Attorney General Ken Cuccinelli defended his challenge to the federal health care overhaul in a court filing Monday, arguing that the case centers on whether Congress overstepped its powers.
Cuccinelli filed suit in March, moments after President Barack Obama signed into law a health care plan that supporters say will better regulate insurance companies and extend coverage to millions of uninsured Americans, including the elderly, the poor and those whose ailments limit their ability to secure coverage.
To critics, the law amounts to excessive government spending - it boasts an estimated price tag of $1 trillion in the coming years - that comes on the heels of an economic downturn and adds to the national debt. In Virginia, officials have said additional Medicaid costs associated with the health plan may approach $1.5 billion by 2022.
Cuccinelli says the law's requirement that people obtain coverage or face penalties runs counter to a new Virginia law exempting residents from that mandate. He also contends that Congress exceeded its authority to regulate interstate commerce by including that provision in the package.
Separately from Virginia, a number of other states led by Florida are jointly pursuing litigation with a similar goal: overturning the health care law.
Lawyers for the federal government last month asked the court to reject Cuccinelli's lawsuit.
Although the rift over health care has been characterized by some as a partisan clash, the attorney general's response says the lawsuit isn't a "policy battle" disguised as something else.
"This is a legal contest," the filing states. "At issue is whether a state law survives because the federal law that would displace it is beyond the power of Congress to enact, or whether the state law must yield to a valid federal enactment."
This is the type of legal dispute courts have handled since the "earliest days of the Republic," it adds.
The case could help to define the scope of Congress' power in the future, Cuccinelli said in a statement Monday.
"If the government prevails... then Congress will have been granted virtually unlimited power to order you to buy anything," the attorney general's statement reads. "That would amount to the end of federalism and our more than 220 years of constitutional government."
Federal attorneys in their May 24 motion to dismiss also characterized the dispute as one that may shape how state and federal rights co exist.
If Cuccinelli's case succeeds, they argued, "a state could import almost any political or policy dispute into federal court by enacting its side of the argument into state law," the motion states.
Judge Henry E. Hudson has scheduled oral argument on July 1 and Oct. 18.

Free health care! Free health care!
Who cares! It is not in my best interest to have the government tell me that I have to purchase a health care plan for me and my family! Uhbama telling me I HAVE to have a health care plan for me and my family is not my idea of the pursuit "Life, Liberty and the pursuit of Happiness." Now I know that comes from the Declaration of Independence and not the Constitution. I quote it purposefully as an example of the tyrannical behavior that King George III displayed in denying us our right to self determination. Does Uhbama think he's a king and the democrats his court? Not to mention if you or I fail to purchase health insurance we will be punished by the IRS and have any tax refund due back to us reduced or eliminated! Sure feel sorry for the poor people who already can't afford to buy a plan! There goes your tax return!

It is not in the governments or society's best interest if you and your family use the emergency room as a doctor’s office because you don't have insurance. If you chose not to have insurance and expect other taxpayers to pick up the tab for your treatment, then you should be happy that the government is forcing you to take responsibility for yourself and family.

...talking about...again. The government telling any PRIVATE tax paying citizen what they MUST purchase is an example of an oppressive not a progressive government. Please explain how that right now the tax payers are paying for these services. They aren't. The cost's are either being absorbed by the hospitals or passed off onto the paying customers.

I do have a policy for my family and I. It costs $226/week which two years ago cost $150/week. Do something to bring down the costs not "...spread the wealth around". Uhbama said that.

What in the world are griping for, it you already have insurance there is no penalty to you. Is your concern that others are not treated fairly because of the tax? I doubt it, your only concern seems to be slamming a president who you don't like.

There I spelled it out for you. I gripe because instead of thinking of ways for these insurance companies to operate less expensively (and pass the savings on to me and their other customers) they want to mandate health insurance for everyone. That is just going to make these companies even richer than they already are! I gripe because instead of finding and punishing non-paying illegal immigrants they are going to punish my fellow citizens of the UNITED STATES OF AMERICA if they don't get insurance! I gripe because this is setting us TRILLIONS of dollars more into debt! My disdain for Uhbama is beside the point!
