The debate is a perennial one at the General Assembly.
School officials say they need to start classes before Labor Day to prepare students for testing in May. The tourism industry says starting earlier would hurt businesses - and, by extension, schools, through lost tax revenue.
In the past, the industry has gotten its way. But this year, a compromise that would allow schools to start before Labor Day on some years may have a chance.
On Monday, the bill, from Beach Republican Del. Bob Tata, passed the House Education Committee, where previous efforts have died. Tata is the committee's chairman.
Tata's proposal would allow school divisions to start before Labor Day on years when the holiday falls on or after Sept. 5. That will happen nine times between now and 2030, including this year.
An identical bill passed the Senate Education Committee but was referred to Commerce and Labor, which has killed similar measures.
Tempers flared during a hearing on Tata's bill, with opponents demanding statistics that showed students suffer when school starts after Labor Day, and backers saying there was no evidence on the other side that businesses would lose if school started earlier once every few years.
Backers of Tata's proposal say Virginia's post-Labor Day start requirement puts many students at a disadvantage, because they're competing on national standardized tests, such as the Advanced Placement and International Baccalaureate exams, against students from states that are allowed to start school in August. Meanwhile, they're competing on the SOLs against students from the more than six dozen Virginia localities that have obtained exemptions from the post-Labor Day requirement. Those students all have extra study time, proponents say.
Localities can be exempted for "good cause" - typically because they expect inclement weather later in the year.
Tourism industry representatives from Virginia Beach, Williamsburg and Kings Dominion theme park said they count on families visiting in the week leading up to Labor Day. They said they also count on students for their seasonal labor.
The bill pitted Virginia Beach school officials against representatives from the city's main industry, along with some city officials.
Tourism areas in other states - Myrtle Beach and Hilton Head in South Carolina and Orlando in Florida, among others - start school before Labor Day and have found ways to make it work, said Virginia Beach School Board member Carolyn Weems.
"Were any of those states recognized as the best state for business?" asked Del. Mark Cole, R-Fredricksburg, referring to several national accolades Virginia has won.
Virginia Beach City Councilman John Uhrin, who represents the Oceanfront and is director of operations for a hotel management company, spoke against the proposal. And, according to a spokes woman, Gov. Bob McDonnell doesn't want to undermine the tourism industry and jeopardize any potential late-summer revenue.
Tata told tourism industry representatives that by lining up against his bill, "you're signing your own death warrant."
This bill "bent over backwards" to find a compromise, he said. If it's not passed, another bill that allows school divisions to decide for themselves when they should open every year - instead of just some years - eventually will be, he said.
"Within five years I'd say that bill would pass," Tata said.

Changing Start date for schools
I believe that Va. law says that school districts can't start until after Labor Day, but I believe school districts can get waivers to start before Labor Day. I know that some in the Western part of the state start before Labor Day - Botetout County starts before Labor Day.
So, why can't other districts get the waivers? Maybe bcause they don't ask for it.

This seems like a lot of noise about nothing. There's zero reason to change it and disrupt everyone's schedules so don't.

I cannot imagine where you spend your summer vacation, but you need to step back and look at how ridiculous your post comes across. If you are gauging your facts on Busch Gardens alone they are certainly not the only ones to hire summer help. I see high school kids working in every aspect of the retail network from fast food to department stores and even landscaping businesses. I can safely say that most of them are from the good ole USA. Busch Gardens appeals to foreign students because many of it's themes are European. The schools waste too many days during the year for teacher work days and such.The solution would be to let the teachers and staff work during the summer. It is ridiculous that they get the entire summer off for vacation. No other job gives such generous vacations to it's employees.

Obviously you have no idea what a teacher does on workdays. Come on into the real world and find out. As far as having the entire summer off for vacation, it is unpaid vacation. Just thought I would clear that up. In case anyone else thinks this, teachers and staff do not get paid in the summer unless they are 12 month employees. Besides, they need the summer off to recoop from those darling angels they have to put up with everyday. Welcome to 2010, it is nothing like it was in the 60's. Dare you to try teaching, bet you couldn't make it a month. Of course some of them would not object to working in the summer with no students. WOW what would that do to the budget......... Lets see, all teachers and staff work while students are at home for the summer. Makes sense to me. More money for teachers and staff, we can't afford to pay teachers now so let's make them work inthe summer and pay them more. Come on...
Their salary
is based on a 9 month contract (might be 10 but it definitely is not 12 months) - and they can elect to have that paid to them during the school year or they can draw it over 12 months (i.e., for simplification, 12k/9 month contract they can elect to draw $1333/mo or draw $1k per month for 12 - now I know they make more than that was just using that for simplification)......so they don't get 'paid' for 2 months vacation unless they choose to draw their salary over 12 months. So, for 12 month contract, salaries would go up, school utilities, etc., would rise.....fiscally it isn't sound. That is why the 'year-round' program ended - cost too much, saw too little benefits of it.
Just an Observation.....
And these vacations and holidays are not paid. Does your job give you a paid vacation? Pay for your Thanksgiving day? Did your employer make you make up the day/s missed for the nor'ester? Does your company expect you to finish your job at home on the weekends...no overtime pay? Or worse yet, think that they can force you to come in on a Saturday to make-up a day? Have your company's head-honchos announced that your job is 24/7? Do you pay for your own office supplies?
Before anyone starts moaning and groaning about what swell jobs we have as teachers, I would invite you to volunteer, to change careers, or to substitute....we can always use a fresh perspective and help.
I just finished doing my grades at home but will still have to make-up this time.
Observation
As a retired teacher I agree. If you think that the job of teaching is "easy" and summer vacation is really a vacation then try doing the job for at least one week (Monday-Friday) and then you HAVE to come back on Monday. Believe me having to think about coming back on Monday may be the real test of how you think about teachers.
You have to do your planning (yes people, teachers have to have Lesson Plans), you have to teach, you have to solve discipline problems (if any), you may have a PTA meeting, parent conferences, Team meetings, report cards, AND it snowed and you have a snow day - WHICH YOU AND THE STUENTS HAVE TO MAKE UP EVEN IF YOU HAVE TO GO TO JUNE 30 (in VA).
Being retired I can now say: Teachers are NOT babysitters to your children. If you think so then I would remind you that you can get a babysitter alot cheaper with less education. AND, If you think we are then YOU need an attitude adjustment.

This is a local issue !!!
kind of hypocritcal...
that city officials would put tourism dollars before education of local kids -- yet they moan and groan when the education of local kids fails.
