Recent police raids of Internet "sweepstakes" cafes appeared to snuff out the businesses in the city. Officers armed with search warrants that alleged illegal gambling raided 11 sweepstakes businesses Sept. 22 and seized hundreds of computers.
But Wednesday, one sweepstakes cafe was open in the Chimney Hill Shopping Center on Holland Road. It advertised that it donates money to the Virginia Sportsmen's Foundation Inc., a charity run by Sheriff Ken Stolle.
Police and Commonwealth's Attorney Harvey Bryant aren't sure when it opened.
Manager Janice Reilly said at the business Wednesday that it closed voluntarily after the raids and reopened about two weeks ago.
"We never were shut down or raided or charged with anything," she said.
Bryant said he didn't know it existed until two weeks ago when someone at a bingo hall in the shopping center e-mailed him.
He said Stolle's foundation has "nothing to do with why that place has not been searched and their machines seized."
"I can assure you that would carry no weight with my office and should not, and I'm sure does not have any weight with the police department," he said.
A police spokesman said he wasn't sure why the department didn't include the Chimney Hill cafe in the raid.
"I think our guys had their hands full initially," spokesman Adam Bernstein said. "If one pops open and we become aware of it, we'll send folks in and take appropriate action."
Potential charges from the raids in September would be against cafe owners and operators, police have said. Stolle is neither.
Ownership records in the commissioner of revenue's office, which tracks business licenses, weren't immediately available Thursday.
Sweepstakes games resemble slot machines. Players buy credits to play them and try to earn points. People who win more points than they started with can make money.
Their legality is a gra y area of Virginia law. Operators have argued that they are legal because they are like sweepstakes offered by fast-food restaurants and grocery stores.
Virginia Beach has gone after them, while Chesapeake has not.
Virginia Attorney General Ken Cuccinelli issued an advisory opinion this year saying they are legal.
North Carolina banned them effective Wednesday.
The Chimney Hill strip mall storefront lacks a banner sign naming the business, but advertising on the front window calls it the "Virginia Sportsmen's Foundation Sweepstakes Redemption Center."
A framed letter signed by Stolle hangs on the wall by the counter. It says that in his opinion the technology used for the games is legal under Virginia law.
On Wednesday afternoon, about 15 people were playing computer sweepstakes games inside the smoky cafe. Players helped themselves to free coffee. Unused computer screens displayed bullet points touting Stolle's foundation's mission.
On Thursday afternoon, the day after a Pilot reporter visited the business and asked questions about it, it was closed. A sign outside said its hours were "24/7."
Stolle, who was a longtime state senator before being elected sheriff last year, is chairman of the Virginia Sportsmen's Foundation. The group's mission is to "promote Virginia's outdoor traditions, including hunting, fishing and conservation," according to its website.
The foundation, starting this year, will provide hunting opportunities to "disabled military veterans wounded while serving our country," the website says.
Reilly said the sweepstakes business has given Stolle's foundation money to build a wheelchair lift to a tree stand used for hunting.
Will Payne, Stolle's former legislative aide, is listed on the website as the executive director. The organization's registered agent is attorney Edward Stolle, Ken's brother and an attorney at Kaufman & Canoles, where Ken Stolle formerly worked.
Ken Stolle said in an e-mail that he didn't have time to answer questions this week about his foundation. Edward Stolle declined to comment. Payne did not return a phone message.
In August, before the raids, Sheriff Stolle said he believed sweepstakes games were legal but that he would wait for a legal ruling before accepting donations.
"If I weren't the sheriff, I would accept these charitable donations and not think twice about it," he said then, comparing the businesses to bingo. "I don't want the public to feel I sanction the activity when it's not my call."
Bryant, who has yet to charge any sweepstakes businesses with illegal gambling, said prosecutors are plowing through massive amounts of evidence. Will there be charges?
"We are waiting to make that determination," he said.
As for the Chimney Hill sweepstakes cafe?
"If they are operating the same as the other 11, they are doing so in peril at this point," Bryant said.

Someone should check out
the old Blockbuster at the intersection of Holland Rd and Lynnhaven Pkwy in VB. There is a sign that say H3 or something like that. The windows are all covered with what looks like white paper. There are signs saying "free tv's" etc... It looks like a very shady operation. Considering surrounding businesses and residential areas, I can only image what goes on behind those paper covered windows. Anyone have info on that "business"?

These are all good people but I have to say the comments in this article don't seem to convincing.
I hope someone looks into this matter a lot deeper.
This could be a "slippery slope" for VA Beach if there is even the hint of the "Return to the Good Old Days" at the Beach.

The mathematical possibilities of that cafe being an accidental oversight as opposed to being directly related to the personal affairs of the Sheriff is so slight that I'm offended and angry that currently unknown persons involved would make such an assumption of the public. No wonder the state of our union teeters like it does with such blasphemy in office.
To err IS human so there is a possiblility Stolle forgot to do so; however, his cafe should have been the first on the list because he should have put it there. Why? It's what his job and construct of his personal ethics (that he parlays to voters) that would dictate such a move. Stolle has my kudos for doing charity 'work,' but c'mon bud, you've been caught - time to come clean.

I only ask because this is the second time in the last month that he has presented an article concerning Sheriff Stolle that is full of inaccuracies and innuendos. Of course he is quick to point out that no law has been violated before he begins to sling his mud. I can only assume his theory is that if he slings enough crap something might stick. Well, it hasn't Mr Applegate. Get back to us when a crime has been committed! Want to do a real story? Enlighten us on the gang problems in Hampton Roads.

A few hundred more out of work..Thanks to this top priority raid. Grandma and Grandpa's shop will no longer allow them to dilly dally away their time by the looks of it. So instead of smothering the recesses of the deepest darkest pools of scum of society...we have now put out a few more hundreds out of work and a few more hundred from a place to enjoy and socialize...

This sounds like a perfect example of the good ol'boy network still being alive and functioning. OF COURSE the one place that the sheriff is involved with isn't raided! Stolle can put all the lipstick on this one he wants, even perfume it for that matter: it's still HIS pig. The place should be treated like all the other places.
The legality issue of such places needs to be fully resolved before any more raids are done. There are plenty of other crime problems that need this kind of scrutiny.

Well it is after 3 PM. Harvey and VBPD are now aware of these dangerous criminals. Has SWAT thrown in a few flash bang grenades and led these evil perps out in shackles yet?

First it is not clear these Sweepstakes/Internet Cafes are
illegal. The VA AG has spoken and courts have yet to decide. Second, There is no need to seize computers/equipment with swat teams. A simple cease and desist order that could be argued in court would have been more appropriate. And yet Va Beach is still issuing business licenses to operate these businesses.
So Mr. Stolle operated and continues to operate a business in the same fashion as the raided ones and was left untouched. There's Nothing like crushing the competition.
This stinks on high of selective enforcement by the police and the commonwealth attorney's office.
Does anyone believe Mr. Stolle and Mr. Bryant don't have a close relationship? I say a swat raid and seizure is called for Stolle's operation to prove otherwise

I didn't understand them the first time the news hit the Pilot. They bundle interenet access with chances to win sweepstakes, or some other tangible good. This way the chances to win sweepstakes are an add-on to buying the time to browse the internet.
So by law, it seems legal to me. You're buying the time to play on the internet, and as a bonus you get credits to play computer games that just happen to pay out to a smart card. I guess this is the same way the Publishers Clearinghouse works.
