General: SEALs on trial for apparent cover-up of incident

The Army general who ordered three local Navy SEALs to trial for their involvement in an alleged case of detainee abuse says he is more upset by the men's apparent attempt to cover up the incident than by the "relatively minor" injuries inflicted on a high-value detainee.

Maj. Gen. Charles T. Cleveland, head of Special Operations Command Central, wrote to lawmakers who had questioned the prosecutions that their perceptions of the case appear to be based upon "incomplete and factually inaccurate press coverage."

Fox News was the first to report in November that the SEALs would be prosecuted for their actions in Iraq in early September, spurring tens of thousands of people to sign online petitions calling for the charges to be dropped.

The military released Cleveland's two-page letter Wednesday evening. It came in response to a Dec. 10 letter from

Indiana Rep. Dan Burton, co-signed by 40 other members of Congress.

"While the assault and resulting injury to the detainee were relatively minor, the more disconcerting allegations are those related to the sailors' attempts to cover up the incident, particularly in what appears to be an effort to influence the testimony of a witness," Cleveland wrote.

Petty Officer 1st Class Julio A. Huertas Jr. and Petty Officers 2nd Class Matthew McCabe and Jonathan Keefe, assigned to SEAL Team Ten at the Little Creek campus of the Joint Expeditionary Base, face multiple misdemeanor charges related to the treatment of Ahmed Hashim Abed. Abed is thought to be linked to the 2004 killings of four Blackwater contractors whose bodies were dragged through the streets of Fallujah and suspended from a bridge.

McCabe is the only person charged with assaulting Abed. Prosecutors have said he punched Abed in the midsection.

Huertas and Keefe are charged with dereliction of duty for not protecting Abed, and all three commandos are accused of making a false official statement when questioned about the incident. Huertas also is accused of impeding the investigation.

"General, surely you agree that we are in a war that we must win," Burton wrote to Cleveland on Dec. 10. "Our troops and your SEALs need to be bold and decisive in combat; not looking over their shoulder fearing legal jeopardy for every action or gesture."

Citing "press reports," Burton questioned whether Abed had actually been in the SEALs' custody when his injuries occurred and said that al-Qaida operatives are trained to "self-inflict injuries for the sole purpose of accusing U.S. forces of abuse."

Cleveland responded to both points, saying that the allegations of mistreatment didn't start with Abed and aren't based solely on his word. Rather, the allegations were "initially raised by other U.S. service members," he wrote.

And Abed's alleged injuries occurred several hours after the operation had ended, while he was in U.S. custody at a detainee holding facility, not during the operation that captured him, Cleveland wrote.

About 100 people gathered to protest the charges when McCabe and Huertas were arraigned Dec. 7 at Norfolk Naval Station.

They are scheduled to be tried later this month in Norfolk. Keefe's trial has been set for April.

All the offenses are misdemeanors punishable by demotion in rank, up to a year in jail and a bad-conduct discharge. Cleveland said he chose to deal with the incident through non judicial punishment - an option that would have kept the case out of the public eye but could have effectively ended the SEALs' careers.

The men refused that option and chose to face courts-martial.

Cleveland explained that several factors led him to refer the cases to courts-martial:

"Discipline and integrity are primary factors that make our U.S. special operators such an effective fighting force. The abuse of a detainee, no matter how minor, creates strategic repercussions that harm our nation's security and ultimately costs the lives of U.S. citizens," he wrote. "When there are reasonable grounds to believe that an offense has been committed, and that a specific individual in my command has committed that offense, it is my duty to take appropriate action to not only ensure justice is done, but also to maintain good order and discipline."

you took my name as to mean I'm old in age, which I am not. I've said what the real meaning is in the past. Your comments directed towards the elderly are discriminatory, if you discriminate against the elderly you probably discriminate against races, gender, sexual orientation and on and on. "False Official Statement"

General Cleveland is fretting about how he is "more upset by the men's apparent attempt to cover up the incident" than the alleged incident itself.

Well, General, here is a far larger cover-up for you to convene a court-martial about so that you can get to the facts via "an impartial panel".

Your defendant is General Stanley McChrystal.

The cover-up allegation is made by Jon Krakauer, author of the new book, "Where Men Win Glory".

To quote the author verbatim, "The man chosen by Barack Obama to lead the war in Afghanistan also helped cover up the friendly-fire death of NFL player turned soldier Pat Tillman".

A few people seem to think that General Cleveland is not politically motivated with the SEALs courts-martial, and only wants to get to the truth. I will believe it when I learn that Cleveland demands General McChrystal to explain McChrystal's own behavior, under oath, regarding the truth or falsehood of his statements with respect to Pat Tillman.

The Code

The three operators are innocent until proven guilty and deserve their day(s) in court. However, the following passage is from the Navy SEALS code and it address's this situation IF it's true.

"I serve with honor on and off the battlefield. The ability to control my emotions and my actions, regardless of circumstance, sets me apart from other men. Uncompromising integrity is my standard. My character and honor are steadfast. My word is my bond".

"Uncompromising integrity is my standard" stands out to me.

I dont often comment on national issues

or agree with Mr. Wizard.....but in this case hes right on......all of you PRO war....sacrifice my freedoms for my safety types are a real embarrassment....we have hard working spec war folks out their fighting for our freedom and benefit of our nation and some of you are making a joke out of it with your comments

If you are so concerned regarding how our POW are treated, how about calling for the release of the information regarding our POW from the first gulf war, it will turn your stomach. Hope you can handle it. Now lets look closer, our citizens were hung from a bridge and beheaded on live TV, and somehow this punch is being equated to the Army Abu Ghraib incident. I do not know if this is merely a disillusioned attempt by a disgruntled Army General at a command that historically had been headed by an Army General and now is headed by a Navy SEAL Admiral, as an attempt to scandalize the Navy vice the Army who has taken many media hits in these wars since 911. Punch or fat lip not a "beating", not torture

larrygump, of course we would be and ARE outraged when our soldiers are captured, tortured, beheaded, scalded, electrocuted, no the order of Charlie Manson etc., but American soldiers don't do commit these heinous acts--this terrorist alleges a fat lip or punch. It dishonors soldiers who have endured prison camps or torture to put this "punch" in the same category.

Why do Terrorists deserve to live or better yet deserve a trial at our expense? First off they are not recognized combatants under the Geneva Convention. Therefore they dont deserve the "humane" treatment they receive now. You sicken me by disrespecting the MEN of our Special Operations Community. Deja Vu

I remember when we were all in a hoot and a holler about the "alleged" incidents at Abu Ghraib.....then too there were a bunch of us who wondered what the H**l was going on in the minds of the Generals and we were saying pretty much the same things that I am reading here.

Then the ugly truth came out AND as hard as it was to swallow the rest of the troops STILL did what they were suppossed to do.

This is not about how Combat Operations are conducted, its about veracity.

Let the system do its work and bring out the facts.

Abu Grhaib one of the causes of this over reaction

LORENZO, the reprehensible behavior of soldiers at Abu Grhaib-- and loss of control over (or neglect of) those personnel at Abu Grhaib by the chain of command is partly to blame for this EXTREMELY politically correct over reaction to a mere (alleged) punch in the stomach. Let's be clear, SEALS are not prison guards, personnel of the caliber that were employed at AbuGrhaib. And, a punch is immeasurable distant from the sexually degrading and ongoing conditions at the prison. This is no tip of the iceberg.
