Days before the Nov. 3 election, many Virginians were surprised to learn that their personal voting history was about to be disclosed to their neighbors.
The mass mailing, which would have gone to 350,000 households, was aborted at the last minute amid indications that the information might have been acquired illegally.
However, if legislation now working its way through the General Assembly is approved, voters should brace themselves. When the next election rolls around, their voting records might well end up being more widely disseminated.
Voter history lists are maintained by the State Board of Elections. They don't reveal whom a citizen voted for, but they do show who voted in which election. Under current law, the lists can be released only to candidates, elected officials and political party chair s, who typically use them for targeted mailings and get-out-the-vote efforts.
A bill, SB624, sponsored by state Sen. Janet Howell, D-Fairfax County, would allow the lists to be obtained by "nonprofit organizations that promote voter participation and registration " also.
The Know Campaign, the nonprofit group that planned the mailing last fall, fits that description. Modeled after an experiment conducted during a 2006 Michigan primary, the campaign was designed to spur people to the polls by implying that if they didn't vote, their neighbors would be informed.
An analysis of the Michigan experiment found that it was remarkably effective in pushing people to the polls.
Howell's bill is a direct outgrowth of a lawsuit filed by the Know Campaign against the elections board, saying that denying voter history lists to such groups is unconstitutional. The lawsuit has been settled.
The settlement agreement anticipates that the law will be changed so that groups such as the Know Campaign can acquire the lists legally. If and when that happens, the elections board - represented by the office of Attorney General Ken Cuccinelli - has agreed to provide 10 statewide lists to the Know Campaign at no charge and to pay $25,000 toward the group's legal fees.
Anthony Troy, a former attorney general who represents the Know Campaign, said Friday the group simply wants equal access to information that is doled out only to favored recipients under current law.
"It's pretty clearly an unconstitutional statute," he said. "The attorney general's office knows it has no defense. If the statute is not changed and there's another denial, there'll be another lawsuit."
The Know Campaign presents itself to be a nonpartisan group interested only in boosting voter turnout. However, several lawmakers expressed concerns Friday about advocacy groups getting access to the voter lists.
Del. Dave Albo, R-Fairfax County, wanted to know: What about "two guys sitting in their mom's basement" whose only purpose is tarring a candidate with scurrilous accusations? Would they be able to get the information?
Wes Russell, a deputy attorney general, agreed that it is a difficult line to draw. "You run into a free-speech problem," he said.
Some people don't think the line should be drawn at all.
"We don't favor 'carve-outs' - opening records only to certain groups," Megan Rhyne, executive director of the nonprofit Virginia Coalition for Open Government, said in an interview. "That makes us very uncomfortable. You should open them to everyone or to no one.
"Otherwise, you get into the business of asking people why they want the records and what they're going to do with them," she said. "Then you're getting into dangerous territory."

Side Note on Boy Scouts/Scouting : Explorers Scouting
I'm not really sure about how the correlation of Boy Scouts came up in a thread about voting and voting habits. But I thought some of you should know that there is a branch of Boy Scouts which is co-ed for scout 14-21 years of age. It specifically falls under Boy Scouts as far as rules and badges ect. It is called Explorers. I'm a female who was a Girl Scout until I was 13. While I learned many useful skills as a Girl Scout, including earning many badges and the Marion Medal, I found the activities as I grew older to be more centered on career focus and crafts. I already did those things on my freetime and prefered camping, hiking, boating, and ropes/high adventure type skills while scouting. I inquired at the local Boy Scout Council in 1988 about a programs with such specialties the Boy Scouts coud offer to me, even though I'm female. They were very happy to tell me about Explorer Scouting. I joined as soon as I turned 14 and remained a very happy and well accepted member of the troop, made up of both genders, until 21.

The NAACP should be 25% White 25% Hispanic 20% Asian 20% Black and %10 other ethnic groups ... after all that is the accurate representation by % of population nationwide.

Response to Batgeek re: Govt needs to close Boys Scouts
Batgeek you seem to think that it would be wrong for the Goverment to disregard the courts and step in and close down the Boy Scouts. A group that keeps women/atheists/gays out of scouting programs? does "Greater German Youth Movement" sounds familiar? Shouldnt the German govt had shut them down regardless of what the Courts said? I have nothing against the Boy Scouts as long as they:
Have at least 50% members who are women and have a combination of at least 25% atheists, gay, lesbian and transgender, drop the religious stuff and require programs that teach same sex parenting.

Your kind of PC garbage is what is killing this country! It's the BOY Scouts, why should they have to let girls in (or individuals whose actions or beliefs are in direct contravention of everything the BSA stand for)? If I'm not mistaken there is already an organization called the Girl Scouts, it's for GIRLS. Do you think it would be a good idea to force them to allow 50% males into the Girls Scouts? Or will we be having yet another double standard?
The point is that everybody has the freedom to start their own groups. If you're gay, go create the Gay Scouts, nothing is stopping you. Atheist? Form the Atheist Scouts.
But people like you don't really care about freedom. You can't just agree to live in harmony, you must co-opt or destroy the institutions that you don't like. You're going to have a tough fight on your hands. The pendulum is swinging in the other direction.

the BOY Scouts for a reason. It isn't called the Gay/Bi/Trans/Woman Scouts.
Nothing is stopping these other "groups" from creating their own Scouts type organization.
There is nothing wrong with it being a religious organization. I'm an atheist and I have no problem with them not allowing atheists to join or be scout leaders. I have taught basic riflemanship to my neighbors troop.
