McDonnell: Give State Police immigration authority

RICHMOND

Some members of the Virginia State Police could enforce immigration laws and play a role in the deportation of illegal aliens if federal officials grant a request for that authority from Gov. Bob McDonnell.

McDonnell announced Thursday that he has formally asked the Department of Homeland Security for a 287(g) agreement, named for a section of federal law that permits some immigration powers to be given to state and local police departments.

Under that program, certain officers from approved law enforcement agencies receive four weeks of federal instruction on identifying illegal immigrants, cultural sensitivity, avoiding racial profiling, immigration laws and using a federal immigration database. They can then use the database to identify and report illegal immigrants for possible deportation.

It's unclear when federal officials will reach a decision and what expanded police powers they might grant.

In his Aug. 10 request, the governor referred to "addressing those aliens who are engaged in major drug offenses or violent offenses such as murder, manslaughter, rape, robbery, and kidnapping, as well as DUI offenses."

When asked for more specifics, a McDonnell aide said the range of enforcement powers will depend on the terms of any agreement between state and federal officials.

A spokesman for Immigration and Customs Enforcement declined to discuss McDonnell's application.

In Virginia, eight local law enforcement agencies and one regional jail in Northern Virginia and the Shenandoah Valley have entered into agreements with federal officials to perform immigration duties, according to ICE.

Those partnerships have resulted in the removal of more than 1,950 illegal immigrants since 2007, ICE spokesman Richard Rocha said, adding that, nationwide, such agreements have led to the removal of nearly 120,000 people.

McDonnell's letter, which comes about two weeks after Virginia Attorney General Ken Cuccinelli announced that Virginia police have the authority to check the immigration status of people they stop or arrest, has the potential to further ignite a local immigration debate that has ebbed and flowed over the years.

The move drew praise Thursday from John Kwapisz of the Virginia Council for Immigration Reform as a "long overdue" effort to enhance public safety.

Claire Guthrie Gastanaga, a lobbyist who has worked on immigration issues, disagreed, calling it an unnecessary step that could further strain the limited resources of State Police.

If 287(g) authority is granted, she said, she hopes the agreement will include language protecting crime victims and witnesses from routine inquiries about their immigration status.

Under current state law, officials must check immigration status when people are taken into custody. Virginia State Police troopers are permitted to inquire about immigration status if it's relevant to an investigation but aren't required to.

A national revival of the debate occurred recently when Arizona passed a broad immigration law that, among other provisions, could allow police to inquire about an individual's status during an unrelated stop if an officer has a reasonable suspicion that the person is illegally in the country.

Obtaining federal immigration authority for State Police is something McDonnell has supported since he was attorney general. But his predecessor as governor, Democrat Timothy M. Kaine, was lukewarm about the idea.

I hope this is a typo

I am in support of State Troopers receiving EMIGRATION authority. Then when they are gone, I won't be persecuted by unjust "maximum speed" laws anymore!

Racism is a core tenant of the Republican Party

The Republican Party for decades has tried to find black or brown people to scapegoat in order to scare white suburban voters into voting Republican. From Willie Horton to the Rev Wright to mexican immigrants the Republican Party playbook always stays the same. Nothing has changed.

That's a pretty broad condemnation. There is not a racist bone in my body, and yet, I am labelled one if I support enforcement of existing laws? I'm not scared of immigrants - legal or not - of any color. If the government wants to grant amnesty and make them legal with a(nother) wave of the magic wand, so be it. But until then, I support allowing the police to enforce the law and do so whether or not someone falsely accuses me of being a racist for doing so.

Racism Core Tenant of Rep Party

I am a recovering Democrat. That does not make me a Republican and the fact that my IQ is above 80 makes me unqualified for Tea Party membership. Both Dems and Reps have used "racism" for years to make their platforms attractive to certain blocks of voters. But what I am seeing now is really crazy. Dems are pandering to a certain block of voters (Hispanics/Latinos who have an interest in getting citizenship for themselves and their families) by urging that our immigration laws be ignored. This has completely turned me off of the Democratic party-I want them to enforce our laws, not change them so that they have a new voter pool from which to draw. I am also turned off by Reps for many reasons including the "none-of-their-business" abortion issue, taxbreaks for the wealthy, and John Baynor's face. I love immigration. Legal, respectful immigration. Paperwork immigrants. Immigrants who study our laws, our history and ENGLISH. Not line jumpers.

A loving Nun in Richmond would not have been killed 2 weeks ago, by an illegal immigrant on his 3rd DUI..who should have been deported years ago! Slow paperwork....great excuse!

13 innocent people in the Washington area would not have been killed by an illegal Jamaican who hid in a trunk and had been told to leave by a judge! A large portion of the East coast was terrorized by these 2 killers for weeks and cost millions to apprehend!

It's going to take a team effort (50 states and the territories) to tackle illegal immigration and terrorism. We are the 'United' States.

D.C. should have been corresponding each state to aid ICE and DHS in these areas

McD is wasting time and tax dollars. While I agree we should send illegals packing, McD's plan is flawed.

Why can't our govnor work on creating jobs which is a bigger priority at this time?
