Just about every top state official has offered an opinion, but only five people have a say in the ethics investigation of Del. Phil Hamilton’s efforts to land a job with Old Dominion University.
That quintet – members of the House of Delegates’ Ethics Advisory Panel – is charged with evaluating complaints made against legislators.
House Speaker William J. Howell, R-Stafford, requested the inquiry Monday after the disclosure of e-mails between the lawmaker and university officials discussing the Newport News Republican’s efforts to secure state funding for a teaching center at ODU as well as a job for himself.
ODU has received $500,000 in annual funding for its Center for Teacher Quality and Educational Leadership, and Hamilton was paid $40,000 a year as a contractor until his employment with the school was ended last week.
Virginia’s conflict-of-interest law bars lawmakers from accepting money for services performed within the scope of their legislative duties.
Hamilton, who is up for re-election this year, has resisted calls to resign his House seat. He has admitted making a mistake and pledged to cooperate with the ethics review.
The members of the advisory panel are Alfred C. Anderson, Bernard S. Cohen, Phyllis E. Galanti, vice chairman John H. Rust Jr. and chairman William W. Sweeney.
Two are former state legislators, one is a retired judge, another is a former county treasurer, and the fifth has served on other state government committees.
Anderson, Galanti and Rust identify themselves as Republicans. Cohen represented Alexandria and Fairfax County as a Democrat in the House of Delegates. Sweeney, a former judge from Bedford County , declined to identify himself by party.
Panel members are appointed to four-year terms by the House speaker.
Complaints to the panel are initially investigated on their merits. Those deemed groundless are dismissed.
Complaints that are found to be potentially legitimate proceed to a formal investigation that occurs much like a trial. That process is typically confidential.
From there, the advisory panel can make several determinations. It can dismiss a complaint or rule that a conflict of interest occurred.
Unwitting violations are sent to the House Privileges and Elections Committee, which can seek censure of a member. Knowing transgressions are referred to the state attorney general for possible prosecution. A violation is a misdemeanor punishable by up to a year in jail and a $2,500 fine.
Some panel members said it is rare for complaints to advance to that stage.
Cohen said he recalls only three complaints during his years on the panel.
“I must say, most of them turn out to be non-violations,” he said. “This is not an active job.”
Cohen also is a lawyer and litigated the landmark 1967 Supreme Court case Loving v. Virginia, which struck down prohibitions on interracial marriage.
Rust is the other attorney on the panel and, like Cohen, formerly represented a Northern Virginia district in the House of Delegates. He now serves as commissioner of accounts for the Fairfax County Circuit Court.
Panel member Anderson served nearly three decades as Roanoke County’s treasurer. He is active in Virginia Republican causes.
Galanti is a Richmond resident and the wife of Paul Galanti, a former Vietnam prisoner of war who has been a prominent supporter of U.S. Sen. John McCain’s presidential campaigns. She has previously served on several state judicial committees.
Each of the panel members declined to comment on the Hamilton inquiry, though Galanti noted the panel usually has its first meeting within a month of a complaint being filed.

If the activities in this matter are legal and in keeping with expected standards of conduct for lawmakers we need new laws. He betrayed the public trust, he deserve our outrage. He abused his position and wants to take responsibility for it...how by being re-elected? LOL... Come on folks you or I would be canned and looking at jail time. Give Philly boy one more chance to make a million?

He said he had no discussions with ODU officials about possible employment with the center before he introduced a budget amendment for it yet e-mails show he did. I tried to teach my children that making untrue statements is wrong and a lot like lying.
If the response is overwhelmingly positive to his campaigned I can not imagine where he is campaigning.
Does his wife really get $90,000 a year from CNU to put on a charity golf tournament once a year? How do you get a job like that. I could use one of those. Is she a golf pro? ODU, CNU is there a pattern here? That is $130,000 plus what NNPS caughs up. WOW that politician really had it made!

Ethics Review of Delegate Hamilton
Judging by the composition of the review panel, Delegate Hamilton has nothing to worry about. 3 Republicans and 2 moderate Dem's means dismissal of the charge and maybe a written reprimand.
Phil Needs to Resign Immediately
By all means, don't make it public because afterall there is an election coming-up and campaigns to manage! I am a Republican and I have supported Phil; however, his lack of integrity, honesty and arrogance over this situation has turned me off completely. I am sick to death of politicians like him. We need term limits from the local level (city council) all the way to the Federal level. This is no different than the arrogance of the Newport News city council refusing to broadcast the hearing for Randy Hidlebrandt yesterday. By keeping things from public view in a day and time where everything is covered by the media 24/7 and available either by broadcast or streaming, is what gives the public the "perception" or as in Phil's words "the appearance" of impropriety. Believe it or not, the public isn't fooled. Politics are dirty because of people like Phil Hamilton who is so pompous, greedy, self-centerd not to mention the biggest fault of all-LIAR. Cloaking things in the dark is certainly the way to handle this situation and the one in City Hall yesterday because the tax payers aren't smart enough and their vision hasn't become 20/20 simply because they haven't been elected to a loft

Hamilton should resign ASAP.
Graves should resign at the end of Fall 2009.
Blackburn should be fired.

What does President Broderick have to do with any of this? This deal was sealed under the watch of President Roseann Runte. Perhaps she should step down from her current job???
President Broderick is Guilty as well...
If my memory serves me correct, President Broderick, before becoming the President of ODU, was the Chief-of-Staff of then President Runte. Part of his duties were to oversee the hiring and payroll of the university. If this is correct he definitely would have known about the situation with Del Hamilton, especially when the delegate was trying to secure funds for ODU.
Decency
If Hamilton had any sense of decency he would have resigned two weeks ago. The President of ODU should apologise for this bribery/kickback scheme and set an example for the students by stepping down from the office he just attained this summer. This sleaziness, coupled with the new name of the football field, has cast a shadow of shame on what should have been a great home opener for Monarch football this Saturday. Boo...
S.B. Ballard Stadium
As for your illusion of wrongdoing by the SB Ballard naming of the stadium, it is common practice to reward generous donors with naming buildings after them. If you look at any of the buildings on campus, you will find names of people in the region that have donated time/money to the advancement of Old Dominion. Darden College of Education, Kaufmann Hall, Batten College of Arts and Letters, Ted Constant Convocation Center. These people didn’t get their names on buildings because they are Nobel Laureates or Professor Emeritus but the time/effort/money that they put into the advancing the University. I am also sure he donated a large sum of money to the University for the privilege of having his name on the stadium.
