Iraq or Afganastan, where all prisoners should be and see if he can fight for his life. Hope someone comes to their senses and does not free him.

Turner could have stopped Brown but didn't, he allowed and watched as a young pre-med student was murdered. If Brown had indeed drunk 50 alcoholic drinks then you know Turner could have stopped him. For the same reason (50 drinks) I have to agree with Turners mother "He was so drunk, how he can remember anything with any specificity is well beyond me." That quote is right, he couldn't, which is why we should not believe Browns confession SEVEN years after the fact. I would believe Brown is trying to get his buddy in murder out of prison more than I would believe Turner's innocence. Turner allowed her to be murdered, likely held her arms down (otherwise Brown would likely have had scratches from her), both of them dumped her body, both of them continued to lie for days causing her family agony. The sentence should stand, not be 2nd guessed 14yrs later.

I REALLY HOPE THAT RICHARD BRIDGES IS SEEING ALL THIS HAPPEN FROM HEAVEN. BRIDGES WAS THE DEFENSE ATTNY TO DUSTIN BACK IN 1995. I AM SURE IF HE WERE ALIVE TODAY DUSTIN WOULD BE FREE. HANG IN THERE DUSTIN. THIS IS EXACTLY WHY I DON'T BELIEVE IN CAPITAL PUNISHMENT. IMAGINE IF BILLY JOE TURNER HAD NOT CONFESSED. DUSTIN WOULD HAVE SPENT 72 YEARS IN PRISON FOR A CRIME HE DID NOT COMMIT. EVERYBODY BETTER WATCH THEMSELVES CAUSE IT COULD HAPPEN TO ANYONE. RIP JENNIFER EVANS.
