House to lift time limit on handgun purchases

RICHMOND

The House of Delegates advanced legislation Monday that would repeal the state's one-handgun-per-month condition and exempt guns made and used in Virginia from federal firearms laws.

The Republican-dominated chamber also set up a final vote on a bill that would block public access to concealed-carry permit records filed in local circuit courts. Final votes on all three measures will occur today, the House's deadline to finish work on its own legislation.

On a voice vote, the House took another step toward approving the repeal of Virginia's limit on handgun purchases. The one-handgun-per-month law, passed in 1993, was a signature initiative of former Gov. Douglas Wilder, a Democrat, who pushed it as a means of reducing illegal gun trafficking.

However, supporters of the repeal say that the limit on handgun purchases has lost its effectiveness after lawmakers carved out an array of exceptions, including an exception for gun owners with concealed-carry permits.

The evolution of instant background-check technology also has helped to keep guns from criminals and others who are prohibited from buying them, said Del. Scott Lingamfelter, R-Prince William County, the bill's sponsor.

"Making it harder for the law-abiding citizen to acquire a handgun legally will not stop felons from acquiring a handgun illegally," Lingamfelter said.

Del. Joe Morrissey, D-Henrico County, said that the one-handgun limit has helped to stop gun running and to reduce gun violence in the city of Richmond.

"We are unraveling almost two decades of progress," Morrissey said.

The House also advanced a bill, HB69, sponsored by Del. Bill Carrico, R-Grayson County, that would exempt firearms and ammunition made and used in Virginia from federal laws. The bill has been embraced by 10th Amendment advocates who criticize the reach of the federal government.

Some legislators questioned whether the bill could have dangerous consequences.

"I'm worried about now eliminating all federal regulations from these extraordinarily dangerous weapons that can pierce armor," said Del. Dave Albo, R-Fairfax County, who also questioned whether Carrico's bill could make unregulated, high-powered weapons more accessible to terrorists.

Carrico said his bill "only gives the good guys a little bit of an advantage of being able to manufacture them to defend themselves."

The House also advanced legislation that would deny public access to concealed-carry permit records maintained by circuit courts. The bill's sponsor, Del. Lee Ware, R-Powhatan County, said many permit holders got permits to protect themselves from specific threats and could be put at risk by having their names and addresses released.

The General Assembly last year passed legislation putting the Virginia State Police database of concealed-carry permit holders off-limits to the public. That law was triggered by The Roanoke Times' posting of the database on its Web site in 2007.

Freedom ??

Before folks start complaining about restrictions on their freedom regarding guns, they should consider the dangers to the general population by allowing unrestricted "freedoms." People are not free to slander or libel their fellow citizens under the freedom of speech Just like the old example, people are not free to falsely yell fire in a crowded theater. Many of the same folks that are against restricting guns as a violation of their freedoms are the first to support Patriot Act provisions that could violate another person's right to privacy. Reasonable people will recognize that some rules governing personal behavior are necessary to avoid chaos.

I totally agree only because

I totally agree only because the need for restrictions on these freedoms "made their case" for the public good. All I'm saying is "make your case, those who want to restrict us." That has not been done to date.

Pfft.

Virginia is for criminals

Before the restriction on gun sales, Virginia was the state of choice for criminals on the East coast who needed guns. Now the Republicans are making it easier for criminals to get guns. Then when murder rates rise in New York, Philadelphia, and D.C., the Republicans will claim that restricting handguns does not work. The Republicans are evil.

Enough!

There is no other civilized country in the world that allows people to buy virtually an unlimited number of guns, take them virtually anywhere in the country, including places that serve alcohol, display them in the open or in a concealed manner and still has gun wingnuts complaining about restricting their so-called "rights." So Virginia will soon allow people to buy an unlimited number of hand guns. Why? What are these nuts going to do with a bunker full of guns? But these folks argue that it is never the "law abiding" citizens who create the problems, just the crooks. Well, now the crooks will look to Virginia again as the easiest place to buy guns. Enough is enough!

Fred, I think you are coming

Fred, I think you are coming at this from the wrong perspective. This country is too large to totally control firearms - it cant happen. Instead, the case needs to be made for the public good the overriding reason to RESTRICT any freedom we have. That case has not been made at all re firearms. So it defaults to our "freedom" here. All freedoms should be guaranteed till such a case can be shown. And most folks are not gun "nuts" or have bunkers full of guns. Most are hobbyists, collectors, or folks just wanting a sense of independent security, not dependent on police - who cant be everywhere.

It is not

the easiest place to buy guns.....but there are loopholes. But as long as the criminals can get all the guns they want, we should be able to protect ourselves. The bad guys have the guns (if you work in a hospital er, all those shooting victims coming in - duh, they have guns and so do their friends who come in with them).....so why can't we have them to protect ourselves? This kum-ba-yah carp that nobama is spouting doesn't work - sometimes you got to have the stuff to back it up with.

That pesky Constitition

That's because there is no other civilized country in the world that has a Second Amendment guaranteeing its people the right to keep and bear arms.

However, if you believe that those like yourself that want to disarm honest citizens are in the majority, the Constitution has a provision just for you! Just propose an Amendment to revoke the Second Amendment, like we revoked the Amendment that started Prohibition. Since most people believe like you that disarming honest citizens leads to utopia, your Amendment is sure to become law!

Facts

Drugs are illegal and still readily available to any druggy. The state of VA can flounder around with the gun laws until Florida freezes over and crooks will still have as many, if not more, guns as before any legislation is passed. Bottom line: Honest, law abiding citizens will still be deprived of legally owning weapons while the crook will laugh and still procure as much as he/she wants.
The entire justice system in this country needs to be revamped, more prisons need to be built and laws toughened up to put gun toting criminals away. Heck, school kids grow up with guns, young adults think a gun is a way of life. Harden criminals are not taken out of society with existing laws. Until this country starts getting tough on crime no amount of gun laws will solve the problem.

NavRet- What law abiding citizens are being deprived of legally owning weapons? Name one law that keeps them from owning a gun and allows criminals to get guns. Or just name a law that prevents law abiding citizens from owning guns. There are time limits and hoops to jump through- but no restrictions. You can own machine guns, silencers, AR-15s, and you can own 1000s of them. What more do you want?
