Judge speaks against higher in-state requirement for schools

CHARLOTTESVILLE, Va. (AP) —

A federal appeals court judge is speaking out against legislation requiring more Virginians be admitted to state-supported universities.

Judge J. Harvie Wilkinson III of the 4th U.S. Circuit Court of Appeals said during the University of Virginia's commencement Sunday that requiring UVA to admit more in-state students would run counter to the philosophy of school founder Thomas Jefferson. Wilkinson attended UVA's law school and later taught there.

By custom, almost 70 percent of UVA students are from Virginia. Some legislators have proposed requiring a higher-percentage of in-state students at UVA and other state schools.

Wilkinson was among the speakers at Sunday's ceremony, when UVA awarded nearly 6,300 degrees.

It's a school, for cryin' out loud

Does this sound at all to anyone else like affirmative action? Requiring colleges to favor a particular type of student from a particular background?

UVA, like all colleges and universities, keeps its doors open with tuition money. Out-of-state tuition, as everyone knows, is higher than in-state. If they can draw more money from a student living in Maryland or Kentucky or California, then let them.

And what's the rationale behind the legislation, anyway? Protectionism? Virginians are more worthy of an education there than residents of other states? I'm not quite sure I understand why they need this legislation. Don't colleges want to draw students from other states?

Well for every out-of-state student that a college receivng state money admits, the college should have to give the dollar difference between in-state and out-of-state tuition to in-state student grants. Even if the out-of-state student is on scholarship and taking a slot without paying tuition, the differential should still have to be added to the student grant fund for in-state students.

Why??

Why?? Out of state students already pay a penalty for being out of state. I agree they should pay more, but your plan takes money from the budget to reduce the already much lower costs for an in-state student. The only way to make that up, would be to increase tuition. I presume you would suggest that increase be on the already much higher out-of-state students' tuition. As I said before, we shouldn't be discouraging out-of-state students from attending Virginia schools. They contribute more financially and bring the diversity a quality university needs. Too many who have never had the experience think a university education is just an extension of high school. Without a significant percentage of students from other parts of the counrtry and the world, it would be the equivilant of educational in-breeding.

Out-of-Staters should be limited

I have scrimped and saved to send my kids to college thru the 529 State College Savings Plan. They can only attend state run schools or else the money goes to their kids or another family member. If the colleges do not regulate out-of-state students then that limits my Virginia children in the choices available to them in this state. Maybe they need to take the clause "Virginia schools only" out of the 529 plan.

Judge At UVA

Just another lawyer shouting off his mouth, just to hear the echo. No one wants to hear you resoond, opinion, or anything else, well maybe silence would be good from you judge. People are slowly getting wise, Lawyers are ruining our country, you are just another lawyer , so sit down and shut up!

Rather than limit the number of out-of-state admissions, perhaps the Commonwealth should look at increasing the tuition of non-Virginians.

70% is high enough

Santa wrote, "Nobody should care what this judge thinks. UVA is a Virginia school that should be mostly for Virginian's."
The article says, "By custom, almost 70 percent of UVA students are from Virginia."
To me, 70% equates to "mostly". One of the things that makes a university education such an incredible experience is the opportunity to learn with and from a more diverse population; students from other parts of the country, and even the world who think differently and hold positions on issues that aren't necessarily that of the majority of students from Virginia. That diversity of experience and thought that students from other places bring to Virginia colleges benefits those Virginia students who may otherwise have had no contact or interaction with anyone from another place.

Sounds like a really inspirational commencement speech...

...nothing the graduates would rather hear more than a discussion about in-state admissions as they head off to new horizons!!! Who selected the judge to speak and why???

U.Va. is mostly a Virginian school

69% of students are Virginians. Specifically, this is what Judge Wilkinson said: "I have heard it said that there is a movement afoot to legislate strict limits on out-of-state enrollment at this and other state universities. Not only does this run counter to the very premise of broadmindedness in public education, it is also contrary to the vision of our founder. He was a Virginian first and foremost. But the founder did as much as any person to establish a transcontinental nation. His copious correspondence with Enlightenment figures beyond our shores showed his vision to be international in scope. This great Virginian understood that both the Commonwealth and the University would be immeasurably enriched by opening doors to those beyond our borders. We have always done this and may it always be so."
