Chesapeake postpones vote on noise ordinance

CHESAPEAKE

The City Council on Tuesday delayed a vote on whether to make major changes to the city's noise ordinance after the complaint of one commercial contractor who said the new rules would create problems for his business.

The proposed ordinance, now set for a vote Nov. 24, would prohibit loud overnight noises such as lawn mowers and extended dog barking heard across property lines.

It also would prohibit loud construction activity from 11 p.m. to 7 a.m. - the most contentious piece of the new ordinance.

"It would certainly create havoc with the construction industry," said Mayor Alan Krasnoff, who requested that the vote be postponed.

Chesapeake has been trying to revise its noise ordinance for at least two years.

One council member was so frustrated that she voted against the continuance. The vote was 8-1.

"This has been going on for two years," Councilwoman Patricia Willis said. "It's been changed and changed and changed. This is never-ending."

Make This Ordinance Enforceable

I surely hope our city leaders vote on this ordinance soon and put some bite in it. I live in a neighborhood where this one family is a thorn in everyones side. They have this boat that is sometimes worked on which is loud in addition to one of those (Fast and the furious) cars that their son reeves up every other day. This family is very inconsiderate to other neighbors. When the police are called the noise stops of course and the cops can't do anything. This ordinance should be made to where we the citizens can go to the Magistrate and obtain a summons. My wish would be this family move from the neighborhood very soon.

Lousy Ordinence

The bad thing about this ordinance is it don't address the most common noise problems. Why is there a time period for a barking dog complaint? Those that work nights have no way to deal with a neighbors dog that constantly barks during the day. And the biggest problem is the loud music that comes from vehicles. The new ordinance requires a noise meter to say its too loud. So as you sit at a stop light with a booming radio next to you there is nothing that can be done. Maybe Chesapeake police officers can politely ask the driver to turn the music down like Va. Beach. Its a shame the officer can do nothing if the request is denied. Since the ordinance is so weak an uninforceable, I agree with Ms. Willis. Just vote on it to get it over with.

Is the time to contact the city manager.If you have noise complaints concerning a business in your neighborhood. You people still don`t listen ! I have been in contact with the city since 1996 ! They promised me then, to make amendments. They had 13 years to work on this. A sound study was done that cost some 30,000.00 ! You people think you know what you are talking about. Have you read the proposed new ordinance? No, just like Mr. Bilbo and his poor construction co. This city council has sold their souls to developers ! Good luck when a mixed use comes your way and "2030 Lets move forward project". Thank you CHESAPEAKE. You seem to know what your are talking about.. Willis was involved on this issue and the only one with a back bone. You would think after 13 years of citizens complaints, sound studies, emails, the city would have a balanced noise ordinance. My friends they did ! On Tuesday night once again this council blew it. Please change the city logo to a "City that Caters to Business". Who cares about the citizens anyway?

I think I have a bigger problem with Councilwomar Willis

She was the only one NOT to vote a continuance & her reasoning? She was frustrated with the ever-changing aspect of the ordinance & how long it has been taking (2 years). By her thinking, she would rather vote to pass a law that was not correct & could possibly be turned over & rendered unconstitutional (sound familiar?), than spend the time, DO HER JOB & hammer out an ordinance that is correct & addresses the problem. But no, she's tired of doing her job & just wants to "pass something" to get it over with. Almost like she can't be bothered with doing her job and doing the right thing. That kind of attitude speakes volumes.

The "lone" council woman was right!

She was the ONLY one that was keeping her promise to the neighborhoods that suffer from constant noise that emanates from adjacent businesses. If you have ever been awakened at 1 am because your whole house vibrates at night by trucks unloading goods or the gun-shot like noise of a trash dumpster being emptied at 3 am...PLEASE email city council NOW! This ordinance is NOT about barking dogs and loud motorcycles, but can help if your neighbors are inconsiderate. To some, the inconsiderate neighbor may be the two-bit construction company that wants their illegal aliens running a jack hammer at 6 am!

Missing the issues

People have missed the issue. The issue is business noise emanating on to residential property. You live in a neighborhood, the city allows a shopping center to be put in your back yard. The shopping center has business that are open 24/7. Why should I have to listen to noise inside my home all hours of the night and early am hours. The police cannot enforce the current codes, because the city attorney says the codes do not apply to a business. Chesapeake has never owned a noise meter! I have been complaining to the city for 14 years. They promised me back in 96 to make changes. This is not a new issue with this city. Council members based on their comments last night have interest in the business community, one council member wanted it continued for 10 yrs. Wonder where his interest is? He must own a business or one of his buddies has a business. Business should not have the right to make noise all night if it emanates on to a residents! This city needs to stop catering to the business and protect the citizens. I pay taxes too !

Muffler noise

Just a quick point: loud mufflers are covered under the State traffic codes which does not require a noise meter. These codes are completely seperate from the City noise ordinance. Covered are vehicles with no mufflers, removed catalytic converters, holes in the exhaust (including punched out mufflers), and any exhaust with a "loud or unusual" noise. Basically, if it is stock or sounds like stock, it is legal.

Just one minor problem with your post, bhound....

Who (or what) is going to be the single determinant of what "stock" is? You are correct that loud exhaust is covered by the traffic codes, but what exactly is "stock"? I own several Harleys and have ridden almost daily in my 52 yrs. Currently, 2 of my bikes have what some would consider "loud or unusual" noise. One problem: both of them are "stock" bikes in that they were bought directly from the factory and have had zero modifications to the exhaust. They were built at the factory with the loud exhaust they have. So are you saying that I am violating the traffic code because they are loud or am I OK cause they are "stock"?

Loud noise

Any car or motorcycle with loud mufflers and people with loud radios and attention getter's. There missing something in life and expect to gain their attention while disturbing others. Any person that makes any intentional noise above reason that disturbs others should have to spend some time in a jail blasting loud noises at them for a couple days. I have found most of the motorcycle drivers showing respect toward others lately. We still have a few rude drivers that will pull up beside you at a traffic light and continue to rev the engine until the light changes. Ignorance has to be excused for some people.

Is generally the wannabe who put loud pipes on his bike without realizing that carburetion or fuel injection needs to be recalibrated accordingly. Subsequently, his bike will no longer hold an idle. He has to keep revving it to keep it from stalling. But hey, people are still looking at him and trying to read the cute antisocial stickers plastered all over his beanie helmet. That's what counts.

Hah! I would say I had the same thought about jet noise. It'll overpower a dog bark any day. However I must say, the Navy for the most part, tries to be good citizens at night - and I live pretty darn close to Fentress.

chesapeake noise ordinace

Amen for a revised noise ordinance. I live behind the Shoppes at Greenbriar. Every Wed. morning at 3:00 am a dumpser is empied by a very loud truck. Some of the trash companies dont give a hoot about disturbing people.

Noise Pollution at City Hall

We need to pass an ordinance to quiet down some of the noise pollution at City Hall!!! Let's put a noise meter over there. Can't they find enough ways to fine people, since they can't get enough tax increases to pay for all their great idea's?

Norfolk

needs to take notes. I have never been around a more "out of control" crap-hole city. The difference when driving though Norfolk and Chesapeake/Virginia Beach is like night and day. No enforcement of nothing, guess Norfolk is too busy with other pressing matters.

I hear a *lot* of crap in Chesapeake and VB. This includes residential areas. I don't know which parts you visit -- must be out in Hickory or closer to NC line.

Not fair. Of course Bunch of Walnuts Road out in the boonies is going to be more quiet then a densely populated area. Compare apples to apples. If you pick similar neighborhoods with similar economic backgrounds and property sizes, there probably isn't that much difference.

WORST NOISE

I would love to see the state do something about theese teens with small slow junk cars with those supose to be impressive loud mufflers. Why parents allow their kids to have such trash on the streets is beyond reasoning. They are very destracting to other motorist. They are accomplishing their intent GETTING ATTENTION ! Maybee that is the only way they have to to get attention. They are worse than the Harleys and the c. rockets and want to be's . If a vehicle has been modified an any wat to produce a noise level, it should be a $1000.00 fine state wide.
