SEALs should face accuser during trials, military judge rules

If the government won’t bring a suspected Iraqi terrorist to the United States to testify about alleged abuse at the hands of a Navy SEAL, the trials of two commandos accused of not safeguarding him will be held in Iraq, a military judge ruled Monday.

In back-to-back hearings at Norfolk Naval Station, Cmdr. Tierney Carlos said Petty Officer 2nd Class Jonathan Keefe and Petty Officer 1st Class Julio Huertas each deserve to face their accuser – alleged terrorist Ahmed Hashim Abed.

Keefe and Huertas are both charged with dereliction of duty for not protecting Abed, who was captured in September in Fallujah. Abed is thought to be connected to the 2004 killings of four Blackwater contractors whose bodies were burned and hung from a bridge.

Carlos scheduled their courts-martial for successive weeks in April at Camp Victory, a military base near Baghdad .

A hearing for Petty Officer 2nd Class Matthew McCabe, the commando accused of punching Abed shortly after his capture, is scheduled for Wednesday before a different military judge.

Both Keefe and Huertas also are charged with giving a false statement to an investigator, and Huertas is accused of impeding an official investigation. All the charges are misdemeanors that carry a maximum sentence of a year in jail and a bad conduct discharge.

The three commandos, assigned to SEAL Team 10 in Virginia Beach, did not accept non-judicial punishment for their alleged wrongdoing and chose to face courts-martial.

Thousands of supporters have rallied on their behalf on the social networking Web site Facebook, and several members of Congress have questioned the decision to proceed with courts-martial.

Gregory McCormack, Keefe’s civilian defense lawyer, has pushed the government to make Abed available to testify, something officials apparently balked at. In the meantime, Army Gen. C.T. Cleveland, head of U.S. Special Operations Command Central and the person who decided the SEALs should face trial, issued an order for Abed to provide testimony about what happened through a deposition.

Carlos said he couldn’t stop the inquiry but would not allow it to be used as a substitute for Abed’s testimony at trial, which is now scheduled for April 5. If Abed, who is being held in U.S. custody, is available to give a deposition, Carlos said, then he should be available to testify at the trial.

In both hearings, Carlos explained that moving the trial to Iraq complicated logistics but is necessary to preserve the accused men’s rights. Camp Victory has lodging and dining facilities available to handle the case, he said, and a jury can be assembled from the sailors serving there.

Monica Lombardi, Huertas’ civilian attorney, came to court prepared to fight prosecutors’ motion to delay the trial. That wasn’t necessary after Carlos’ ruling to hold the court-martial in Iraq, tentatively scheduled for April 15.

“I want the members of the jury to see this witness, this terrorist, and they can judge for themselves if he’s telling the truth,” Lombardi said.

She said she still hasn’t seen much of the evidence the government has assembled against her client, including pictures of the alleged abuse.

The name of a second accuser – a fellow sailor whose testimony Huertas is accused of trying to influence – also surfaced during the hearing.

Lombardi said Petty Officer 3rd Class Kevin Demartino, who was helping to guard the detainee, made five separate statements about what happened.

“Each time, he tells a different version of events,” Lombardi said.

Not just government

I would like to expand that comment to include the many bleeding heart liberals who think the goverment is politically correct by prosecuting these three SEALS. To those is say - if you have never been faced danger daily then perhaps you should get out from behind your desk and spend a day in their shoes before trying to bury them.

This is UNBELIEVABLE!!

Why are we crucifying the brave men and woman who are serving our country. I believe the words of our "American Soliders" Personally, I believe that if this "TERRORISTS" (just in case ya'll forgot) had ANY chance to terminate the lives of "OUR AMERICAN SOLDIERS" he would, so why are we prosecuting our people and sending them back to a death sentence..this is WAR, not a game of Risk. Let our troops do their jobs or get the heck out!

Our future as a nation

Sooner rather than later there is coming a day that this great nation will become a third world country and one of those reasons is there will be no one in uniform to defend it. Little by little our freedoms are eroding and we continue to treat the enemy as if he’s a shoplifter at 7-11. I would like to see our political leaders take a walk down a street in Afghanistan of Iraq and if they make it then ask them about the peace loving religion of Islam. busy street in We need to wake-up as a nation and stand up against the poor leadership in this country and the decisions they make regarding he Constitution of the United States, you know, that document that seems to be under attack on a daily basis. I am beside myself as a veteran who fought in Desert Storm and IOF that this even happening to bravest people we have wearing a military uniform. May God have mercy on this country?

Trials To Iraq

As a retired United States Naval Officer, I believe the military is sending this case "out-of-sight...out-of-mind." The protesters in the USA have made an impact on this case....it won't in Iraq. Judge: Gutless illegitimate children!

Defense Attorney Wants This, Jury of Sailors

Hmm, not so sure. No doubt when the dirt ball terrorist is escorted in ...in his jump suit to face our men in uniform, in front of jury of men in our uniform--our men will prevail. I would also expect full press coverage of this regardless of location. Still, I was ready to protest outside the Naval Base Gate every day of this trial.
If the defense attorney wants to confront the terrorist in Iraq--it's likely to be a good tactical move. Still, don't let up expressing support for the SEALS.

Seriously?

Why not save time and effort and just declare the seals free and clear, if I was still a sailor picked to be on that jury that's exactly what would happen. Seems like a good setup to me, release them now, save time, stress, and cash.

Thats the way it is and Should be, it is a Military Trial, thats how it works. I agree with one statement you said... Let them go now! Do you really want our Seals tried for this stuff. Gee, the terrorist in question sure "safegaurded" the Blackwater employees they had in thier custody. War is not pretty, and liberals need to understand that.

Playing politics

Moving this trial back to Iraq just re-enforces my belief the U.S. wants the world to know we are squeeky clean human rights activists. Never mind we are fighting an enemy that knows our next move or reads our plan of attack. I am embarrased to say I spent over half of my life defending the beliefs of this country only to have these ideals flush down the toilet by a bunch of rear echelon politicians.
