Ashville Park, the beleaguered 452-acre upscale housing development by L.M. Sandler & Sons Inc., is on the auction block.
Wells Fargo & Co., which holds the loan on the property, is planning to foreclose on about 92 home lots and 331 acres of raw land, according to a legal advertisement published in The Virginian-Pilot. The auction is scheduled for 3 p.m. May 12 in Virginia Beach.
The firm, owned by Virginia Beach developers and philanthropists Steve and Art Sandler, purchased the property near
Pungo for about $10 million and had planned to build nearly 500 homes there with parks, ponds and equestrian and walking trails. Wells Fargo had loaned Sandler about $45 million for the development, according to court records.
Since 2007, Sandler had sold builders about 28 lots at Ashville Park for about $7.25 million, according to Residential Data Bank, a Suffolk-based housing market research company.
On the lots sold, builders constructed about 20 homes. Seven of those were sold, according to Residential Data Bank, not counting two builders who moved into their own homes. An attorney for Wells Fargo declined to comment, and calls to Sandler attorneys were not returned.
In 2008, Ashville Park hosted the Tidewater Builders Association's annual Homearama showcase, featuring homes with asking prices starting at $1.2 million. Ashville Park highlighted the development boom in this southern area of Virginia Beach, where sidewalks and large, upscale homes replaced open fields and farmland.
But the collapse of the housing market ensnared Sandler, which since has seen several developments fall into foreclosure.
The company had multiple housing and mixed-use projects up and down the East Coast. In 2008, Sandler and its subsidiaries owed at least $1 billion in bank loans.
For Ashville Park, it is unclear how much of the loan has been repaid, but on Dec. 31, Wells Fargo and the Sandlers signed a settlement agreement on some of the loans, court documents show. The details of that settlement, however, have not been made public.
Contractors who did the street work, seeded the property and repaired irrigation lines, have filed more than $832,000 of liens against the Sandler entity that owns Ashville Park, claiming they haven't been paid for their work.
Sam Cohen, a Chesapeake-based builder who constructed a home for the 2008 Homearama, said he had been expecting the bank to foreclose on the development. He said he's optimistic that a new developer could turn the community around.
"I think when it finishes, it's going to be a nice community," Cohen said. "Hopefully, it'll work out for the best for the people who are already out there, and the builders who have lots out there."
Last summer, Cohen sold the home he built for Homearama, but he still owns another lot at the community.
For Janice Rhoades, one of Ashville Park's few residents, the bank's potential takeover is an improvement over the months of limbo. "We have hope," she said.
Perhaps the grass will be mowed more frequently, some improvements will be made to the grounds, and lot prices will come down so the properties sell, Rhoades said.
She doesn't regret buying in Ashville Park, she said. She knows most of the people who live in the neighborhood, and there's plenty of room to walk her dogs.
"It's quiet out here," she said. "When things get better, it's going to take off."

These guys are bullies whose business tactics have made life difficult for a lot of people. Just look at the types of stories written about them over the years and talk to people who have worked for them. They claim to be philanthropic but only when it serves their purposes. Do you really believe there was no quid pro quo for the naming rights to the theater that bears their name?

Perhaps it would be more appropriate to rename the "Sandler Center" in town center the "Wells & Fargo" Center? Or should that be the FEDERAL RESERVE center, since in reality Wells& Fargo is as broke as Sandler Inc, aside from those no interest bailouts and the cute new "model to fantasy" approach to banking regulations.
Good freaking luck repossessing. Perhaps you can rent it out to the government when they request an area they can put FEMA trailers on?

They are all jerks anyways. Just talking to them you can see they were feed with a golden spoon! They all think their mess doesn't stink. I'm glad they are getting hit on the head. I would love to see what exactly Tidewater Builder's Association is doing or should I say NOT DOING to help them. After all they are one of their members and they do pay much money to TBA to fund the salary of the CEO and the VPs in this company. You never get so big that you can't fall.

Big Builders built with Illegal Immigrant labor. The Tidewater Builders Assoc. loves to tote the intigrity issues all day long. But the members also love to bend the law. Happens every day. They also love to make big bucks on housing projects yet not spend a nickle on the surrounding infrustructure. Check out Indian River road for example. That area with million dollar homes and yet all the roads leading into it, a nightmare and dangerous. Do not feel sorry for the Sandlar Brothers, they have made more off of the City then the city will ever get back. What a joke.

lowwagecity: those office buildings in Town Center house some pretty high paying jobs, as far as I can tell. Couln't find a room at the beach this past weekend due to the national cheerleading tournament taking place at the Convention Center. Was out at the Princess Anne Park watching lacrosse at the beautiful athletic field complex, and was blown away by the huge indoor facility ( built with private money ) being constructed next to the Sportsplex, which was having an event, next to the Olympic training fields for the USA women's field hockey team. Does any of this happen without the Sportsplex? I guess something is happening that fits more with your thought process- they are redeveloping the Taco Bell at Town Center. Chimichaungas for all!! What an economic plan.

It is unfortunate what has happened to these builder brothers but it should be a big eye opener to all builders. Bigger is not better! These half million dollar homes builders are putting up on cracker jack lots is a joke. You can touch your neighbor reaching out your window. Look at that Home a rama a few years back in Chesapeaek....no new homes...originals still sitting...and city assesments -a joke.
There are enought homes "sitting" waiting for purchase. The traffic in Tidewater cannot handle another neightbohood or strip mall for that matter. Give it a rest or build within reason and not just to build! sThis has been going on

Put trailers and modular housing on those lots.
Put affordable double wide trailers or modular housing on all those lots. Mike Barrett's group has boosted the commercial tax base enough to support such a development. Just ask him. Rows and rows of townhouses like in Kempsville would also be an alternative.
Run Sessom’s choo choo into the center of the development. All the residents would have a direct link to major employment centers.

Council will remember that the roads in the Pungo area were not built for high traffic numbers. Current traffic going through the Princess Anne/Indian River intersection is ridiculous during the day. Turning on to Indian River can sometimes become a game of chicken. Several times, I have sat through 3 or more traffic light cycles trying to make the turn. And I can't recall the number of times that I've seen drivers go around one waiting to make a turn so that they could continue going straight. Increasing the density of homes in that area will only intensify the traffic and make the roads more dangerous due to congestion.
