The men and women who work in Gov. Bob McDonnell's executive office don't have to worry about whether they'll be passed over for promotions or fired because they are gay.
McDonnell has adopted an equal opportunity policy that prohibits "discrimination for any reason." It doesn't actually say gay workers are included in those protections, but everyone knows that's what the governor means because he said so. However, the policy covers only about 30 people. An equal number are included through similar versions implemented by Cabinet secretaries.
But those policies don't cover the vast majority of Virginia's 103,000 state employees. They don't prevent a forensic lab technician from being rejected if she asks about domestic partnership benefits during a job interview. They don't protect a museum employee from being assigned menial tasks because of his sexual orientation.
McDonnell refused to sign an executive order guaranteeing workplace protections to gay state employees. He would undoubtedly feel bad if workers were mistreated, but he doesn't think that's really any of his business.
His passive posture on job discrimination would be troubling enough if he were leaving the fate of state workers in the hands of hundreds of individual agency heads. But it's an embarrassment for McDonnell to look on helplessly as Attorney General Ken Cuccinelli bullies colleges and universities that have retained workplace protections in place for at least eight years.
Cuccinelli penned a letter last week to public university leaders ordering them to rewrite non-discrimination policies and to erase any specific protections extended to gay workers. The letter is merely an advisory opinion with no legal weight, but it leaves college officials in a predicament as long as McDonnell refuses to publicly renounce Cuccinelli's belligerence.
This is not only an issue of fairness; it's also relevant to McDonnell's core mission of job creation.
Universities often are important players in economic development packages. James Guyette, president and chief executive officer of Rolls-Royce North America Inc., cited a research partnership with the University of Virginia as a key reason his company selected Prince George County over locations in seven other states for an aircraft engine plant three years ago.
If Cuccinelli succeeds in chasing talented academics who happen to be gay out of Virginia, their loss will reverberate beyond any one campus. A Maryland state senator has already seized on Cuccinelli's letter and the commonwealth's attitudes toward gays in efforts to convince Northrop Grumman leaders that they should relocate their headquarters to his state, not Virginia.
McDonnell must decide whether it's more important to pacify his political base or to run an effective state government and attract jobs to Virginia. If a nondiscrimination policy is good for his gubernatorial staff, it should be good for all state workers.
Leadership from the governor on this issue will ultimately be good for all of Virginia.

What part of EQUAL protection under the law don't you understand? Stop singling out every minority group for special protection. Equal means just that, quit hyphenating names, you are either an American or not, and if you don't like the way Virginia is being run, take Ronald Reagan's advice: Vote with your feet. You can move to Massachusetts, California, or Illinois.

I'm not leaving and you'd better get used to that concept. I absolutely resent my tax money going to these backwater creeps (gumnuh&Cooch). We will NOT stop fighting for our rights until we have them. Furthermore, I am NOT seeking your approval. I simply don't require it. I DO demand equality under the 14th Amendment of the US Constitution. I DO demand that our attorney general actually READ the Constitution. His comments suggest that he didn't attend law school, or 12th grade government class taught at ANY public high school in the Commonwealth.
Gumnuh McDonnell and Atty Gen Cuccinelli are embarrassments to us. These gentlemen are tarnishing our reputation to businesses, tourists and students. The only way to teach these gentlemen this lesson, is through reductions of revenue this state collects. Other state senators (Maryland) are already contacting companies who had planned on moving here (Northrop Grumman). Maryland's message...if you don't like the bigotry in Virginia, Maryland welcomes you. If this happens, Virginia will lose even MORE jobs.Not to worry, your ditch digging job is secure.

I am an American, and VA is my home I have no intentions of moving because 2 bafoons were elected as Gov and AG. I will stay right here and fight them every step of the way. Neigher McD or Cucci will be re-elected for anything, and as time goes by more and more people of both parties will see what they elelcted is totally wrong for Virginia.

the attorney general, the top legal job in the state, didn't know that discrimination violated the equal protection clause of the US Constitution?
Wasn't it HE that advised the governor not to include sexual orientation in his anti discrimination policies?
I can see at least two possibilities:
1. The attorney general has taken the fall for our bigoted backwater trash governor Bob McDonnell or,
2. The gentleman, Ken Cuccinelli wasn't aware of the equal protection clause, and we are being served by someone who should have learned this in the first semester of law school, and we have an INTERN doing on-the-job training in the Attorney General's seat.
These gentleman are NOT qualified, and Virginians deserve better.

Everyone knew how the bigots McDonald and Cuccinelli stood on any gay rights before they were elected. Personally I hope Northrop Grumman does move their headquarters to Maryland. Your "Job's Gov" is going to chase away more jobs then increase them by the time these to political idiots are through.

SAIC moved their Corp HQ to VA from California when CA started trying to tax anyone working overseas under CA tax law even when the people overseas were paying taxes to the states they reported as their homestead and point of re-patriation. So if NG goes then SAIC has already taken it's place...
Leadership and recognizing reality
If McDonnell does not rise to the leadership challenge or acknowledge the moral injustice of discrimination in actual law, maybe he will recognize the reality of a diverse workplace and what this means to the corporate bottom line. Employers want productive employees who contribute to profitability regardless of their sexual orientation. Public and private Universities need intelligent, creative and dedicated instructors regardless of sexual orientation. So if for no other reason, McDonnell needs to promote equal treatment for all employees as essential to creating jobs in Virginia.
Reconsideration?
Perhaps Fox below will reconsider his dastardly remarks in view of what the Governor said yesterday on this topic. "I will not tolerate discrimination in this administration. And there will be consequences if I understand there's discrimination on any basis other than ability, merit, and willingness to follow my directives." That makes it very clear that he will not tolerate discrimination on the basis of sexual orientation. That is as it should be, and while I would prefer that policy to codified in Virginia law, until it can be I will take the Governor at his word. I am a bit disturbed by the phrase..." willingness to follow my directives"...but I believe this was in the context of discriminating against people because of their sexual orientation, which he has proclaimed will not be tolerated in his administration.

...I finally agree with you. However; the 'follow my directive' remark is no different then the oath taken by every military member who says they will follow the 'lawful order of the Commander in Chief'...
