Lying charge heats up Norfolk commissioner race

The race for commissioner of revenue has taken a negative turn, with challenger Doug Knack claiming that incumbent Sharon McDonald uttered "a blatant lie" at a debate, and McDonald retorting that Knack "doesn't have a clue as to what he's talking about."

McDonald, 54, is seeking her fourth term as commissioner of revenue, which levies taxes on most businesses. The position pays $136,167 per year.

McDonald is backed by most of the City Council, most other elected officials, and the Democratic Party. Knack, an independent, has mounted a spirited challenge. The 58-year-old real estate agent garnered endorsements from a pair of political opposites: former Republican U.S. Rep. Thelma Drake and Vivian Paige, a former Democratic nominee for treasurer who runs a left-leaning political blog.

Knack has raised $24,000, nearly twice as much as McDonald, including a loan of $5,000 he made to his own campaign. "I wouldn't be in this if I didn't think I could win," he said.

McDonald and Knack have clashed outside the political arena. Knack's wife owns Kathy Knack Interior Designs in Ghent.

She has been fighting McDonald over the tax classification of her business since 2004.

Kathy Knack says she's being charged too much in business taxes. McDonald says she's just following the state code.

State law allows McDonald to assess taxes at higher rates for personal services than for retail sales. Knack is taxed for providing personal services.

McDonald said because most of the furniture and other wares she sells is custom-designed in the store, what Knack is really selling is her advice. "The state guidelines are very clear, that interior decorating is a personal service," McDonald said.

McDonald said she has asked Kathy Knack for records that separate retail sales from personal services. "She said she can't provide the records," McDonald said.

Doug Knack provided The Virginian-Pilot detailed financial records from his wife's business, including a breakdown in sales from 2004 through 2008, on the condition that numbers not be published. They indicate about 5 percent of her income is from "design services."

Knack said he decided to run not just because of his wife's business, but because of "inconsistencies" in McDonald's office.

The Retail Merchants Association, a statewide business group based in Norfolk, has contributed $4,164 to Knack's campaign and has long been critical of McDonald.

The association asked state Tax Commissioner Janie Bowen to provide a non binding ruling on whether Norfolk's interior designers are improperly taxed at a higher rate. She ruled, in one test case submitted by the merchants association, that the taxes were improper.

At a civic league forum, McDonald said the ruling had nothing to do with Norfolk. Knack's campaign said that was a "blatant lie."

"It doesn't have any bearing on Norfolk because it's fictitious," McDonald said. "There is not any such business in Norfolk that I am aware of."

Margaret Ballard of the Retail Merchants Association replied that "the appeal was based on an active business in the city of Norfolk."

McDonald touts improvements she has made to her office, including the opening of the region's first state Department of Motor Vehicles branch at a city hall and a policy that allows 85 percent of new businesses to acquire all permits at her office. McDonald also credits her office with collecting $35 million in the last 12 years from businesses that had not been complying with the law.

Knack faulted McDonald for spending more than a month each of the last two winters in Richmond lobbying the General Assembly for the commissioner of revenue state association, efforts McDonald says have helped Norfolk taxpayers.

He also said her "aggressive" attitude toward assessing taxes may be driving businesses out of the city. "She's been aggressive, and it's not her job to be aggressive; it's her job to follow the law," he said.

McDonald said that's exactly what she's been doing - making sure businesses follow the law.

"If it's aggressive tactics because we're looking under every rock, trying to find tax money for this city, then so be it," she said.

"I think most of my constituents would say, 'That's exactly what you should be doing, because if you make sure everyone is paying their fair share, then that's less that I have to pay.' "

knack attack

Knack your interest in running is obviously personal,your wife.This job is for someone that can handle your very situation and not mix emotions.I don't want to pay your wife's difference in lost tax revenue.I am trying to raise my family and not debate why someone wanted to take personal problems and make them the concern of everyone else,go call Oprah.My vote is overwhelmingly for the current officer,because of your idle time approach.Your $5000 personal loan would have been better spent on helping the needy within the city,not ones selfish intentions.What happen's when I come to you with a similar question are you going to BEND the rules for me?I will probably have to pout and run for office.

Knack for Norfolk NOW!

To Margaret 1253: Ms. Knack provided the proper paperwork to McDonald time and time again - the last time was in June. With no response other than a cold shoulder and a closed mind. Ms. Knack provided that same paperwork to the Pilot without permission to disclose.

This is all beside the fact. It's never been about just one business. There are a total of 34 businesses in this industy in Norfolk and they are not all classified consistently. So it's about a minimum of 34 businesses. And if there is inconsistency in this group, there may well be inconsistencies in other groups of businesses as well.

Commissioner race

After reading these comments I am compelled to add my own thoughts on Ms. McDonald and this race. First, I'm having trouble understanding why the Knacks would turn over business records to the paper but not to the Commissioner's office. All I can figure out is that they believed the Commissioner's office would find ample proof that the business is indeed mostly "personal service" whereas the chances were good that the Pilot wouldn't have the expertise to analyze it correctly. Nothing against the Pilot, by the way - it's just not their area of expertise. Secondly I know for a fact that many many individuals and businesses have had their taxes reviewed and lowered following their appeals. It sure looks to me like Ms. McDonald is doing her job as it should be done - without favors being given to anyone.

Ever try to do business with this dept..say get something as simple as a yard sale permit? First of all you either have to go there (a total pain to get to and all close parking is reserved for people working there not citizens) or do snail mail..no online, like what is that about in 2009!!! And if you go there they do not take credit or debit cards and there is no atm after 4:30 when that section is closed...omg, you can go to any 7-11 and buy a pack of gum with a debit or office credit card but not pay for something like a yard sale permit at a city hall! this city is a joke! Yeah, I think it is time for a change!

I'm voting for Doug Knack

Doug Knack is what the city of Norfolk needs. Honesty, accountability and consistency.

2nd paragraph

After reading that most in city council back McDonald that was enough to seal my vote for Knack. These people are not smart enough to spend my taxpayer dollars wisely, therefore I do not trust their endorsements of candidates accordingly.

If the City Council supports her...

"Norfolk City Council supports McDonald." How confident are you with the decision making of Norfolk City Council lately---light rail, closing down businesses with no notice, overdue construction projects and costs, etc. Does the fact that the Norfolk City Council is behind her re-election sound any alarms? If not, it should. This could be the first step to curing the ailments of the city of Norfolk--out with the old, in with the new!

I'm voting for McDonald

I'm not sure I understand where Knack is coming from. Does he expect McDonald to break the law so that his wife pays lower taxes? Is that what he intends to do if he is elected - break the law? Something doesn't square here. Sounds like he's running to get revenge or something. And that's not what I want in a City leader.

I have had nothing but excellent customer service from McDonald's office. If someone is competent, knowledgable and experienced, and is doing a great job, why vote them out?

McDonald gets my vote, hands down.

State Tax Commissioner says Sharon is wrong

Actually OVgael, the State Tax Commissioner just last month ruled that Sharon McDonald had not been applying tax code properly. Who wants to break the law again? Enough said

The Knacks seems to have the Moral Highground in this Case.

This story seems to indicate that Ms. McDonald has gone a bit "above and beyond" in her authority to bill this particular business. It appears as though it has become personal, and an elected official should Never let it become personal. It's sad what power does to some folks.
