VIRGINIA BEACH
Mark Hardman, who is running for commonwealth's attorney in Virginia Beach, has accused incumbent Harvey Bryant of being corrupt and weak-willed. But Hardman has saved his harshest words for his former boss, Portsmouth Commonwealth's Attorney Earle Mobley.
Besides accusing Mobley of cronyism, Hardman recently ripped him for allegedly turning a blind eye to illicit activity at work. In postings to his campaign Facebook page - under a note titled "Tyranny of Harvey Bryant and Earl Mobley" - and an e-mail complaint to the state bar, Hardman says Mobley knew one of his prosecutors
had sex with female prostitutes in the office but he took no action.
"We played along with it for a long time, but now it's getting to the point where we're thinking about hiring a civil attorney to sue him for slander," said Bill Prince, spokesman for the Portsmouth office, noting that Mobley was weighing whether to file a bar complaint against Hardman. "You know his motivation in all this is to sully Earle because he lost his job, and to get some free press for his pathetic campaign."
Mobley fired Hardman in March after Hardman announced he planned to run for the Beach's top prosecutor post.
Hardman, a 2007 graduate of University of Virginia's law school, worked five months in Portsmouth. He claimed Mobley infringed on his right to run for public office and that Mobley was protecting his friend Bryant.
Hardman has accused Bryant of lacking integrity and failing to file charges in some cases, including the April 19 crash that killed bicyclist Daniel Hersh. Bryant said filing charges without proper evidence would be unethical and unprofessional.
Meanwhile, the accusations of prostitution in the Portsmouth office infuriated Mobley, who said he had "absolutely no knowledge anything like that has ever taken place."
The Virginia State Bar does not release information about complaints unless disciplinary action is taken. But in a document dated June 30 and provided by Hardman, the bar responded that it would take no action on his claim of prostitutes in the Portsmouth commonwealth's attorney's office.
"Doesn't that tell you something right there?" Mobley said. "Yet I get dragged basically through the mud. That's amazing. I thought he was running against Harvey Bryant."
Bryant described Hardman's recent claim as "just outrageous."
"That is just wild, desperate stuff from a guy who can't get attention any other way," Bryant said.
Hardman has made the issue a part of his campaign. On his Facebook page, he offers this slogan: "When executive officials use government offices to sexually exploit women, I will not rest until justice is served."
He acknowledged he did not witness prostitution in the office but said he heard about it from other attorneys.
Two of the prosecutors he mentioned as knowing about the story were contacted for comment. One, a former Portsmouth prosecutor, denied hearing about it. Another, a Portsmouth prosecutor, referred questions to the office spokesman.
"It is an outrageous lie and unsubstantiated assertion," said Prince, the spokesman. "Never have we ever heard of anything like that."

Your Tax Dollars At Work
Nice to see how our elected and appointed city officials are using our tax dollars for their sidebar antics. Lawyers, wanting to be politicians and trying so hard and doing anything to achieve the fame they seek. What do you expect when you have others in higher positions that cannot lead by example. Portsmouth needs to clean up their act and it needs to start at the top. Get rid of those who cannot govern or lead by example because they bicker among themselves or try to personally profit by using their elected city or state position . Maybe they just have to much time on their hands and their positions need to be abolished. We sure are not getting our tax dollars worth.
this just cements harvey's position
Unless there ends up being real substance to these very serious claims, this guy Hardman has just become no better than a clown who's risking losing his law license.
Which is entertaining enough -- but the trouble is, when it's all over, Harvey Bryant will be able to point to his reelection with 92% of the vote (or some such high number): the status quo, dramatically reinforced.
It would be great if a serious candidate stepped out and took the time and trouble to give Bryant a real challenge. I would love to see the good ol' VB Republican establishment get a real shake-up -- but it's not going to happen through the likes of Mark Hardman.
I just lost 10 IQ points
I just lost 10 IQ points reading about this guy. Graduated from law scohool in 07 and already wants to run for CA ? How about this. Get a job. Hold it in your chosen profession for a few years and then come back and see us again.
Geez...what a joke.
unethical and unprofessional
Maybe hs should use those word as his campaign slogan since he seems to be heading that direction.
False unproven accusations.
Wants to file charges without evidence.
And use of Facebook to run a campaing? Is this kid still in high school?
Hardman a Joke
Here is someone two years out of law school with little to no prosecution experience that calls himself a candidate to be the top prosecutor for one of the largest cities in Virginia. He has absolutely no credibility as a candidate so he has to resort to name calling and false accusations against his opponent or anyone else who has any association. It is truly sad that this guy is even given a forum for his childish behavior.
Hardman is out of line
If Hardman was reading his own resume (not even two years out of law school, less than nine months of experience as a prosecutor, has never tried a felony jury trial) he wouldn’t even vote for himself! There are few things more dangerous than a prosecutor who believes we should be indicting people for crimes for political grandstanding rather than evaluating the evidence.. His “allegation” against the Portsmouth office is the text book legal definition of hearsay evidence; if he fails to grasp something so rudimentary it’s little wonder that he was fired from that office to begin with.
He reminds me of Don Quixote, jousting at windmills.
Beach prosecution candidate?
With Mr. Hardman's mud slinging, he sounds like he's ready for congress.
Hearsay
Shouldn't someone who wants to be Commonwealth's Attorney know what hearsay evidence is?
Slander...by a guy claiming to seek justice
This is indeed pathetic. Running to the press with no facts, no witnesses, and only water cooler talk? I hope his self-proclaimed desire to not rest until justice is served comes back to bite him in this case.
This is just an attempt to get free press by a kid fresh out of law school with no experience. I remember reading in a previous article that he only worked at the Commonwealth's office in Portsmouth for less than 6 months (I don't remember exactly how long) before he was fired. And he's running against a guy with over 30 years of experience? No wonder he is trying to create issues.
Bill Prince Incompetent?
"We played along with it for a long time, but now it's getting to the point where we're thinking about hiring a civil attorney to sue him for slander," said Bill Prince, spokesman for the Portsmouth office
Wow, Chief of Staff for a Commonwealth's Attorney and he doesn't know the difference between Libel and Slander. What a joke.
