RICHMOND
Prosecutors can retry an ex-sailor who received a conditional pardon from Virginia's governor after spending 11 years in prison for the rape and murder of a fellow sailor's wife, a federal judge has ruled.
Derek Tice was one of four ex-sailors known as "The Norfolk Four" who claimed that their confessions to the 1997 rape and murder of 18-year-old Michelle Moore-Bosko were coerced. Gov. Timothy M. Kaine freed three of them in August, saying he had "grave doubts" about their guilt but lacked sufficient evidence to declare them innocent.
The conditional pardons left the convictions on the men's records. Tice's convictions were tossed out six weeks later by U.S. District Judge Richard L. Williams, who cited a defense attorney's failure to try to suppress a confession taken after Tice had invoked his right to remain silent. Lawyers for the state and Tice disagreed on whether he could be retried in light of the governor's conditional pardon.
Williams said Thursday that Tice can be retried, and gave prosecutors 120 days to make a decision.
"This Court has not concluded that Tice is actually innocent of the crimes of which he was found guilty," Williams wrote. "Tice has not persuaded any court that he was the victim of prosecutorial misconduct. Nor is the Court persuaded that any effort to retry Tice is suggestive of prosecutorial vindictiveness."
Desmond Hogan, an attorney for Tice, said he had hoped Williams would bar a retrial. He said prosecutors don't have to retry Tice, and he would be disappointed if they do.
"A lot of people would be shocked if they did, given the governor's grave doubts," Hogan said. "In light of the entire history here, it would really be a shame to put Derek through this."
The state attorney general's office declined to comment on Williams' order. David Clementson, a spokesman for the Virginia Attorney General's Office, said any decision to retry Tice would come from D.J. Hansen, a special prosecutor in Chesapeake.
Hansen, a deputy commonwealth's attorney in Chesapeake, has defended the convictions. He said in August that he stood by statements he and another prosecutor, Derek Wagner, made in a letter to the editor of The Virginian-Pilot, denouncing the bids for pardons.
"It is unfortunate that the facts of this case, as decided by the justice system, are being drowned out by a series of post-trial armchair opinions that have no scientific basis and would not be admissible in a court of law in this commonwealth," he wrote.
Hansen was not available for comment Thursday night.
Williams' rulings put Tice in an unusual position compared to the other two men who received conditional pardons. The original convictions of Danial Williams and Joseph Dick remain intact, so they are not subject to possible retrial and imprisonment. A fourth co-defendant, who was convicted of rape but not murder, had already been released from prison.
Hogan said it would be unfair if Tice's successful challenge of constitutional violations in his first trial put him in jeopardy.
"I don't think it was the intent of the governor to expose Derek to being put back in prison," Hogan said.
Thirty former FBI agents and some ex-prosecutors had lobbied for exoneration of The Norfolk Four. The ex-sailors' cause also was championed by novelist John Grisham, who has homes in Virginia and Mississippi.
A fifth man convicted in the case, Omar Ballard, has said he alone raped and killed Moore-Bosko, whose sailor husband was at sea when she was slain in her apartment. His was the only DNA found at the scene, and Kaine said his was the only confession with information matching the crime scene.

Does DNA help Black people
I am appalled at the Governor of State of Virginia for actually giving persons pardons. The ironic thing here is that it boiled down to DNA evidence. Well not sounding like a 'drum that has been beaten over and over again' when do people of the Black community get the same typeof justice? Wayne M. Scott an alleged Black convicted rapist and robber received lfe plus 100 yerars and there were no witnesses, no eveidence and the DNA from the 'rape kit' was that of a white male. Mr. governor -elect Bob McDonnell was the Attorney General and refused to look at the mistakes done by the prosecutoers and the Roanoke police departments and now an innocent Black rots in jail while Mr. Trice and his buddies make a movie.

Some people memory must be fading fast. It was Joe Dick who testified against his former shipmates. Joe Dick was the one that cried and looked the Moores in the face and apologized to the Moores. NOT DEREK TICE. Michelle was friends with Omar Ballard. It is because he is of a different orgin that everyone wants justice because Derek Tice and other other guys are of the same orgin as Michelle. Read the book the wrong guys. John Grisham is writing a screen play and making a movie about this case. Even former Virginia FBI agents and former Virginia Attorney General say these guys, Joe Dick, Dan Williams and Derek Tice are innocent. Even out of Michelle mothers mouth came that "Michelle lied to her about where she was going that weekend and went to Norfolk to marry Billy Bosko". These guys all along said that they had nothing to do with this at all from the start, but because Det. Ford would not believe them he pressured them into coercing a confession. Read all of their statements, none of them match.

Derek Tice, a previously convicted murderer and rapist will be retried for the horrific acts he committed against Michelle Bosko. Derek Tice admitted to murder and rape repeatedly, confessed at trial, testified against his co-defendants and even cried while apologizing to the family members while he was being sentenced in court.
Derek Tice was a murderer and rapist then and he's a murderer and rapist now.
I don't have a short memory. I remember quite well the history of this case. Once Omar Ballard admitted to the crime and indicated he would take the rap by himself, (coupled with DNA) the other defendants all started saying they were innocent, that they were 'coerced' into admitting their guilt and that they falsely accused their co-defendants. Take that to the wailing section! Justice for Michelle Bosko will be served.

When is the state of Virginia going to stop wasting the tax payers money and retrying a innocent person??? When is this nightmare going to end for all of the families involved?? Gov. Kaine should have given the "Norfolk 4" a full pardon and this would be over for good. With all the former FBI agents, former attorney generals for the State of Virginia rallying around the Norfolk 4 for a full pardon, why would Hansen even think about retrying Derek Tice?? This will only make them look like the idiots they are by retrying an innocent man. Does the State of Virginia not have the guts to stand up and say we made a mistake. With no DNA evidence or the crime scene matching these guys statements what do they have???? NOTHING but ego. Justice has been served with Omar Ballard sitting in prison for the rest of his life. The Bosko's hid him in their apartment from a mob when he raped a 13 year old girl, so Omar Ballard was good friends with the Boskos. Omar Ballard has a history of raping women. The Norfolk 4 were serving their country and had no history of trouble at all with the law.

'Does the State of Virginia not have the guts to stand up and say we made a mistake. With no DNA evidence or the crime scene matching these guys statements what do they have?'--The state has the guts to prosecute this criminal for the murder and rape of Michelle Bosko. Derek Tice is a murderer and a rapist, nothing more nothing less. Concerning DNA evidence, the majority of cases tried in most courts throughout this nation do not have DNA evidence. The premise in which you offer your argument is that if a criminal case does not have DNA evidence of a perpetrator then the perp clearly should not be tried or convicted. If that's the case then thousands of cases would never go to trial and thousands of criminals would walk free. With regards to the defendants statements of the crime scene not matching up that's impractical at best. During the initial trial some of their statements matched concerning the furniture layout of the apartment, some of their statements didn't match. Later at trial, when all of the defendants started snitching on each other their statements started to match...quickly..I wonder why?
Backfire!
Prosecutors will probably attempt to retry this case. It called at attempt to cover up a bad conviction. Could backfire though if he is found not guilty. That could make the entire case look like a sham. Better to leave a sleeping dog lie!
