Lawsuit now accuses Xe contractors of murder, kidnapping

A just-amended lawsuit alleges six additional instances of unprovoked attacks on Iraqi civilians by Blackwater contractors.

Three people, including a 9-year-old boy, are said to have died.

Also added to the suit is a racketeering count accusing Blackwater founder Erik Prince of running an ongoing criminal enterprise involved in, among other things, kidnapping and child prostitution.

The latest charges, filed this week in U.S. District Court in Alexandria, bring to more than 60 the number of Iraqis allegedly killed or wounded since 2005 by armed Blackwater contractors guarding U.S. diplomatic personnel in Iraq.

The Moyock, N.C.-based security company, since renamed Xe, earned more than $1 billion under that contract before the State Department, under pressure from the Iraqi government, let it lapse in May.

One of the new plaintiffs is the estate of Akram Khalid Sa'ed Jasim, 9, who died when Blackwater shooters allegedly opened fire on a minivan returning from the Baghdad airport on July 1, 2007. The boy was traveling with his extended family, who had gone to the airport to apply for passports.

The Blackwater guards also shot the boy's mother in the back as she bent over trying to shield her 3-month-old daughter, who nevertheless was shot in the face, according to the lawsuit. The boy's father, uncle and cousin also were wounded.

The racketeering count added to the suit this week accuses Prince's companies of engaging in murder, weapons smuggling, money laundering, tax evasion, kidnapping, child prostitution, illegal drug use and destruction of evidence.

The companies are accused of carrying out three or more kidnappings using three airplanes, identified in the suit by their tail numbers. Susan Burke, the plaintiffs' lawyer, said Wednesday that the kidnappings appear to have been so-called "extraordinary renditions" in which suspects are taken to other countries for interrogation.

The child prostitution charge involves young Iraqi girls allegedly being brought to the Blackwater compound in Baghdad's fortified Green Zone, identified in the lawsuit as the "Blackwater Man Camp," to provide oral sex to contractors for $1.

The purpose of the racketeering allegations is to demonstrate a "pattern of illegality" by Xe and its affiliated companies, Burke said.

If the court rules against Xe on the racketeering count, it could dissolve the company or place restrictions on its future activities.

"What we're very, very worried about is this company hurting other people going forward around the globe," Burke said. "They're moving into Africa, they're moving into other places, and we believe they need judicial supervision."

Anne Tyrrell, a Xe spokeswoman, said the company "rejects these allegations, which are largely identical to past allegations made by the same group of attorneys in other, unrelated cases."

I would like to have

this question answered:

If it is true Xe is still operating in Iraq without a contract, and IRI is the "sponsor organization" if you will behind these operations, and John McCain is the chairman of the board of ISI, why isn't he held in conflict of interest, since his committee would be responsible for overseeing the part of Military Contracting dealing with Civilian Sub-contractors?

Regarding the Pilot and XE,

Xe is not the military. Within the context of Xe and Iraq, they are part of the State Department. The Pilot does a huge disservice to the men and women of our Armed Forces when they associate Xe and the actions they do with our Armed Services and the good work that is happening over there by our true military arm.
I wish the Pilot would associate Xe with the State Department, not the Defense Department.
Xe is a mercenary organization. They are guns for hire. They have NOT demonstrated the same core values our military has. Our Armed Forces have not been expelled from Iraq for actions against the people of that State. Xe has.
Just because they wear camo gear does not make them a military organization. It just makes them a group that carries guns. A huge difference. Xe's actions are NOT representative of what our guys/gals are doing over there and the Pilot should acknowledge this. They should stop "tagging" Xe as "military".

We do not know if this is true and only time will tell. The one thing that is evident is this company does business covertly. This company has proved that using a private military does cause big problems with oversight and accountability.

The billions of dollars this company has received from our tax payers have put a bad stain on the United States reputation. I would like to know, why are our tax dollars being used to continually bail this company out?

I would like to know why our military people just don’t get paid more?

Use this money for our active duty and retired military.

Some things don't change

Mercenaries get bad names. From Wikipedia:

Its just a news story

Its a story of what they are said to have done. The real deal will be in the courts and dealt with there. If it was done here to your family and nothing was done you would be yelling form the rooftops yourself.

Do all of you actually believe the stuff in this article?
Think back to Vietnam if you can...all the negitive reporting on what our soldiers were doing accomplished exactly what the enemy in the field could not - distruction of the will to fight.
Now America is "smarter" and we do not put down our uniformed soldiers, but it is ok to attack the contractors because they are just doing it for the money. And writers like Bill Sizemore and Jeremy Scahill are just doing a public service and have no personal interest. How much money has Scahill made by bashing Blackwater? Much more than those "mercinaries" he keeps stabbing in the back.
And the will to fight evaporates. And when we get attacked again, will the warriors want to fight knowing that they will be spit on in two to three years?

then that this well-run, patriotic organization keeps getting brought up in lawsuits, criminal charges, and has been found at fault for under preparing its "mercinaries" in 2004 (in addition to roadblocking the investigation into the massacre in Fallujah)? there may be some "untruths" in some of these complaints, but there is a lot of smoke and we all know that saying.

Give too much power to anybody and they will eventually abuse it. Just as we gave Bush unprecedented authority to initiate an unjustified war. No-bid contracts with complete immunity.. with Iraq not willing to renew their contracts. If they did excellent work wouldn't they be happy to keep them? USA is still accountable for loose cannons whether military or contractors.

Also, them being as secretive and classified as the CIA what would they actually let the public know? Use some common sense..

In one of the last few stories the pilot ran about Blackwater it was determined that they won their contracts through normal procedures. Don't worry I'm not surprised you missed it, it was the very last line of the entire story, added almost as an after thought. And the State Dept. wanted to keep doing business with them, the Iraq govn't is who wanted them out, partially because the public opinion of them over there has been run into the ground thanks to the media. And did you think the reason they are "secretive" is because of who their clients are and it is probably classified?

Blackwater corruption

For those who didn't see the the testimony before Congress, 2 or 3 former contract workers testified that the person or persons in charge of MWR(recreation services) for the troops in Iraq were overcharging by making the workers count individuals as they moved from room-to-room versus only counting them entering the facility. They get paid only as they come in, not as they go from room-to-room.

The worst of their testimony is when they talked about the lack of oversight on the electrical work which has wounded or killed at least 2. Taking a shower was a life or death toss-up!

Blackwater had nothing to do with MWR. I believe you are thinking of KBR / Halliburton. KBR was also responsible for the electrical work about which you're writing. They are definitely guilty of manslaughter at the least - a guy in my unit was electrocuted while taking a shower at our base in Baghdad during one of my tours.

and that's not all.....

I also heard Blackwater is responsible for the crucifixion of Christ, the Lions going 0-16, GM going bankrupt, Bernie Madoff ponzie scheme, Katrina hitting New Orleans, the baseball steroid scandel, global warming and the HRBT being closed this morning.

Is the plan of this lawfirm to try and make Xe go broke by bringing frivilous lawsuits against them? This has turned into some ridiculous witch hunt and Bill Sizemore you are sensationalizing these people every time you happen to write negative stories about Blackwater (no matter how bogus or far out there they may be) but just happen to never write about any of the positive things they have done. What do you just print whatever these people email you negative about them? Good grief.

If the shoe were on the other foot

If armed outsiders came to this country running guns, drugs and prostitution and shot a couple locals, including children, to establish their "Green Zone" hood you'd call them a violent street gang and scream for higher immigration standards and more armed police to protect you; but since the alleged thugs are ours, its a problem of too many lawyers?!

How come no one's asserting the right of individual Iraqi's to carry guns to protect their families from these goon squads? Clearly every Iraqi should have free and unlimited access to firearms for defense if threatened since governmental agencies are not obligated to protect them. After all, that's the freedom these mercenaries, oops "contractors", were there for in the first place, right?

First, Blackwater hasn't been found guilty of "running guns, drugs and prostitution." Second, the Green Zone wasn't a Blackwater creation. That was the US government. Third, Iraqis are allowed weapons, to include fully automatic AK-47s. Fourth, Blackwater contractors weren't there to fight for Iraqis' freedom - they were there to safeguard Department of State diplomats, and considering not a single diplomat was killed while under Blackwater's protection, I'd say they accomplished their mission.

I wish your zeal for besmirching Blackwater were matched by a zeal for facts or the truth.

It's really sad how many people think it's ok that innocent civilians are being brutally murdered overseas - just because of their nationality. You're right - if the shoe were on the other foot, hell would break loose.

A good friend of mine did two tours in Iraq, and he's told me stories that would give anyone nightmares. It's no big deal to them to kill civilians who are in their way. In fact, most of these crimes never gets reported.

Blackwater by Jeremy Scahill

If you want to learn the facts about Blackwater, read Blackwater by Jeremy Scahill. These charges are just charges and they may be false. But, before people jump up to defend Erik Prince, they should read the facts. It is a bad idea to hire mercenaries to fight our wars. Bush and Cheney lied to the American people from Day one. They hired Erik Prince because he was a huge donor to the Republican party and he turned around and put key Republicans on his payroll like Anne Tyrell, his spokesperson who is the daughter of Emmett Tyrell, the columnist for American Spectator. They gave Blackwater immunity from prosecution for anycrimes they committed in Iraq including murder. This is what happens or as Rumsfeld said, "Sh-t happens", especially when you go to war unprepared and without a plan for securing the country.
