The detention camp at Guantanamo Bay has been a blemish on this nation's honor and its international standing, one that will not easily be healed.
Eight hundred prisoners from Afghanistan and Iraq have been held at various times at the naval base in southeastern Cuba, without charge, in violation of their rights, and some have been subjected to prolonged mistreatment and even torture.
As a candidate, President Barack Obama pledged to renew America's dedication to the rule of law by shutting down Guantanamo and ending the use of military tribunals that offered none of the legal rights routinely granted to those facing charges in a legitimate court.
Rather than a fresh break from the Bush administration policies of the past, Obama is meandering toward some indistinct resolution that will probably satisfy no one, though it might be the only solution possible. Obama still favors his original deadline for closing the camp by Jan. 22, 2010, but now says some of the 240 detainees still at the camp should be tried by tribunals.
Some compromise may be necessary, but Obama should provide assurances to the nation and the world that true justice will guide the outcomes of those cases. There must be clear rules and accountability for the past violations of human rights.
The task may be complicated by Capitol Hill. House and Senate leaders are refusing to approve $80 million Obama requested to shutter Guantanamo. They are demanding assurances that the detainees will not be transferred to the United States for trial or incarceration. U.S. Rep. Frank Wolf is resisting efforts to settle 17 Chinese Muslims in Fairfax County. They are being held at Guantanamo because they received training in terrorist camps with the intent to attack the Chinese government.
Some of the opposition smacks of fear-mongering, but concerns are also being raised by members of Congress not known for NIMBYism or an aversion to unpopular but necessary policies.
Sen. Jim Webb questions adherence to "artificial timelines" for closing Guantanamo and opposes any effort to bring detainees to the United States.
Webb told ABC News last weekend he favors Obama's plan to use tribunals rather than federal courts, arguing that it will be difficult to win convictions there for individuals captured in battle without search warrants or notification of their rights. Among those held at Guantanamo are five men accused of helping to plan the 9/11 attacks.
Obama has proposed due process reforms for the tribunals, although initial details suggest they will be limited. Detainees were previously required to be represented by military attorneys appointed by the Pentagon. Prisoners would have some choice of counsel under new rules, although they would still be restricted to lawyers assigned to the Pentagon's office of military defense. Obama wants restrictions but not a ban on use of hearsay evidence at trial. He would prohibit the use of evidence obtained by brutal interrogation measures.
U.S. Rep. Bobby Scott acknowledges that the normal rules governing American courtrooms must be modified for at least some of the Guantanamo prisoners. He believes any new tribunal process must be guided by transparent rules establishing the burden of proof required of the prosecution and preserving basic rights of self-defense. But he said it will be impossible to impose a total ban on hearsay evidence in cases involving international terrorism.
A dependable voice for justice and human rights, Scott isn't quick to compromise on such matters, but the damage done by years of lawlessness under George W. Bush can not be cleanly swept away by his successor.
"We've gotten ourselves in a situation where there are no good answers," Scott said.

Again, one has to..
marvel at the utter hypocrisy of all Obama supporters. HE is the President, and HIS PARTY controls the entire Congress. They cam close Gitmo TODAY, they can dispose of those prisoners in any way they feel compelled to. Yet, they don't. How come? We see the usual whining about everything being the evil Bush's fault, yet we now know (even though the media has done their best to shield them) that the Dems were aware of all such practicies that are now questioned, and many of them actually signed off on them. If they are so evil as deeds, why the agreement from both sides? I love the corner they have painted themselves into. Any investigations will show their culpability in all this. I say let them go forward..
President Obama is right again
If the evil axis of Bush-Cheney-Rove had not broken our laws and opened a torture camp to appease those who believe you can act like a terrorist and not be one, there would be no problem.
The previous mis-administration left a terrible mess behind and it's going to take time to clean up. We are already paying the price for the evil Bush did in the name of national security and I doubt the bill is paid in full.
The poorly informed ideological yahoos who compensate for their insignificance in the real world with their self-important rantings in this virtual world have nothing useful to say.
They, after all, supported terrorist acts by their own government because they don't believe American values and will can defeat terrorism. They are cowardly defeatists.

VP shilling for Democrats again!
The very first sentence sounds like it was extracted directly from an Obama speech. With their usual intellectual dishonesty, the VP confers rights reserved for American citizens onto prisoners of a war that we are STILL fighting! I'd also like to see actual evidence that Gitmo served as a recruitment tool for terrorists. Even the president can't do it. He says it is 'likely' that Gitmo served in such a capacity. Without proof, it's just rhetoric.
How can the VP continue to harp on the 'evils' of the Bush administration while turning a blind eye to the actual Evils of the current one? They refer to the 'lawlessness' of the Bush administration, yet are silent while the Obama regime circumvents the Constitution. In 4 months we have seen corporations and banks effectively nationalized, CEO's 'fired' by the President, and the Democrats assuming powers that the Constitution does NOT grant them. Where is the outrage over that? Or is it ok because it's not Republicans doing it?

Marvel at the cover they give their chosen Messiah, Obama, as he continues to learn that his campaign rhetoric and the reality of the world don't often jibe.

Could you imagine any Republican, like Bush, or gubernatorial candidate Bob McDonnell, backsliding in such a way, on such a high-profile issue, and what the Pilot would have to say about it? Let’s see here, Obama is NOW the President, the Dems control ALL of the govt, and they can’t impose their own policy, it’s all the “lawlessness” of Bush and company? That “lawlessness” that we now know many a Dem signed off on? This is yet another example why the Pilot’s Editorial Board should leave thinking to real adults, they just don’t seem to get it! Why, even that icon of the Pilot, Dem Sen. Jim Webb, agrees with the Bush admin on all this! Gotta love it!

There is no statute of limitations for war crimes. Approving waterboarding, walling, and stress positions that HAVE resulted in death or have violated US treaties will ALWAYS be "problematic" for officials that implemented said policies. Even if you have a 100-day clock running.

The VP says the prisoners rights are violated and that they were tortured. What rights? What torture? Are we suppose to believe that because a far left Op Ed board says it's so? More of the same old Republican bashing from a one dimensional VP with no proof.
Editorial or Political Shilling? Tough Call.

I would love to be proved wrong on this following assessment, but I'm willing to bet that the V-P editorial board has never once excused the Bush administration (or any Republican, for that matter) for any muddled or incoherent position that they may have taken by simply casting blame on problems inherited from the Clinton administration. Winning elections yields a right to lead. With leadership comes responsibility, and accountability. Why, in the view of the V-P editorial board, is this only applicable to Republicans?
It is perfectly appropriate (and very effective) for the Democrat Party to take a "blame everything on George Bush" approach. I'd expect no more from the Republicans, if the roles were reversed. But I do expect more than that from the V-P.
Up 'til now, I've always sneered at the right-leaning comments that knee-jerk accuse the V-P of being a shill for the Democrat position. But it's awfully hard to see how this editorial can be characterized as anything

Can you break from your diatribe to comment on the editorial's topic, that the US is stuck trying to deal with a prisoner camp setup by BushCheney solely to get around the application of US laws and US signed treaties of prisoner treatment? The fact that Gitmo is a rallying point for terrorists and has led to increased radicalism is not in dispute. It is a black eye on the US. Gitmo, punting Geneva, punting Anti-torture ban, outing Plame, waterboarding AlQuada to force false claims of Iraqi connections to start a war.... all Bush admin workings.
Yes Obama is trying to clean up this mess. Yes he did inherit it. Yes these are huge & costly problems. Yes, he cannot right them in 100 days. He is trying to close Gitmo, but fearmongering but the Repubs and the spineless contributions to that fearmongering by Harry Reid are making that difficult.
And your contribution to the gitmo discussion: "Clinton!, Lib media!" How sad.
