Afr'Am must pay officers $43,000, judge rules

Afr'Am Fest officials must pay dozens of city police officers and sheriff's deputies nearly $43,000 for security work they provided in the spring, a General District Court judge ruled Friday.

Judge Ray W. Dezern Jr. heard no testimony on the matter. Instead, he based his ruling on a state statute that requires defendants being sued for debts to swear under oath prior to a court hearing that they do not owe the debt.

That had not been done, Dezern said.

John McIntyre, an attorney for Afr'Am Fest, argued that Donna Smith, who heads the organization, would have sworn under oath that organizers did not owe the money, given a chance.

Smith said that at a hearing on the issue earlier this week, Judge Gwendolyn J. Jackson never gave her a chance to swear under oath. Instead, she ordered both sides to work out a compromise.

Smith said she still hopes that can be done. Three officers have been paid $1,540, she said.

Attorney Peter G. Decker III said he and Martin Thomas Jr., who represent the public safety employees, have sought payment for two months.

On Friday, Afr'Am officials offered to pay police and deputies 13 cents on the dollar, Decker said. Officers unanimously rejected the offer, he said.

Both attorneys also expressed doubts after the court ruling that they will collect the entire $43,000. Afr'Am officials have told them repeatedly they do not have the money, they said. "Our door remains open" to a compromise, Decker said.

"These officers all work two and three jobs to make ends meet," he said. "If they hadn't been at Afr'Am Fest, they would have been somewhere else working. They deserve to be paid."

Smith said she was appalled that Dezern "did not honor Judge Jackson's order that this be worked out. It was unfair."

Her organization, the Southeastern Virginia Arts Association, sponsors Afr'Am Fest as its annual fundraiser. The association provides scholarships and training for young artists in Hampton Roads.

Afr'Am, a celebration of African American music and arts, has had scheduling problems and poor attendance the last few years.

Smith said her organization has been maligned in media stories about the unpaid security costs.

To hold the festival at Town Point Park, which is owned by the city, Norfolk leaders forced Afr'Am officials to pay higher rates for security than other festival organizers pay, she said. Officers were to be paid $32 per hour at Afr'Am Fest compared with $25 per hour at Harborfest, she said.

"They milked the cow," Smith said of officers, who are owed from $3,000 for the lieutenant who oversaw security for the weekend to $320 for some officers who worked a 10-hour shift during the event, held May 21 to 23.

"Our plan is to pay any debts that we owe," she said. But she added: "I question whether their numbers are legitimate. If we're able to save $10,000 on safety and security, we could help a child go to college with a scholarship."

Decker said the issue isn't about scholarships. It's about Afr'Am officials honoring their commitments.

"They signed a legitimate contract that they have failed to honor," he said. "The bottom line is my clients sure would have liked to have known what she was planning to pay them before they agreed to provide security."

Saving Money??

One, you can't "save" money for the cost of something after you have already agreed to a purchase price and received the service. The deal is done, the bill is due.

Two, you question if there numbers are legitimate? Did you sign a piece of paper that said that you would pay them $32/hour. Did they provide x number hours of service....so $32 times x equals ___. Wow! A legitimate number.

Three, didn't the city give you a 11,000 grant to cover security cost just last month??? There's your ten grand "saved".

Ridiculous, this joke of a festival has to go.

The word "racist" or "racism" is thrown around so much nowadays it's disgusting. In this case, some people are labeling any critism of the festival sponsors as racist. It seems to me, however, that it is actually racist to believe members of different races need to be held to different standards. Here, people believe the predominently-black organizers of Af'ram should be held as accountable as anyone else. I would consider this progress since in days past some would have believed blacks incapable of being held to the same standard as everyone else. In this dispute, they are being treated equally.

My second point concerns what seems to be posters' second biggest gripe, i.e. how much the officers are due. The dollar amount is irrelevant. The festival organizers agreed to the amount and signed a contract. Period. A lot of people feel the officers aren't worth the amount they charged. So what? The organizers had the chance to challenge the amount; that opportunity evaporated as soon as they signed the contract.

ok lets get this straight: Donna Smith organizes Afr'man Fest = needing security = getting a security contract = reading and signing said contract = hiring said security = getting security for event = PAY THE FREAKING BILL!!!!!!!! I am so sick of people like Donna Smith being in positions that they are inebt in and when things go south, that is the first thing they want to do is play the race card! It has nothing to do with race. She organized and got what she wanted!! it is that simple! because the profit margins were not conducive to their happiness; it is not the individuals who worked the security problem! still a fact the security worked and are entitled to what they CONTRACTED with this organization; PAY THE BILL there is nothing to negotiate!!!!!!!!!!!!

The only fair solution

The only fair resolution I see to this problem is to pay the African-American and Hispanic cops in full, and don't pay the rest of the cops a dime. It's the only way to follow the Fourteenth Amendment to the Constitution, and treat everyone equally.

My solution would create a teachable moment, and the gods of political correctness would bless us.

Coming up with all these win-win solutions makes my brain hurt. Next problem, it's someone else's turn.

Deputies & Police Officers doing Security

Ok, they working part-time doing security. But, come on, $32/ hour??? I know security officers who are doing security at 7-11 stores & getting paid 1/3 of that. Now let's see, you got how many officers(Police & Deputy Sheriff's on their uniform on Afr'Am fest) vs. 1 security officer with no back up on Norfolk, Portsmouth, etc. 7-11. Which is more dangerous??? I'd like to know, in case something happens to Police Officer or Deputy while on part-time job on their uniform, who would pay their actual salary? Workmans comp? I hope they are insured through their part-time employer, not by the City of Norfolk.PS. Afr'Am organizers: There are several Private Security companies in the area, who can offer your armed security officer less than $32/hour. I wish mine job would pay $32/hour.

Should be paid using Stimulus Money

This debt should be paid using stimulus money. Obama can say that he provided $43K to Norfolk Officers and created a few more jobs.

Scholarships???

Implying that the officers should forgo payment because the money could be used for scholarships is pretty awful. It's selfishness thinly disguised as a request for charity. When you make an agreement to pay for services, you honor the agreement. You don't try to change the terms in your favor afterward. That's a breach of contract.

Besides, maybe those officers need the money to help put their own kids through school.

Maybe they think they can claim something racial and AG Holder will support them and try to make this a non isssue like he is trying to do in AZ. This is a Nation of Cowards, right? Nation of Cowards, or a Nation or Reverse Racism? I don't know, I have to ask AG Holder. He is so smart.

DIsturbing

I am disturbed by this situation. I have been involved with SEVA since its inception when it was formed by Glen Ray (ODU), Danny Scarbrough (dance instructor from CA), and Elliot Jones(NSU). It was organized to be family oriented. To promote the arts and talent in this area. The organizers of AFRAM knew the hourly rates of the police/sherrifs before signing the contract, and should honor their word. To complain that the event is loosing money, they should take a look at the artists being featured and realize some of those groups will attract people with a tug mentality. Prior to 2005, I volunteered for the event, but because SEVA choose money over quality, it has reached to this. SEVA PLEASE, pay up and re-evaluate the artists you are bringing in and the mentality sthose artist supporters. Return AFRAM back to its original intent.
