Owners of two Waterside nightclubs shut down by the city last year said they might be willing to drop lawsuits against Norfolk if they can reopen a business inside the downtown facility.
"My clients are in the business of running establishments, not filing lawsuits," said Virginia Beach attorney Samuel W. Meekins Jr. "The win-win here would be to give them a viable Waterside operation."
Meekins said his clients would like to open a restaurant such as BlackFinn, an upscale chain his clients once operated at Waterside.
"Barring that, we want damages for being wrongfully ousted," he said.
However, Meekins said Have a Nice Day Cafe and Bar Norfolk have dropped lawsuits filed last year demanding compensation of $16 million.
The lawsuits could be re-filed, but City Attorney Bernard A. Pishko said he does not expect that to happen. "Generally, parties do not non-suit when they have a high evaluation of their prospects," he said.
The nightclubs' owners still believe that the city illegally shut them down in August 2009, Meekins said. A lawsuit contesting Norfolk's actions is scheduled for trial in February.
Deputy City Attorney Adam Melita said city leaders are in the process of deciding Waterside's future.
"As much as we would like to answer that question for them, we can't," Melita said. "Not only is the decision about whether to put a restaurant in there above our pay grade, so is the decision about whether Waterside is going to be there."
Bar Norfolk and Have a Nice Day Cafe were closed after city leaders expressed concerns last year that both clubs were repeatedly violating state liquor laws.
In Norfolk, in addition to a Virginia Alcohol Control Beverage license, any restaurant serving alcohol or providing entertainment must also have a license approved by the City Council called a special exception.
No other city in South Hampton Roads licenses restaurants in the strict fashion that Norfolk does.
When the council voted not to approve special exceptions for both nightclubs on Aug. 18, 2009, owners said they felt ambushed.
Within days, both restaurants opened their doors and served alcohol in defiance of the council's vote, saying they didn't need a special exception. Their doors were then padlocked by Waterside Associates, the private group that technically owns Waterside.
Waterside Associates, which operates Waterside, is closely supervised by the city.
A Circuit Court judge later ruled that the clubs served alcohol without a license and the city and Waterside Associates acted lawfully in shutting them down.
The judge also ordered the two sides into mediation. Melita said discussions continue with Meekins and law partner John J. Faber Jr., although without a mediator.
Meekins contends his clients had the right to operate when their clubs were shut down because they were grandfathered by permits previously granted by the council.
"The real issue for the court is did we have the right to operate," he said. "We believe we did."
Melita said that the city has the right to rescind special exceptions in the state code. "Essentially it's a permit, and if you don't comply with the terms, you lose it."
Since the bars have left, few businesses remain in Waterside, and several community groups now say they want the city to raze the facility.
The council is expected to determine Waterside's fate in December.

Let us open a "viable" operation or we will sue for damages?
Seems like a desperation move to me.
Let's face it...
Let's face it... these places were attracting The "WRONG" clientele for what was originally envisioned for Waterside and what had originally made it so successful. It went from multiple, small, charming, ethnic restaurants & shops to 2 domineering hip-hop nightclubs. (HOW did that happen?)
It was no longer attracting the yuppies & upper-middle people because they had no attractions of interest & they became AFRAID to go there!

We are not attracting those people becasue they do not exist in large quantities in our area. We are not Chicago, New York, Boston or Seattle with dynamic industries, financial sector jobs or world class institutes of higher education. Our yuppies and double income no kids drink a lot and have lots of tatoos and vote for cheerleaders (palin) and witches (o'donnel). I am not sure how we can build an economy that relys on people to spend all the time, we also need to create production capacity to produce things that people in other countries want. I am advocating the mosque and islamic university to attract diversity to our area which will perhaps give us some new ideas, new leadership and new industries. Look at Hampton Roads progress in the past 20 years, then look at Doha and Dubai's progress in the same time frame. We need to bring people in who can help us think bigger and more long term, then actually be able to do the work. I would prefer a change than the same guard who just wants to build condo's and restaurants for an easy buck.

We are going to witness a great transformation where the great satan will buckle under the weight of his own sword. As the US continues to bloat the military budget while its tax receipts start to fall from a statnating GDP and continued tax breaks for rich people, the country will buckle from within and it won't be able to hold such a heavy sword above its head and it will fall, pulling the holder of the sword down with it. new powers will emerge. we should get ahead of this trend by stopping drinking and showing our new leaders the good sides of our society, openess and hospitality.

I am happy to see the bars go. Alchol is the root of our problems and having a place that creates public drunkeness is unwanted. What we need by waterside is a beautiful mosque that will show people the truth when you live a clean life. We need to clean up our town!

I think the city killed
I think the city killed those two establishments to help hurt waterside's cash income so they could push to demolish it and give the property to a friendly developer.
That one site said the two establishments in Waterside and the others outside of waterside were shut down to eliminate competition for the new venue on Plume street which is partially backed by a city of Norfolk employee or two. That is another interesting theory.

so let me get this right, the two clubs shut down. for now real reason yet clubs like Atlantis break city codes and laws left and right and the abc and vabeach board do nuthing to them.... yet other clubs try to do the same thing to copy cat. and there stopped and get shutdown right away.... must be nice to know who to pay off. or be part of the boys club.

A Gentleman's Club in VB on privately owned property and a Restaurant in Norfolk on City owned property are 2 completely different establishments in 2 different jurisdictions.
There's no comparison there.
