The City Council violated Virginia's Freedom of Information Act on Tuesday when it discussed in a closed meeting allegations that Police Chief Bruce P. Marquis improperly raised money for a law enforcement conference, said Alan Gernhardt, an expert on the state's open meetings laws.
Councilman Paul R. Riddick said the council talked about Marquis for several minutes. That discussion was illegal, said Gernhardt, staff attorney for the Freedom of Information Advisory Council in Richmond.
Earlier that day, Councilman W. Randy Wright chastised Marquis in an open meeting for implying that racism may be behind some of the allegations.
Marquis was criticized for raising money from businesses and spending forfeiture funds on a conference for the National Organization of Black Law Enforcement Executives, held in Norfolk in late July.
A former police lieutenant also alleged that an inordinate number of officers were assigned to patrol the conference.
Marquis told The Virginian-Pilot that he wonders whether the allegations would have been raised if the conference had not been for black officials.
"The use of drug forfeiture funds, in my mind, did not pass the smell test," Wright said. "The way he solicited funds was very intimidating.
"The thing that concerned me the most was his playing the race card. I think that was uncalled for."
Wright's comments were met with silence from other council members until they went into closed session.
Riddick said some council members were critical of Marquis in the closed session, but only mildly so. He said Marquis enjoys wide support from the council.
In 1998, an opinion issued by the Virginia Attorney General's Office involving the city of Hopewell concluded that city and county governing boards may not discuss employees they don't hire in closed sessions.
Norfolk's code empowers only City Manager Regina V.K. Williams to hire the police chief and most other employees.
Norfolk City Attorney Bernard A. Pishko said he does not agree with the opinion and said it is not legally binding.
Mayor Paul Fraim said: "I'm not about to comment on what we discussed or what was said. I will say I have great confidence in the legal advice we're getting from the city attorney and that no laws were violated."
Gernhardt acknowledged that until someone challenges a city or county in court, there is no binding precedent. "But I fail to see why the council discussed the police chief behind closed doors," he said.
Gernhardt was critical of the council in December when Fraim called a special closed meeting to discuss indictments of three police officers.
Vice Mayor Anthony L. Burfoot said he did not join the discussion on Marquis.
"Technically, I know we're not supposed to speak about employees under control of the city manager," he said. "This is an administrative issue, and I'm going to let the administration deal with it."

Why doesn't the city stop with Harborfest? Make's them to much money I guess. Our FAMILY along with many neighbors have STOPPED coming into Norfolk during this event because of the many drunks walking around Waterside. We have now been going to the Chesapeake Jubilee where it is "FAMILY ORIENTED" for the past 8 years.

Circling the Wagons?
First I find it curious that this article was removed from the Pilot website on the very same day that it was posted. Second I would like to remind the Norfolk City Council and Chief Marquis himself of a quote that the Chief made in the Pilot on March 22, 2009 regarding officer misconduct. Chief Marquis stated "some behaviors merit no leeway...anything involving moral terpitude - LYING, CHEATING, STEALING - we're not going to tolerate." It is a fact that Chief Marquis knowingly was not being truthful when he stated that nothing was left uncovered during the NOBLE conference and that NPD manpower and resources were allocated the same for NOBLE as they are for any other conference or festival. How are other NPD officers disciplined when they knowingly do not tell the truth? Who investigates the Chief? The Council and the Chief's personal friend the City Manager? If leaders lead by example then the NPD and the citizens of Norfolk are in big trouble. Does anyone care or does the race card trump morals, ethics and integrity?

The residents of Norfolk deserve transparency
in their government. Unfortunately, I don't think it will happen with the current officials we have. They are too concerned with covering each others backs and favoring their special interest groups and freinds. It's like that in any government to a certain extent, and the bigger the city...the bigger the problem. I think perhaps I agree with statements made by other posters previously. We need to make sure that there are term limits imposed upon public office. ANY elected official should only be able to serve 2 terms, whether consectutive or not. That is the only way to really put government back into the hands of the people.

I was never a fan of the Police Chief, but after he pulled the race card because he was being investiaged, I have no respect for him. I also have no confidence in the City Council after pulling the shades down and having their meetings behind closed doors. The tax payers have a right to know what they've been (over)paying for.

Let us not forget the arrogance of Mr. Pishko in reference to the unlawful arrests of Chet Szymecki and Dan Moore. It's funny that no one in government gets spanked for violating the rights of it's citizens. Ignorance of the law is no excuse for a citizen, but it is for city government though.
