A Virginia Beach woman made a costly mistake when she got a tattoo from a man operating illegally out of his East Ocean View home, city officials said.
The woman, whom officials declined to identify, said she was infected with acute hepatitis B when she received the tattoo last month, Deputy City Attorney Cynthia B. Hall said.
Police arrested James A. Murray, a licensed tattoo artist, at his 12th Bay Street home on May 15, Hall said. Murray was indicted on five charges, including operating an illegal tattoo parlor and for failing to have a tattoo parlor permit.
Murray was not indicted for infecting the Beach woman. Hall said spreading hepatitis B is not covered under a state statute dealing with infectious biological substances.
Hepatitis is an inflammation of the liver caused by a virus that can lead to jaundice, vomiting and, in rare instances, death, according to the Centers for Disease Control and Prevention.
Murray called the charges "bogus" when reached by phone Wednesday and said he did not infect anyone.
"I don't believe this woman exists," he said. He said he sterilized his needles and doesn't know how an infection could have been spread.
He said city officials have refused to provide him with the woman's name.
Hall heads the city's Convenience Store Task Force, composed of officials from police, fire, health, planning and the city attorney's offices that regulates stores, flea markets and illegal businesses. Tattoo parlors can't be operated out of private homes and must be licensed by the city.
The Norfolk Health Department told Hall's group that a Beach woman had been infected with hepatitis. Hall said the woman did not remember the address where she received the tattoo but gave her Murray's phone number.
Hall called Murray to set up an appointment. She and members of the task force all arrived for the appointment.
Murray's business was called Skin Flix Tattoos, she said. His business card indicated that in addition to doing tattoos in his home, he also made house calls and performed tattoos at parties, she said. Officials confiscated Murray's tattoo equipment, including hundreds of used needles and a pressure cooker Murray said he used to sterilize needles.
"He was not cooperative," Hall said. "We told him about the hepatitis health issue and all he said was, 'When can I have my tattoo equipment back?' "
Virginia Beach Health Department officials declined to release any information on the woman's condition, citing privacy concerns.
The CDC estimates that in 2007, about 43,000 people were infected nationwide with hepatitis B.
Larry Hill, a spokesman for the Virginia Department of Health, said instances of diseases being spread by illegal tattoo artists are not tracked by state officials.
"This is the first time I've heard of that happening," Hill said. "But you put your health at risk going outside the confines of people who are properly licensed. People doing it illegally aren't being monitored."

Sterilizing those needles won't help if the virus is in the ink bottle from pouring back the unused stuff.

Why do people always blame
Why do people always blame victims, and associate themselves with offenders? This man ILLEGALLY was giving people tattoos, used needles or not, still a crime. This woman, who under her own stupidity received one of these back alley tattoos. It's not her fault, but I do believe she should have made better decisions about something like that. Hepatitis B is more of a threat than HIV/AIDS. It also has a vaccine that protects one from getting this virus. If there was a vaccine for HIV/AIDS there would be a line a thousand miles long. Why not just get this vaccine, its free at the health dept so health care isn't an issue. Babies are given this at birth and is required for admission to school. I feel like this lady is an idiot for doing this, and also stupid for not getting vaccinated. I am a nurse, and there is no reason to not be vaccinated. Hep b is transmitted by blood and blood products and bodily fluids. She could have gotten this anywhere. I am sure if I saw a tattoo artist who was using an old needle, autoclave/ pressure cooker, or some sterilizing agent or not, DO NOT REUSE needles unless you are the only person using it. ie) insulin injections. What proof
What proof does the woman or the police have that she did not contract the illness elsewhere? Hepatitis is more easily contracted than HIV. He may be guilty of giving illegal tattoos, at least unlicensed, but he is innocent until proven guilty on the Hepatitis. Not a bleeding heart here-just realistic. Chances are he infected someone if he is reusing needles. There is a huge group of people in Nevada that were infected at a clinic/doctor's office because of reused needles. Be smart folks a used needle should never be reused.

Actually if you read the article it says that Hepatitus is not covered under the state code so there will not be any charges filed regarding the alleged spread of the disease thus nothing needs to be proved.

sterilized needles?!
This guy has a pressure cooker to sterilize needles?! That's terrifying. For one thing, needles should NEVER be used on more than one person. The rest of the equipment should be sterilized in an AUTOCLAVE - the same oven used by medical professionals to sterilize surgical equipment. If you ever go to get a tattoo and the artist does not open a NEW needle IN FRONT OF YOU, walk quickly to the nearest exit. I do feel bad for this woman, but under the circumstances she could be a lot worse off.

Wow... Who would have thought that a guy giving tatoos out of his house in East Ocean View(I'm from the area, so I'm allowed to make jokes)of all places, would not necessarily, be the most sanitary environment. I think this article alone proves my theory, that the world is overrun by complete idiots.

They sterilize the needles- but pour the unused ink back into the bottles- after it has been contaminated. You get what you pay for.....
