Shortly before a shooting occurred near a Town Center nightclub, Philadelphia Eagles quarterback Michael Vick got birthday cake shoved in his face.
"Obviously, that's an aggravating factor for any human being," Commonwealth's Attorney Harvey Bryant said Wednesday. "And he correctly went and got into his vehicle."
But there's a conflict among witnesses as to who smeared the cake in Vick's face, Bryant said.
Vick didn't engage in any aggressive conduct in response, the prosecutor said.
The Newport News native had just come out of a party celebrating his 30th birthday at Guadalajara on June 25 when the cake-smearing took place.
Surveillance tapes show Vick walked out the front door at 2 a.m. and signed autographs for fans for several minutes outside the restaurant, Allen Fabijan, a spokesman for Guadalajara, has said.
Outside the restaurant, there was some scuffling and the quarterback was smeared in the face with cake, Bryant said.
The commonwealth's attorney declined to say who any witnesses said wielded the cake.
Vick got into his Mercedes, Bryant said, which was parked in front of the restaurant and "after some period of time, he came back out of the vehicle as if he intended to confront someone in the crowd."
Vick's friends surrounded him, got him back into the vehicle, and drove off, Bryant said, adding that Vick did not engage in any aggressive conduct.
"All of this is before any shooting occurs," Bryant said.
The shooting took place at about 2:10 a.m. around the corner from the restaurant.
Police haven't named the person who was shot, but some who attended the party said it was Quanis Phillips, one of Vick's co-defendants in a federal dogfighting case. Police have a suspect in the shooting, they've said, but have placed no charges because of a lack of cooperation from the victim or witnesses.
Vick and Phillips were convicted in 2007 and 2008 of dogfighting charges.
They are on state and federal probation, which prevents them from associating with felons without getting permission from federal law enforcement officers.
Bryant said Vick has met with Beach detectives and that in their opinion, he was cooperative and truthful about the Town Center shooting.

If Vick did the right thing.....
I hope the DA does the right thing and persecutes the person who smeared cake in Vicks face. The way police treat the public now is that anyone can be aggressive and get away with it, but the victim better not do anything to defend themselves.
looking at the flier...
...I went back and looked at the photo of the flier for this event...how can someone say that Q. Phillips was not invited when it appears that tickets were being sold for this event? Did the entertainment company sponsoring this event sell a ticket to Phillips or to someone who gave it to him?
Cake in face
Phillips wasn't invited and having an open invitation to a birthday party didn't mention that felons were welcome to attend. Phillips and Vick are not friends. Phillips got a reduced sentence for testifying against Vick and by showing up he broke his parole and will possibly go back to jail. I'm sure that has something do to with him staying silent about the shooting. He has no problem pointing the finger at somebody. He's being quite because he's aware of the problems he brought on himself.
East End NN street justice!
After talking to a couple of laborers that live in the east end and were there, I understand the whole scenario now. Phillips approached Vick as he was leaving, exchanged words with Vick, then smeared cake in his face. His bodyguards/thugs got him in his car and tried to calm him down... Phillips and his thugs were joking about it in front of the car....Vick jumped out of his car and his bodygaurds/thugs qiuckly got him back in the car where they sped off this time. His other bodyguards/thugs drove up to Phillips 4 minutes later, who was around the corner walking to his vehicle (you know he cant park up front like Mike). They "popped a cap in his behind".....what? ,you think drive bys only happen in L.A. And aint nobody saying nothing, cause thats East End Street Justice! Add money to a thug and what do you have....A rich thug!

Phillips has no problem pointing the finger at someone to save his own behind. Don't think it's a respect to crime that he's keeping quiet. It's because he violated the rules of his parole by showing up at a party knowing a felon was there. Phillips "AIN'T" no stand up guy. BTW..what's with the bodyguards/thugs describing people hired to keep Vick safe and out of trouble. Vick would have professional "bodyguards" who don't have criminal records. He would not have anybody surrounding him that was a felon. If you're gonna post you know something...try knowing what you're posting..

Apparently, you have no idea what you are talking about....but that figures. Not all thugs and gang members have felonies. Have you ever seen Vick in public, I have , several times, before and after his dog fighting arrest. I have ties in Surry and own property within spitting distance of his old dog fighting residence. So I have seen his bodygaurds/thugs and I can assure you, none came from MultiGuard...haha
All about Ignorance
The entire incident surrounding Michael Vick's B-day celebration and its aftermath is/and was rooted in Ignorance. The fact that he decided to have a public party with both haters and so-called friends gathered together and not expect something negative to happen was ignorant. The fact that someone decided to shoot another person after the party was ignorant. The fact that many people who have commented think that Michael Vick should be prosecuted for a shooting where the victim does not wish to testify and witnesses have remained silent is ignorant. The fact that some people think that Mr. Bryant has failed in his duty as the Chief prosecutor for VABeach for not prosecuting a case where there is no evidence to support a charge against Michael Vick is ignorant. The fact that some claim that all the news coverage about this incident is about race is rooted in Ignorance. This type of incident only highlights how ignorant the public is about our criminal justice system and how ignorant people are in general about one another.

face, what an astonishing turn of events. After a small stint in prison, can someone tell me if Vick was the bride or the groom.
