Portsmouth mayor's former assistant seeks amends

Mayor James Holley's former secretary is seeking compensation for abuse she has received from the city, her attorney said Thursday.

She "received substantial harm, because she was abused, treated improperly" Marcus Scriven said Thursday at a news conference in his Virginia Beach office.

Scriven said he has approached the City Council about finding a way to "make her whole and put her back to the status quo."

Scriven did not name his client, but city documents and officials have identified her as Lorraine Stokes. He would not go into specifics about what she is seeking, aside from continued employment.

"She respects the mayor for what he has done," Scriven said. "She respects what he has represented for the area in the past. And she's making no judgment about him today and what his future should be as mayor."

Holley, 82, has faced scrutiny since The Virginian-Pilot reported last week that the council fined him $2,500 following allegations of a pattern of mistreating his assistants and asking them to perform personal tasks for him.

Stokes wrote a letter to her supervisor that listed 44 personal tasks that she said he asked her to perform. They included calling T.J. Maxx stores to search for wooden shoe trees, canceling his subscription to Playboy magazine and searching for "a taser gun, geese repellent for his home use."

She also said he called her a "nobody" and threatened to fire her if she did not do the tasks. The mayor has denied that.

Scriven said Stokes never intended for Holley to be fined or asked to resign.

Stokes did not attend the news conference. Her father, retired minister James Hailes, and two brothers, Carl and Larry Hailes, did attend the conference, but did not speak.

Scriven said his client is dealing with the trauma of abuse and of her complaint being made public. He described her as a mother and grandmother who never intended to start a public fight with the mayor.

"She's not a public figure, she didn't try to be a public figure," he said. "She's not a politician, she didn't try to be a politician.

"She tried to be a citizen and employee of the city of Portsmouth and for some reason, she's now thrust onto the front pages of the media, on TV."

Scriven said his client was trying to help, not attack anyone, by submitting her memo confidentially to the City Clerk after earlier complaints had not resulted in any change.

She thought things might get better rather than worse, Scriven said.

"But we know what happened," he said.

She wanted to keep working for Holley, Scriven said, and learned that she had been reassigned after documents were provided to the media.

"My client doesn't know what that new position would be," Scriven said. "That was done during her absence, without her consent, without her knowledge."

Scriven said his client had already been out of the office for what he described as a legitimate purpose before the news broke, and has been on leave since.

Councilman Steve Heretick said Thursday that "she didn't do this. This wasn't a political assassination for her."

He said council members got involved only after earlier efforts to resolve the situation were unsuccessful.

Council members confronted the mayor about Stokes' list and Heretick said that Holley wanted to fire her. After that, he said, "we couldn't walk away from it."

"In some ways, I think she's become the catalyst for a much larger discussion," Heretick said.

The councilman said he has always had a high regard for Stokes, her attitude and the job she does.

Heretick said public officials face a different type of accountability.

"Conduct like this by an elected public official, if not newsworthy, is at least noteworthy," he said.

He said he doesn't see any issue with Stokes getting a similar job with the same responsibilities and salary.

"I hope we find her a better boss."

Leave the Woman Alone....

For all of you complaining that "it's all about the cash", etc. It is not this woman's fault that he treated her like this, nor was it the fault of her predecessors in this assistant position, and there have been many. She is just the first person with enough guts and self-esteem to not stand for his crap. It's also not the first time that Holley has done something stupid or abused his power in this city. I wonder how many of you hypocrites wouldn't ask for some sort of compensation after having your name slandered all over the press because he acted like a moron. I say good for her---he doesn't seem to understand anything other than money, so hit him where it hurts. City Council did the same thing for the same reason---hence the fine.

Stop the press! Assistant is no longer threatened by mayor but misses him and does not want anything bad to happen to him... and wants her old job back with him. Tear up the recall papers - I can't tell anymore who is senile - the mayor or the assistant. If I am reading correctly, now looking to sue city for breach of confidentiality.
Go figure. I take back everything negative I said about the mayor.
Long reign the mayor. Forget the recall,You won't get enough votes to recall Mayor Holley. You may as well quit salivating...Good luck Mayor - I feel you. Citizens, don't waste our taxpayer money for naught. After what we've been reading from the Assistant's attorney, Forget about it.

HAVEN'T YOU EVER HEARD OF THE SAYING

"He may be a crook, but he's OUR crook"? Hello, the Pilot ran an article a day or two after this became public quoting residents of Cavalier Manor who just LOVE Mayor Holley. There will be no resignation and a recall will never get off the ground. If he'd been an appreciative rather than abusive boss Ms. Stokes probably wouldn't have complained about the things he asked her to do.

Hey, this guy is 82 it's about time he cancelled his PLAYBOY subscription and then be forced to retire. I can't believe there isn't a young person qualified to run the city -- inject new blood into an old city.

It's not that there isn't

It's not that there isn't anyone young and qualified, it's that these people don't have a prayer because the same people who condemn the man turn around and vote for him again every time he puts his name in. Trust me, the young people in this city, some of us who have lived here forever, are sick of him too and want to do something about it. But look at council too---some of them have been on council for the better part of 20 years and what have they done? So it's not necessarily a matter of nobody wanting to do it, it's a matter of all of these being elected positions and only the "established" people are ever elected.

It's about time somebody had the courage to expose the abuse that secretaries have been subjected to for decades - trotted out like trained ponies to run personal errands - i.e. pick up lunch, go to the drycleaners, pick up the kids from school, etc., etc. At the same time, expected to still turn out a day's office work. This should go to Court and be a landmark case. In years past, this lady probably would have lost her job for speaking out.

The assistant is in d@#$%d if don't, d@#$%d if you don't position. There is no way she could work in peace if she stays. Money should be taken from Mayor Holly's personal assets to settle the case. Isn't there a law protecting whistleblowers?

Wow, I almost felt sorry for her at first. Obviously, she learned quite a lot working for the Mayor.
