A day after the city's top prosecutor declared he will press cases against the poker halls that have been springing up here, some of the places were opening as usual - with police working security.
Commonwealth's Attorney Earle C. Mobley went on the record Thursday saying that he will prosecute operators of those and other forms of gambling not sanctioned by the state. Mobley said he will write to owners and operators, putting them on notice of his intentions.
Mobley said he met with the police chief already.
Detective John Doyle, a spokesman for the police department, said Chief Ed Hargis will re-evaluate whether officers can continue those off-duty jobs after Mobley issues the letter.
The halls were opening too, a few owners said.
"We're waiting for the letter," said Mark Tibbitt, manager of the Victory Poker Lounge, on Friday afternoon.
Tibbitt said the business was to open Friday night, and police officers were to work security.
Justin Daniels, manager of The Poker Palace, said that hall will be open every day until they get notice from the commonwealth's attorney.
"We have no problem shutting down," he said.
But Daniels said they wanted to see it in writing. For the time being, police officers were working there too, he said.
Jim Swan, president of Portsmouth's Fraternal Order of Police, said the phone was ringing off the hook with officers concerned about whether they should work the jobs.
He said he contacted the chief's office and an assistant told him that it was business as usual for now.
Doyle said that the police chief has said he will not re-evaluate the issue of officers working at the poker salons until he gets a letter "stating Earle Mobley's position and once the places and owners have been notified."
Mobley has never said the games were legal, but he has long been vocal in his belief the state law is flawed in that it makes an exception for "games of skill." Some argue that includes poker. However, on Thursday, Mobley said he would prosecute people for running poker halls.
A draft letter exists, but it had not gone out as of Friday, said Bill Prince, a spokesman for Mobley's office. "It doesn't matter," he said.
The letter was a courtesy notice to owners and operators of poker halls, Prince said.
Police, he said, shouldn't hinge their actions on the letter.
Prince said Mobley had no knowledge of police officers "working off-duty at these places, but they should immediately stop working."

Mobley is clueless
I agree with other comments, Keep the gaming here, keep the money in the city and let the city partake in revenues instead of atlantic city or Dover. Mobley must not be getting a cut or something so he is enfrocing the law. Cmon poker room owners, line his pockets, the threats go away. Call it enterprise!! Good Luck in keeping them open, Portsmouth needs the money!!
Its time to legalize gambling
The buses are filled leaving the Tidewater Area and heading to Dover, Midway,and Atlantic City sending tax money that could be kept right here in our own state to other localities. The downtown area of Portsmouth and Norfolk would revitalize with casinos and think of the number of jobs it would create. I wasn't aware of the poker halls in Portsmouth until this article came out, but tonight I am seeking them out. I will use my skill to bluff when necessary and maybe even get that 5 of diamonds to complete my straight flush.

The whole thing is a darn shame. I don't get it. Now what's everyone going to do? I think the powers at be are shooting themselves in the foot.
Commonwealth's attorneys are
Commonwealth's attorneys are elected to enforce the laws of the Commonwealth. If you don't like the laws about gambling, contact your state legislator. THat's like demanding a cop get fired because you ran a red light and got a ticket.

Even though I'm not
Even though I'm not convinced that it is a game of skill, I see no reason for them to close the poker rooms down. I do have a problem with Mr. Mobley telling the officers they can't work there.

It's time for the voters to recall this Mobley guy, or at least not re-elect him next time he's running for office. Fight for freedom! Don't let the oppressive state government infringe on your rights.
Didn't know off duty officers were working??
Huh??? Mr.Mobley had no idea that off duty officers were working security? Did he not talk with the Chief about the Poker establishments before yesterday? Was he not aware that one of the places involved the FOP to raise money for it's charities? Hum... just makes you think. What else is he "not aware" of? I can't help asking, Why, when people contacted his office about opening Texas Hold Em' establishments, did he not just say NO !? He could of saved people a lot of money (including the city)by just telling them No when they called & asked. That part of the story is very "vague".
