Philip Bay planned the day of attack on Landstown High School in meticulous detail, a prosecutor said.
It would start at 6 a.m. on April 20, 2009, with a call to a classmate who had conspired to help him kill at least 30 people, Bay wrote in a note that Commonwealth's Attorney Harvey Bryant read in Circuit Court on Monday as Bay's trial started. The shooting would start at 11:15 a.m., he wrote.
It would end when Bay took his own life at noon after detonating homemade bombs, he wrote, shooting students with sawed-off shotguns and causing the propane tank in the science lab to explode. In the hours in between, Bay wrote, he would put the final touches on his plot: load weapons and sharpen blades at 8:30 a.m. and steal a car two hours later.
One of his lawyers, defense attorney Eric Korslund, told jurors he will not dispute that Bay planned to carry out the attack. Prosecutors will "prove this beyond a reasonable doubt," Korslund said as he waved a small stack of papers in the air. "I'm waving the white flag."
But Bay suffered from mental illness exacerbated by improper medication and was insane at the time of the crimes, Korslund said. In addition to bipolar disorder, he said, Bay suffers from post-traumatic stress disorder brought on by his father's corporal punishment and emotional abuse.
Korslund snapped his fingers. Bay was a "young man whose moods would change like that," he said. "It's easy to hate Philip Bay, but we're all here to give him a fair trial."
Bay, a former Landstown student accused of engineering a Columbine-style attack on his school, pleaded not guilty Monday. He faces 11 counts of manufacturing or possessing an explosive device with intent to cause harm, possessing a weapon of terrorism with intent to terrorize, two counts of possessing a sawed-off shotgun, soliciting or recruiting for an act of terrorism, and committing, conspiring or aiding in the commission of an act of terrorism.
The alleged plot was thwarted just weeks before it was set to take place when police arrested Bay and two co-defendants after receiving a tip. The co-defendants have pleaded guilty in juvenile court to possessing or using a sawed-off shotgun and possessing weapons of terrorism. They have not yet been sentenced and are scheduled to testify for the prosecution.
Jurors listened to opening statements - which were interrupted when the power went out for about half an hour Monday afternoon - and heard testimony from a fire investigator who said he discovered a host of bomb-making materials in Bay's bedroom.
The trial is set to last through the end of the week.
Bryant called Bay "the mastermind, the bomb-maker and the recruiter for this suicide mission," and said Landstown notebooks, calendars and photos will help prove Bay, now 19, set out to kill at least 30 people.
He began "the countdown to terror" on April 16, 2007, the day of the Virginia Tech massacre, Bryant told jurors. Bay had wanted to be the one to cause that kind of destruction, the prosecutor said, and he was prepared to kill his mother in order to steal a car.
"I will be armed to the teeth with guns, knives and everything else. I will kill, kill, kill. You have my word," Bryant quoted from a journal he said belonged to Bay.
Bay listened from the defense table with little expression, alternately removing his glasses and replacing them. His appearance was changed markedly from the time of his arrest, when the then-17-year-old wore chin-length hair, casual clothes and a thin mustache. A clean-shaven Bay on Monday donned a dress shirt, dress pants and a sweater vest, and his much-shorter hair was parted and slicked to the sides.
He politely answered a judge's questions with, "Yes, sir."
Korslund said multiple doctors will testify Bay was legally insane when he planned the attack - he did not understand right from wrong. "He suffered from a mental disease."

he should stay in priosn
because that means this where you come to. why would you want to do the same thing and you saw many people suffer from Virginia Tech?? Everyone knows right from wrong; and everyone can claim they dont due to a disorder that they may have. He knew what he was doing was wrong.
As for his mother, I am pretty sure she never did anything to punish him or anything like that. she seemed like someone you could walk all over saying she and Phillip came into my work and a day later his friends applied there. And to his friends who got off with going to CEL, I dont think your age should of matter if u get charged as adult. It's like stealing if your with the person you get punish as much as they do. You threaten on bombing a brand new school, killing people with two slugs to the head and by far killing innocent students & teachers. I dont understand how our court works, but you and phillip should never walk free. it's what you deserve!

I live directly across the
I live directly across the street from his house. He told us his mother gave him the weapons as gifts. His mother NEVER disciplined him. Although he has big issues, he was sane when he did this. To calculate and then to want to hurry up and do the crime before the police found out proves that he knew he was doing wrong. there are millions of people who have mental issues..they don't usually commit crimes of this nature. He is extremely smart and could have gone to any college on scholarship. that is how smart he is so he was sane when this took place. the problem here is the mother who let him get away with things and yes he's been in lots of trouble before. her words to him...deny deny deny!
Absolutley Amazing!!
That he was insane, according to the doctors, at the time he planned all this, and yet is now sane enough to stand trial, understand right from wrong and make informed decisions! I hope his lawyer can sleep at night, I couldn't!
The Landstown HS student
He planned to kill but was caught in time, that shows that something is working right. Since Columbine, people are more on the lookout and aware that some young men are drawn to terrorism, whatever the motivation. And we cannot blame his parents, most parents of these killers are decent folks. If there is a young man in your life be a positive influence on them if you are able. Yes they are difficult to talk to and as we get older we are repulsed by their music and clothes and habits, but they are just kids and it is a problem that affects all of us. Maybe we have spoiled our teens, but they definitely want love and a purpose and guidance and typically most ment down through the ages have found it in the military.
Weird
Ok I admit I have a 14 year old and not a 17 year old, but I still cant understand how the heck this kid had all these sawed off shot guns and bomb materials in his mothers house. I would llllluuuuuvvv to see an interview with her. I have family that go to Landstown and could of died if he did what he planned on doing. I pray that he gets life. Can you imagine if he had gone through with it? he planned to blow up part of the building, shoot at least 30 children. This was not an idle threat. I pray he goes to jail for life, for the mere fact of the lives he planned on taking. He just wanted to make a name for himself. Thats it. He just wanted to be famous. Disgusting.
Bipolar is real
Its obvious that many of the commenters have no experience with the bipolar disorder as I was the same way until I married one with it. My experience was a wonderful one for the first year while she was on her medication but quickly got out of control when she stopped taking her medication. It went from being the happiest year ever to a living nightmare. Bipolar means having extremely highs and extremely lows (manic depressive). Its important that we recognize certain signs of this disorder and intervene appropriately. It starts with the parents being involved to prevent cases like this and asking for support from teachers and other family members. This young man may only need proper evaluation, medication, and supervision. So you say he had dark thoughts of killing people. Frankly, it is not surprising to me that a bipolar person has these thoughts when they are not medicated. Thankfully, someone tipped off the authorities, and they responded, which is usually the case.
I personally know someone
I personally know someone who has this disorder amongst other mental issues but he did know what he was doing, he was sane and I know this kid and live across the street from him. He was not raised right and his mother let him get away with things you can't possibly imagine. She herself was in denial.
yes, bipolar is real, but differs from person to person
i appreciate that you were/are married to someone who is bipolar.so you know,we haven't all "had dark thoughts of killing people" "when they are not medicated".i went for 7 years w/o meds & all w/o any dark thoughts of killing/injuring anyone or myself.when things became too much,i went back on meds for a brief time until my husband & i agreed that i was stable again.i agree that the signs & symptoms need to be recognized & that there needs to be communication and support.i will say,however,that not all bipolar people are alike.we are not all bad.i volunteer w/in my community & i'm very active with my children & all of their extracurricular activities. also,both of my kids are always on honor roll-1 of them is bipolar & she volunteers,too.
