Gun-rights activist again sues Norfolk over '07 arrest

NORFOLK

A Yorktown advocate of the right to openly carry firearms has filed another federal lawsuit over his one-hour detention during the June 2007 Harborfest, this one alleging excessive force against four policemen involved.

Chester "Chet" Szymecki Jr., who is proceeding without a lawyer, alleges that intentionally tight handcuffs and his physical removal from the festival site at Town Point Park caused pain and aggravated existing neurological problems. He seeks $2 million plus costs.

The local criminal charge against him over wearing a holstered .45-caliber handgun at the festival was withdrawn. Virginia law prohibits localities from regulating firearms.

The city settled a previous federal suit over the constitutionality of his arrest with a $15,000 payout before a scheduled December trial but admitted no wrongdoing.

City Attorney Bernard Pishko said Thursday that the city's position is that there was no excessive force.

"The officers' version doesn't confirm Szymecki's allegations," Pishko said.

While I'm for gun rights I believe this guy is just going for the money....

He has already gotten enough. Don't get greedy folks when it come to our tax money!

Stupid still isn't fixed!!

Born and raised in the land of Mark Twain, hunted my entire life own guns and think that everyone who can legally own one should. You sir have missed the point. I am for your right and mine to carry a weapon; the only difference is I want people to be more responsible when carrying their legal weapon. I happen to be a conservative with common sense that appears to be lacking here lately in the big picture of our society. Trusting you would be that last thing I would ever do, you’re probably as competent as our government in that matter. You consider yourself a vet, probably a two year wonder that never amounted to much but thank you for your service. The only laughing I do is at your “street smarts”, now that cracks me up!

Your challenge of law enforcement officers taking a bullet for a citizen….hmmm. The first thing that comes to mind was the L.A. bank shoot out, more local and recent a NPD officer off duty stopping an armed robbery of a gas station…do I need to go on. Get over not being qualified for duty as a police officer and move on.

The Police Should Know...

For a long time, I did not know that this was an open carry state. Then again, I did not carry a weapon. The officers that harrassed this man should have known better. Now they cost the city of Norfolk $15,000 and maybe more if the courts decide to favor him. With this in mind, I think that there should be some real thought put into some of the laws that are enforced here. Take the Ocean Front. You are not allowed to speak vulgar language. Does that conflict with the right to free speech? Take that in mind while the police are out and about ticketing people for saying an "inappropriate"word. I find it sad that a place that could be so nice and fun, just has a dim idea of what's best for the people.

Maybe all localities will learn a lesson because of Norfolks stupidity! If more folks carried, concealed or open maybe crime would be lower, shoot the other way doesn`t work very well! Carry on sir and good luck!

...but I have met the guy at a military function. Nice guy, well educated, pretty normal in every respect.

We spoke of the military and the injuries we both had while serving in the line of duty. Both of his legs were broken with bones sticking out, the military docs planned on amputating one but he beat the odds and kept the leg. His right arm was almost torn off and he still has permanent nerve damage along with limited use. His face was smashed so bad his wife said they didn't recognize him at first.

I see him on occasion and he always has his pistol. Does not bug me, I mean, what is the problem with a good guy carrying a firearm for protection?

Mr. Clemens wrote in the hopes that the public might learn from his vision and you missed it; "Letters from the Earth" comes to mind. Do you understand why you have the right to bear arms? Self-protection come to mind? Most, but not all[me], gun people are conservative and want less government. PSO's are the government. Why do you count on the government for your security? Trust me, they will fail you,(9-11). Uncle Timmy tried to bring it to our attention, but you were not listening. I do not count on any governmental agency to take care of me; I rely on myself and my street benefits from it--ask them. [It is hard to write when one is laughing.] I challenge you to give an example of a PSO taking a bullet for a citizen? That's what we vets are for.

Know the law......if you are the ones getting paid to enforce it

If you dont like the law..change it, otherwise keep your mouth shut. This man was arrested for NO reason. He wasnt breaking any laws and I hope he gets some cash for his troubles. Open carry is the law in Virginia.

If you broke the law would they not fine you? If you are late with your taxes do they not penalize you financially? Is the uninsured motorist fee a legal bribe if having no auto insurance is illegal? The government and it's officials are not ammune to the laws they set forth.

Do you have any evidence to support your claim? Virginia concealed carry permit holders have the lowest violent crime rate in the state. I have had my permit for over 4 years, and I've never felt the need to used my weapon to coerce or threaten anybody. Making up "facts" to scare people just shows your own ignorance.

Norfolk citizens promoting criminality?

Judging by the comments from some of you here, you prefer criminals to actual law enforcement. If that's the case, then not only do you deserve the high crime rate, but you also deserve to be put under the boot of your thugs with a badge.

I speculate that the guy has gotten tired of the chronic pain caused by excessive force and decided to exercise his legal right to seek compensation.

Think of it this way, our

Think of it this way, our taxes pay police officers to enforce the law.
Our taxes are now going to be used to pay a man who was following the law.
So which makes more sense? Paying a cop to brake the law, or a man who embraces it?

I personally don't like to open carry so I keep it hidden mostly, but the law is the law. I also don't like pulling up to the gas station with my two year old and hearing someone's radio blaring (cause the car door has to be open while you pump gas right?) with lyrics that say "nigga this and nigga that. where's my ho at?" and much more graphic stuff. Actually I don't just not like it, I HATE it. If you want to disrespect yourself then go ahead, but don't teach my daughter words that she may pick up and use in public cause she does not know any better yet. A two year old spouting off the word "nigga" trying to be cute can be very uncomfortable at IHOP. I respect the law of the land though so I can't just go over there and break his jaw. If I do break the law, then there is a penalty to be paid and a badge does not exempt you from the laws that we must follow.

The Moral of the Story

Cuffs too tight? Slammed to the ground for "resisting"? Another arrest on your record? Like the cops say: "It's not the rap; it's the ride". And they didn't pay the $15k - the Norfolk taxpayers did!

oh my god you people are unbelievable. this guy is a loser. i would be willing to be hes out of a job and needs the money. so what your handcuff were too tight, get over it. 2 years later, really? if you cared so much you shouldn't have settled for 15k.
