Virginia Attorney General Ken Cuccinelli is filing lawsuits against two companies based in Virginia Beach that offered foreclosure prevention services, alleging the companies violated consumer protection laws.
The suits, which will be filed in Virginia Beach Circuit Court, say the two companies illegally demanded money up front for their services and in some cases never performed. The suits ask the court to order the companies to return money to consumers and seek civil penalties.
Nationwide Loan Modification Bureau LLC and Real Estate Resolutions LLC both opened near the beginning of 2009 as the foreclosure problem in Hampton Roads began to mount. The companies touted insider information, attorney connections and an ability to persuade lenders to lower mortgage payments through loan modifications. The Virginian-Pilot raised questions about both companies' practices in an April 2009 article.
Federal regulators have called some loan-modification companies "bottom feeders" that take advantage of financially vulnerable homeowners. They say people at risk of losing their homes should seek help for free from government-approved nonprofit counselors.
The lawsuits allege the Virginia Beach companies would charge as much as $1,200 up front, which violates the Virginia Consumer Protection Act. The act prohibits loan-modification companies from charging money before performing the services.
The suit against Nationwide Loan Modification also accuses that company of doing little or nothing to help customers prevent or avoid foreclosure.
"During these difficult times, the last thing people need is to be kicked when they are down," Cuccinelli said in a statement. "The advance fees collected should be refunded where services have not been completely performed. I am pleased that my office has been able to address the alleged wrongdoing and I hope these cases will send a strong message that we intend to enforce our foreclosure rescue law."
Danielle McDole, a mortgage broker who founded Real Estate Resolutions, said Tuesday she was not aware of the lawsuit and declined to comment.
Before she opened Real Estate Resolutions, McDole owned Everyday Lending Mortgage Corp., a defunct subprime mortgage business that was sued for mortgage fraud. In an interview with The Virginian-Pilot last year, McDole said that suit came about because of the actions of a single employee and that as CEO of Everyday Lending she was unaware of the employee's actions.
The mortgage broker has lost three homes herself through foreclosure, according to a 2008 bankruptcy filing. In addition, she offered to give up three other properties as she liquidated her assets in the Chapter 7 bankruptcy.
Jason T. Gillentine, the owner of Nationwide Loan Modification, said he shut down his business several months ago after the attorney general's office began its investigation. He said he's been working with the office to comply voluntarily with the complaint.
"They really wanted to get my attention," he said.

I just love when I hear
I just love when I hear people say, "It's not my job man".
I already know what you cannot do... The question is "WHAT CAN YOU DO?" If the answer is nothing... then you’re useless. Obviously, the office of the AG is worthless as a crime fighter. Well then by that reasoning, the voters have selected the right man to fill that position.
Useless is as useless does… and that's nothing. The real rub, I'm the guy paying the tax bills to have this useless position and this worthless person do nothing.
Next time Ken... Instead of trying to get Virtus to adjust her bra strap, how about getting the street thugs to pull up their pants. I can see the headlines now... KC and his sunshine band of worthless & useless lawyers try to implement dress code among street gangs and thugs.
So the bottom line is...
Virginia has an AG that is soft on crime by either choice or design. Either way, Virginia looses because there is a loser in the office.
I am so ashamed that I voted for him. Ken has shown no leadership ability or credibility in the areas of law enforcement or proposed legislative crime agenda.
How can you say...
The AG is soft on crime when it is not his job to prosecute most criminals? And that's not by his choice, it's how Virginia defines the AG's job. If he tried to prosecute most crimes, his efforts would be summarily rejected. By your definition, you are probably soft on crime as well (unless you are in law enforcement). And BTW, I voted for Ken and I am proud to still have one of his bumper stickers on my car (and will keep it there for the foreseeable future).

The AG’s job is to effectively lead the fight on crime and keeps out streets safe for Virginia’s citizens. The AG needs to support everyone in law enforcement - from police chiefs and sheriffs to the cops who walk the beat.
As of right now…. Ken has done none of those things; he has no leadership ability and demonstrates no credibility with law enforcement. The low level staffers of his office can do his job better.
All the while, crime rates in Virginia run amok while KC and his Sunshine Band plays on. Ken… find some real blue collar crime thugs to take down.

On the criminal level, the office has fairly limited direct involvement and a bit broader indirect involvement. Maybe that is why you do not believe he is doing his job -- you think it's something different than it is.

Oh yeah, that is a FEDERAL housing loan; THE ONE banking that is not, repeat, not REGULATED w/the new financial Laws that were just signed into order less then a hour ago! Funny, the regulations w/freddie/fannie where created by BHO in the early 2000's when he was a Lawyer....They(Government-BOTH SIDES) set eveyone up for easy funding...ran the bill up, sucked all the investments out of it.....as stock holders...& NOTE: these docs that were signed today... to STOP THIS type of business? excluded....from this new bill of Anti-trust/RESPA issues? the Freddie/fannie... Curious how many of your buyers used subprime lenders? Did you earn commissions directly or indirectly via subprime, or Alt-A mortgages? Certainly you had incremental sales as a result of a mortgage industry out of control. While it's not fair to generalize, my experience (and I've been in the business for 20 years) is that many realtors will do anything to receive a commission, including pushing clients to mortgages that are inappropriate and harmful to them. Ever do that? There are a lot of villains.....mortgage brokers, realtors, attorneys, and homebuyers who were either uninformed or greedy for lifestyles they could not afford. To rant about Freddie and Fannie is to ignore the complexity of the problems, and pervasive bad conduct in the mortgage industry and related industries, as well as by consumers.

You embarrassed the state, you embarrassed the public, you embarrassed the Governor. When McDonnell gave back the 5 large ones to help the Vets, you pocketed the money (55k) and never looked back. Finally, someone in your office is actually doing their civic duty and going after the bad guys. Too bad we do not know who it is, so we could get a real AG. One that works for the citizens rather than a creepy homophobic, far right extremist with sexual hangups and downright weird behavior. Funny how a AG gets mixed up in fraud especially money destined to the vets. Maybe someone on your staff will actually go after you, you BUM!

Plenty of bile... but no facts... We get it folks... obviously, there are 20 or so ultra left liberals that continuously post on here on any article that involves the AG or the Govenor, and you don't like them.. ok we get it. However, fortunately, there are FAR more that support them and voted them into office...Thank God! They continue to perform the will of the people who voted them in...Thank God!
