No charges for teen who filmed bus beating

A teen who filmed the beating of a Smithfield High School freshman on a school bus in September and posted it on the Internet won't be charged.

Isle of Wight County sheriff's Capt. Paul Phelps said his office reached that decision last week after consulting with Commonwealth's Attorney Wayne Farmer.

Phelps said the teen did not cause further harm to the victim by recording the incident and publishing it on You Tube.

Farmer said he had considered charging the teen with harassment by a computer, a Class 1 misdemeanor.

"While his conduct is, quite frankly, deplorable and indefensible, we don't think it meets the requirements of the statute," Farmer said Tuesday. "We looked at other statutes as well. The mere act of posting the video does not qualify as criminal."

Kaleb Wilson, 16, was attacked Sept. 23 while riding the school bus home. He was hit on his head, face and back at least two dozen times as others cheered and laughed. At least one student filmed the beating on a cell phone.

Another 16-year-old was charged with malicious wounding.

I have gotten to know the

I have gotten to know the young man that was beaten, and he has a bright future ahead of him. There is alot the public does not know about this kid. This is not the first time he has bullied, so before you judge get all the facts on the things that he has done to others.

I love this.

I especially love how that video had like 20 views, and then his daddy called the media and it skyrocketed! So if you think about it, having the news publicize the humiliating video of his own son for all of Virginia to see is at the fault of Lee Wilson.

I can say if you knew the parent and saw the doctor bills,and permanent long term damage to his eye you would not say that.

Where is the PTA/O

My question is where is the Parent Teachers Association/Organization. Are they not elected to handle events of this nature or are they there to ensure the teachers have a monthly luncheon? It is time for this organization to begin performing their duties and be a voice to protect the students. It is also time for the citizens to stand up to the school administration and let them know they are elected officials and will be removed if they are not capable to teaching and protecting our children.

don't you know that by not charging that boy then it will increase this happening. Kids nowadays beat other kids and film it and put it on you tube for kicks...There has to be consequences or it will happen so much more. Show them that it is not right to this because that's the only way to make it stop. Don't encourage more! We need to get a handle on these kinds of things or else we all lose. Come on stand up to the plate and do something about it before it's way too late and a kid gets killed even.

Videoed bus attack

The punk who videoed and then posted this "PLANNED" attack on a much smaller and out numbered adversary should be carried out in the street with cameras rolling, by however many people want to watch, as his own parents tear his back side off and hand it to him. The victim should then be allowed to get in a good swift kick or two of his own.

As for the assailant? He needs to be expelled from school, for the year! With no alternative learning possible. Let him get his court punishment out of the way, if there is any! He would then have to start school over next year at whatever grade level he has just started for the probable 3rd time. Big moron and bully! My child would have my blessing to run up on the heads of whoever made a wise crack or played in/about the whole situation.

Let me video the prosecutor getting his feelings hurt by a bad judge-ment call, then post it on line. I'm sure he would want to file charges.

bullies

Bullying has drastic long term impact on the victim. These bullies need to have thier names published , prosecuted for battery and be subjects of law suits. then maybe the idea of bullying someone because they are smaller or of just the posseser of a non confrontational and kind spirit will be given a second thought by these instigaters. do exactly to these bullies what they did to thier victims, hit them where it will hurt the most and leave a scar.

Were this my son I would enroll him in a martial arts class to get his confidence back. Also I would make sure he had a pocket full of super sharp #2 pencils and always kept one in his hand with his thumb on the eraser. If anyone assaults you son jab them as hard as you can with the pencil. Let us, your parents, worry about the legal problems from your actions. But above all else son protect yourself.

Publicity Stunt?

I love how the parents of this kid and or his lawyers are using the media to hype up the situation. The kid barely has black eye, you know that thing that happens when a baseball hits you in the eye. I'm confident the school has plenty of experience in dealing with these types of situations. Let the school do their job, don't bring every problem in your life to the presses, and more importantly, move on with your lives. Oh, I forgot that this is America, land of the sue everything that moves...
