A quiet Chesapeake neighborhood, a rare hate crime charge

Malencie Ballard arrived home one day in the spring to find a statue of black Sambo planted in the yard of her next-door neighbors, the Young family.

The two families had argued over kicked balls, loud parties and litter during the eight years they’ve lived side by side on Aguila Drive in the city’s prim Las Gaviotas neighborhood.

The statue, painted black with white eyes and lips and with a watermelon in hand, angered and offended Ballard.

“I dreaded going home,” she said.

The dispute in the golf-course community escalated. On June 21, police charged father and son Dan and Anthony Young with felony hate crimes, accusing them of going on a baseball-bat wielding rampage on Ballard’s property. Ballard is black, and the Youngs are white.

Such charges are rarely brought by Chesapeake prosecutors, according to FBI statistics. The city had 45 reported hate crimes between 2002 and 2007, with a peak of 12 in 2004. The state defines a hate crime as a criminal act intended to intimidate a victim because of race, religion or ethnic origin.

Messages left with the Youngs at their house and work were not returned. Anthony’s attorney , Hugh E. Black III, did not return a phone call seeking comment.

Reached at work, a man who identified himself as Dan Young’s brother, Robert, said “there’s definitely two sides to this story.” He declined to elaborate.

Malencie Ballard, who owns M&M Greek & Embroidery shop in Norfolk, said she moved into Las Gaviotas in early 2002.

The 900-home community off Cedar Road is nestled between golf courses and set along ponds and shallow waterways.

Neighbors in the suburban community include Mayor Alan Krasnoff and a state Supreme Court justice .

Ballard said she bought a two-story, two-car garage home across the street from the Chesapeake Golf Club.

The Youngs had moved in a few months earlier, Ballard said.

The families were pleasant to each other but never close. The Youngs have a school-aged child; Ballard’s adult daughter lived with her. She said she does not like balls thrown into her yard or the boisterous games the neighborhood boys play that often spilled into her yard.

“I don’t want other people to damage my things.” she said. She added that she can sometimes be cranky.

After one rowdy and unsupervised boys basketball game, Ballard said, she and her neighbor got into an argument.

A few days later, the Sambo statue appeared, pointing at Ballard’s home office, she said. More stone figurines, their faces painted black, showed up in the Youngs’ front yard, she said.

On June 21, Father’s Day, the Young s held a family gathering at their home.

Ballard called police to complain about the noise. Police came, and the Youngs turned down their music. Dan Young “was openly belligerent” to the officer, according to court records.

When police left, Dan Young, 53, and Anthony, 27, grabbed baseball bats and stomped into Ballard’s yard, and they yelled obscenities and racial epithets at their neighbor’s house, court records say. The men slugged the trees and shrubs, according to prosecutors.

Ballard locked her family inside and called police again.

The Youngs each face two felony counts of committing a hate crime and trespassing. The men rejected a plea agreement and were indicted by a grand jury in September.

They have a court hearing next week, but a trial date has not been scheduled.

Ballard said she does not want to move. “All I want is some peace,” she said.

Next door at the Youngs’, the statues have disappeared. A “For Sale” sign is planted in the front yard.

This is what I do know

I know the background on this situation.1st I know Ms. Ballard and she has a good heart however her views on real life situations are very unrealistic! I also know the people next door to Ms Ballard. They are not racist(and I am African American).I do think that they were wrong for trying to get at Ms. Ballard by taunting her with that lawn jockey. However I do know that Ms Ballard can be very underhanded herself and I think she has some blame to share in this.I know Ms Ballard's adult daughter and she has quite the temper on her. Knowing what I know and reading all the comments on this story most would agree that they would never ever want to have the Ballard's for neighbors!I hope that the Young's do not get convicted of felonies and have to deal with that for the rest of their lives over this.I especially feel sorry for Thomas [(Ms. Ballard's (boyfriend/husband?)]and the adult daughters father who seem pretty level headed and having to put up with all the drama!

Not a racial case...

This is not a racial case...however, the 2 neighbors who came over wielding baseball bats should be going to jail. We put up with a neighbor who had no respect for us or our property...basketballs being bounced off our vehicles, music being played so loudly that it could be heard in every room of our house, etc. We called the Chesapeake police and when it finally went to court, the officers lied in court, under oath...don't be surprised if the same thing happens here. As far as those bashing the neighbor who called the police, I say this: if you have not been in a situation of fearing your neighbor, back off...being concerned for your safety in/around your own home is not something to be scoffed at...she had every right to call the police to protect her property and family!

The problem with everything that you wrote is that you wrote it "assuming" that everything Ms. Ballard alleges is true. It is not true and she is accusing innocent people. Did the Senior Mr. Young get frustrated? Probably. Was the Junior Mr. Young involved for even one second of the frustration, NO, he was not but somehow Ms. Ballard thinks that it was right to accuse the Junior just because he was there that night on Father's Day with his children. That is the definition of racism. The Young's house, yard are always clean & they have the utmost respect for other people's property, especially cars, homes and yard. Ms. Ballard has called the police so many times that it gets frustrating to live in your house & be watched every moment & have the police called for every little thing that she thinks is wrong. Like many have said on these posts, she shouldn't be living in a neighborhood. All I can do is pray for the Young's and pray for Ms. Ballard. Read "Iknowitall".

cranky neighbor?

Who doesn't have one of those? Racist neighbors too? All of us whom reside in a mixed neighborhood. To steal a phrase from Rodney King, "Can't we all just get along"? I guess not. I'm no lawyer, but isn't 10pm until 6am quiet hours? Daytime hours are for making noise, like lawn mowing, weed-eating, edging, tree trimming. I guess those activities didn't bother her. Maybe it was because she wasn't invited to the party, that loud boisterous event that was happening next door w/out her. And just my take, does her picture not indicate she's a cranky neighbor, not trying to judge a book by it's cover, but she said she's a little cranky. I guess it's up to the person to figure out just what is a little.

I know ms. Ballard, and I know about the Youngs. They are not victims here. The pilot is notorious for mis-quoting people and this is no acception. She never told them, she was cranky. She was misquoted and the story was edited in such a way that they left out a who lot of stuff.

160+ comments about an article that probably should have never be published, especially on the front page of a local newspaper of supposedly higher caliber then the Enquirer. Please if you can't get all the facts from both sides of the complaint, that is evidently headed for a court of law, then don't print any of it. All you"experts" in law, race, human nature, human rights, etc need to go back to your day jobs and try to get your our things in order first before you judge the rest of the world on partial facts or information. 160+ useless comments including mine.

for what exactly?

160+ comments about a woman bent on ruining not one family, but two families. The VP has done it for me this time. I will never, ever pay for another copy of the VP - subsciption cancelled, end of story. Here is the problem, unlike the Enquirer, people believe what is printed in the VP. Both of the Young families (including the 3 minor children) will be affected by Ms. Ballard's unfair and untrue accusations for a long, long time to come. I'm so disappointed with my fellow man at every level of this whole mess. And I don't care what color your skin is...when your heart is mean and your "inner man" is ugly...it's ugly and very difficult to hide. The color of your skin makes NO difference at all. So they are 160 plus comments that are about two things - those who believe what they read in our sad excuse for a newspaper and those who know the truth.

No victim here

You said because of what I wrote that I am a victim of Ms. Ballard. I am no victim. You hide behind your self-righteous attitude,trying to make everyone believe the Young's are God-like and Ballard is the Devil. Lets state some facts shall we. Young, Jr is not innocent as you portray him to be. He decided to drive drunk and as a result of his disregard of the law and other lives, he hit another person and then left the seen. Hit and run. . Check it out, it is public record. Mrs. Young did come on Ms. Ballard's property and got in her face for speaking to her son and his friend because Ms. Ballard got tired of asking those 5 or 6 boys (who were unsupervised) to stop kicking balls and stop running through her yard, repeatedly. They retaliated, by putting the ugly sambo figurine facing Ballard's house (which by the way the Association agreeded was racially offensive). Kids will be kids, but it is our responsibilty to teach them when they are doing something wrong. Not to uphold them in it. They are perfect examples of not how to conduct yourself.
