More than a decade ago, two nightclub operators were recruited to Waterside by the city, with the hope of attracting young patrons. Now, Norfolk's leaders want Bar Norfolk and Have a Nice Day Cafe banished.
This morning, housing officials shut down Bar Norfolk, a day after padlocking the doors and evicting the owners and employees of Have a Nice Day Cafe.
Kevin Martingayle, a Virginia Beach attorney who represents both nightclubs, said Norfolk Redevelopment and Housing Authority officials padlocked Bar Norfolk around 9 a.m. today. Housing officials said both nightclubs violated terms of their leases by opening and serving alcohol after the City Council rescinded their right to serve alcohol.
Martingayle said he’s not sure what legal remedies he will pursue.
“It happened without so much as a courtesy call from anybody,” he said. “The city has shown what appears to be a deliberate attitude to handle this by ambush.”
In a legal filing today in Norfolk Circuit Court, the city is also seeking an injunction. The city is asking the court to order the two bars to stop selling or serving alcohol or provide entertainment in Waterside.
Both nightclubs had their permits to serve alcohol rescinded by the City Council on Tuesday. Bar Norfolk was closed Tuesday, but reopened Wednesday night and served alcohol. Hundreds of young adults poured into the venue while hundreds more waited to get inside.
Mayor Paul Fraim said Norfolk Redevelopment and Housing Authority officials, at the city's request, reviewed the lease with Have a Nice Day Cafe. He said they determined the bar violated the lease when it opened Tuesday night and served patrons alcohol.
"They made the decision to lock the doors," Fraim said of the redevelopment authority.
Waterside is owned by Waterside Associates, which is essentially an arm of the authority. Shurl Montgomery, the authority's executive director, did not return phone calls Wednesday.
Fraim said the actions of the city and authority are appropriate.
"Literally, it's about the city's ability to enforce its own laws. You would expect the city to move as firmly and as quickly as it can."
Martingayle said city officials "need to calm down, take a deep breath and stop acting like bullies."
Alan Albert, a Norfolk attorney who also represents the nightclubs, said police officers showed up Wednesday afternoon at Have a Nice Day Cafe and ordered everyone out. The doors were padlocked and signs put up that said "closed until further notice."
Signs remained on the outside advertising "Sexy Saturday" and "Wednesday Hot Body Contest" promotions.
"This is the first time in 25 years I've heard where a landlord has locked out a tenant in this fashion," Albert said.
Albert said that a "multimillion-dollar lawsuit" will be filed against the redevelopment authority, perhaps as soon as today.
City Attorney Bernard A. Pishko said he expects to file a lawsuit today asking the Circuit Court to order the clubs to cease serving alcohol, which owners said would put them out of business.
Martingayle said Have a Nice Day Cafe was closed Wednesday, minutes after a conference call was held among three city attorneys, three attorneys for the bars and Circuit Judge Norman A. Thomas.
The city attorneys did not mention the impending eviction of Have a Nice Day Cafe, Martingayle said.
"The city is acting like an impetuous child," he said.
Pishko said the city also will ask the ABC Board to rescind state licenses to serve alcohol. He plans to ask the General District Court to impose fines against Have a Nice Day Cafe for opening in defiance of the council vote.
City officials said that over the years, both venues repeatedly flouted city codes, including serving underage drinkers. Have a Nice Day Cafe was cited Tuesday night for selling untaxed cigarettes and fire code violations.
"I think that speaks volumes about the attitude management has there about obeying the law," Pishko said.
Norfolk began working this summer to turn around Waterside's image, renovating empty restaurant and store spaces to accommodate community events and trying to attract families to the riverfront pavilion during the day.
Martingayle said that when the city recruited both bars, "they knew they are all about young people and good times. That was all well and good when they were desperate to fill that space. Now that they've decided to change direction, they've decided to run them out of business."
According to state ABC records, since 2006, Bar Norfolk has been cited 28 times for alcohol violations, with 17 dismissed. The others, which ranged from allowing intoxicated people to remain on the premises to improperly refilling bottles of alcohol, resulted in fines totalling $6,750.
During the same time, Have a Nice Day Cafe received three violations, only one of which - for failing to turn in annual sales reports from 2007 - resulted in a fine, of $500.
By comparison, Jillian's which is also in Waterside, has received no ABC violations since 2006. Jillian's was granted a new license to serve alcohol, known as a special exception, by the council on Tuesday.
Other downtown clubs, such as Scotty Quixx, also haven't been cited, but Fahrenheit, a bar on Granby Street, has been fined $3,250 over the past few years for violations ranging from improperly conducting happy hour to disorderly conduct because of noise.

I know I'm more than likely about to catch my fair share of flack from the people who read and post here constantly, but as a 22 year old member of the community I cannot sit idly by and let the powers that be control the situation that I live in without responding. Therefore, I am calling on everyone to use the current rallying tools the younger generation currently has at their fingertips, things such as Facebook, Myspace, Twitter, and all the others to get groups together and fight back. If enough people come out in organized, civil groups that loudly demand the change in how the system is run and how we want to see things done, something will change. 2008 showed us all that. Grassroots groups in large numbers in one clear voice coming out and telling the established order they are unwilling to take it anymore leads to changes. An apt movie quote comes to mind for this "People should not fear their governments, governments should be afraid of their people."
The City is Broke - And Breaking Small Business
I'm a small business owner and I have been the vicitm of "the City" hitting us with all kinds of minor infractions that cost us major money.
Small Business has no place in the City of Norfolk. I suggest these Waterside bars take their business elsewhere, and STOP paying city taxes to Norfolk! Waterside is "family" friendly till about 10pm ... and about that time - PEOPLE SHOULD be putting thier kids to bed!

I welcome any VIDEO you can send... of Public Works, Zoning, Pace, Shefrrifs Dept... ect ... city workers wasting your tax dollars ! You've seen them - - sitting at Hardees for an hour eatting breakfast... sitting under a tree in the shade for 3 hours doing NOTHING.. trucks running in parking lots while they eat lunch for an hour ... trucks running, AC blasting... They make good money and have GREAT benifits.

Double standard set by the City and NRHA
Waterside is run and controlled by Waterside LLC. a "private" company that is an extension of the NRHA. This is done so, NRHA can spend money as they see fit in regards to Waterside. Because they set up this LLC they don't have to follow federal regulations regarding bidding and disclosure of taxpayer money spent.
But when its convienant to them they jump right in and take control.
Its time for Local Goverment to stop hiding behind these abusers of tax payer money.
When the topic of cost and tax money is brought up, its owned by Waterside LLC. But when they want something else or to strong arm someone its the City and NRHA.
WHY IS THE "HOUSING AUTHORITY" IN THE BAR AND MALL BUISNESS ?
Goverment should not be involved in the real estate and retail buisness.
This is an abuse of taxpayers money.
City Councils just love playing with other people's money.
I back the city on this one.
This is not about probition. This is about the rule of law. I have never been in the establishments so I have no comment on the justice of the city's decision to revoke their liquir licenses. However, the law is the law and they violated it. If they thought that the city was unjustified in their actions, they should have challenged them in court.
Due Process
The City certainly has the authority to revoke a liquor license, but they are still required to follow process, which I do not believe they have. Also, I question the legal authority of the NRHA to close a business. The entire Waterside LLC, NRHA, and the City of Norfolk's involvement in Waterside is an incestious affair that needs to be closely examined.

not to mention when you go to bar or cafe you cant even look like a thug... no work boots, no wifebeaters, no hoodies, no cami, you cant even wear your hat backwards!! people get into fights, people do stupid crap, but how many of these things have actually happened INSIDE THE BARS??? The bouncers do an awsome job and when you are inside you have more rules to follow then when you are in kindergarden... its actually the CITYS PARKING GARAGE which is the problem, shut down the parking garage at night, lose that $5.00 per car and see how many people take a taxi or the hrt because THEY LOVE GOING TO WATERSIDE TO PARTY!... people are getting into fights and shooting people all over norfolk... drive down tidewater drive at night (with your windows rolled down) come on i dare ya! so what it doesnt happen at waterside anymore now it will happen in someones front yard and a baby will get shot with a stray bullet... How many fights have they had a booker t washington or for that matter any of norfolks middle or high schools? they arent shut down yet and those are kids! I know i will never ever fight with downtown norfolk again if bar never reopens... for any reason.

A few posts down someone finally posted the truth about the parking garage at waterside... A patron a JULLIANS not BAR or CAFE, was responsible for the shooting, my brother worked at bar that night and was in the parking garage and witnessed the shooting!! Bar Norfolk will find a way to survive this even if they just move to a new venue, which may be a better deal for them anyway seeing as every wed, fri, and sat night they are PACKED FULL! The city talks of how bad these 2 bars are but the city neglects to mention that it is full of our military, walk into bar norfolk during chief's initiation or the night of the navy marine corps ball... if this bar is so bad why hasnt our military black listed it yet? I go to bar and i am a 29 yr old mother of 4, ive seen older people in bar also this is not just a place for young kids to hang out its a military hang out and as i stated earlier if you stand off to the side while ID's are being checked you will count more military ID's than anything. So is this actually the city councels way of saying that our military men and women, that bring in millions of revenue for norfolk, are dirty, nasty, low life criminals??? Instead of shutting down th
bars, one and all
I'm thrilled. Maybe this will be the beginning of the end of the solid block of bars that is downtown Norfolk.
It was better back in WWII when the people just "thought" they had a problem. At least then there were stores and shops and other services and such as well.
Now all we have is the overpriced mall and countless bars.
Not that I don't like bars, but this is ridiculous.

I've talked to my friends. They are IT professionals for the most part, white collar jobs. One said they tried to go into the establishment mentioned but their shirt wasn't tucked in so they were denied. Another friend said she used to go to one of them fairly often, and it was more preppy than ghetto. She said a friend was denied entrance once due to a pant cuff having a tear in it. This is all I have to go on, it didn't seem to line up with what I was reading from people on here. But I figure most people on here (unless stated) have no direct experience with the venues.
Was it necessary???
Prohibition does not work and will not solve your probelm....it only gets worse and ugly. The City of Norfolk should not abuse their power in this fashion. This is the quickest knee jerk reaction I have ever seen from city government. What's wrong with Norfolk??? Its leadership. Norfolk has no clear direction and no plan. Instead of blaming a bar for its problems they need to look at its neighborhoods.
Waterside is a failure for sure; however, committments were made such as leases, licenses, and employment contracts which the city should honor or at least try to work with the businesses or even compensate them for abandoning their leases earlier. Unfortunately, when you have abusive power hungry people running Norfolk who do not understand anything about running a business let alone a city, its no wonder they find themselves in litigation while pouring embarrassment over the city. City Council members do things because they can and not because it is the best for Norfolk. More businesses and revenue lost to Virginia Beach. Virginia Beach has alot bars and doing just fine. Wake up Norfolk!
