Virginia Beach to vote on revised noise plan today

Virginia Beach is taking another shot at a noise ordinance after the state Supreme Court decided last month that the old one was too vague and, therefore, unconstitutional.

The new proposal, which the City Council will vote on today, would specify what decibel levels are too loud, during what times, in neighborhoods, restaurants and cars.

"This is not our preferred ordinance - we had our preferred ordinance," said Chris Boynton, a deputy city attorney. "However, in light of the Supreme Court's decision, we feel that this is reasonable."

The court's ruling has forced several Virginia cities to reconsider their noise laws. Norfolk changed its ordinance two weeks ago.

In Virginia Beach, under the proposal, 55 decibels, or the equivalent of some dishwashers, would be too noisy at night in residential neighborhoods. Car stereos turned up so somebody 100 feet away can hear it would also run afoul of the law. The s ame goes for late-night restaurants where the music registers at 75 decibels, about the sound of a very busy street, or can be heard from 50 feet away.

The penalty for violating the rule also would be more severe. The fine would be doubled and could be up to $500. A second offense could lead to a six-month jail sentence and a fine of up to $1,000.

The fines would increase because making the law more specific will cost Virginia Beach money, Boynton said. The city has to buy meters to measure sounds and train officers to use them, he said.

Still, it's not as tough as Norfolk's and Chesapeake's laws, Boynton said.

There, violators can go to jail on the first offense, he said.

Neal Insley, a lawyer who represents some Oceanfront and Town Center restaurants, said the proposed ordinance is better but still has flaws.

For example, there is an exemption of city-sponsored or permitted events, Insley said.

"If somebody is going to be held criminally liable, it should be applied to all," he said.

Kevin Martingayle, the attorney who represented the Peppermint Beach Club against the city in the Supreme Court case, said he is disappointed that restaurants and hotels weren't consulted about the new ordinance.

There wasn't enough time to gather public input because Beach officials want to have a noise law in place before Memorial Day and the start of the tourist season, Boynton said.

Susan Baroody, who lives near the Lake Edwards area, recently called police because of some rowdy neighbors and was told nobody could be charged because the noise ordinance was unconstitutional.

"This is my little sanctuary, and I want it to be safe and somewhat quiet," Baroody said.

Jet Noise---it is 9:45pm!!!!

I am so angry I can barely write--but I will attempt. Of course we should have noise ordinances and of course they should be adhered to by the FEDERAL GOVERNMENT. It is incredible to me that this level of noise is even legal....and that our Department of Defense is ok with it. I am just beginning my research and I will find a way to ensure that my daughter's hearing aids and antipychotics are paid for in 50 years. You know that this is damaging our hearing not to mention our nerves! Yes I did buy knowing that I our house is in a high noise area. However at that time they did not have the F-18's. I do not mind the other jet noise, but those things are unreasonably loud. And, why on earth they must fly at 9:30 is so beyond me!!! It was dark an hour ago. Why are we even discussing car stereos? At my house the jets are louder than 50 car stereos blasting 10 feet in front of me all at once.

Oceana now has to go! Thanks lawmakers!

Whenever I hear a jet violating my right to peace I will be calling the police to file a noise complaint. After enough of these fines the base will be forced to up and leave. YES! If the rules are in place for noise violations it must be for all aspects of life including extremely obnoxious obtrusive noise from aircraft. Thankyou Va Beach lawmakers! Reelection for all!

Wrong about car stereos

One hundred feet is way too much allowance for car stereos. No one but the people in their own vehicle should be able to hear them. The proper distance should be three feet outside the vehicle or one pace. The amount of hearing damage heavy bass music does is tremendous and it irritates people too, being one of the causes of road rage. The city of Virginia Beach should really re-think that one.

Stock investment

Time to invest in hearing aids.. Statics shows that the younger generation will need earlier then any generation in history.

Driving to work today with all the window rolled up and traveling 60mph and heard the truck thump, thump thump could feel it in my truck...... Kid in a suv directly behind me. That's needs to be stopped, I'm sure he can hear an emergency vehile coming..sure he can!

You have it all wrong

It's not about the enjoyment of "music"...it's all about "I can do what I want when I want, and I'm in your face, and I dare you to open your mouth and challenge me." Thug mentality.

Noise

Some people who comment have no common sense. It must go with the music they play in their car. The louder the music, and the higher the bass, the less common sense people have.
People who moved in the area where Oceana is, has no one to blame but themselves. They moved into that area after the base was there. Those jets are helping to keep our country free.
People who comment, "What about emergency vehicles." One day, those emergency vehicles maybe saving your life.
I can have my music on in my car, without turning the volume very high, and hear the music, and enjoy it.
I guess some music(or noise) that people play in their car, is not any good unless it is loud. When I can feel it 5 cars away, or inside a 7-11, even when the person is not in the car, is stupid. You lose your hearing. OHHHH!!!! maybe that way these people can sue the stereo manufacturer.(* I am waiting to hear someone do that *) We do need a better noise ordinance, because there are too many people with no common sense.

Noise ordinance

I live 9 blocks from the ocean front. When I moved in, I was told the noise level was 75 dec. That was in 2001. I can tell you, that with the introduction of the F-18, the level has risen to over 100. I sit on my porch, and when those jets fly over, they actually cause physical pain to my head and ears. They fly so low, I can see the pilot in the cockpit, actually observing his face mask! Yeah, the sound of freedom. I don't think the sound of freedom includes deafening the residents they fly over. Some days, they continuously fly over ALL DAY LONG. C'mon, if you're going to pass a noise law, let it pertain to everyone.

Since we supposedly need the master jet base, Oceana, I don't see a viable law being passed. Just a waste of time and resources.

Jets before people

I really cannot believe all of you people that complain about the jet noise. The person that complained about the approaches; have you ever flown a jet or know why they do simulated carrier approaches?? I am thinking you probably have not and do not know why. I live by Oceana, and bought my house with full disclosure of the noise. So if anyone lives near a base it should be no surprise that there is jet noise. The base has been there since around 1943ish, if you do not like the noise then mover or better yet, you should have never bought there.

Too hard

Too hard to enforce. Measurement of noise is a highly technical field...good meters are expensive and have to be calibrated as well as the calibrators. The cheap ones from Radio Shack are toys. Free field or far field? Steady state or impulse? Slow response or fast? Logarithmic calculations. For every 3 dB increase, the sound power doubles. If you don't know what I'm talking about, then you don't know how to measure noise well enough for a court case. Why are city events exempted? Why, because then the Amphitheater would be out of business. I pity the poor people who have to listen to THAT all summer.

emergency vehicles

Seriously...let's hold emergency vehicles to the noise standard? While you're tucked in your bed at 3 AM there are emergency workers working the midnight shift to keep people safe overnight. By all means, let's tell the guy who just got shot, or the woman who is home alone and hears someone breaking into her house, or the people whose house is on fire, or someone's grandfather who is having a heart attack to just deal with it...we'll get there eventually. God forbid we wake anyone for a few seconds as we race past your house with our sirens on.
