The state review of Norfolk's light rail project is remarkable for what it reveals over 139 pages: that officials at Hampton Roads Transit hid the escalating price of the project, kept two sets of books, maintained haphazard and incomplete records and didn't follow standard procurement rules.
It is also remarkable for what it doesn't say: that crimes were likely committed.
As damning as the report is, the Virginia Department of Transportation's inspector general was asked to look at management practices and procedures, not prepare a criminal case. Nevertheless, some findings seem to provide a road map for future investigations:
- HRT didn't adequately oversee land acquisition, contingency funding, or even whether The Tide complied with federal agreements. Such failures could lead to demands for the return of $192 million in federal money.
- HRT didn't adhere to either procurement laws or its own internal controls.
- Repeatedly, communications between HRT and other responsible parties broke down or were sabotaged.
- Before Norfolk signed an agreement with the Federal Transit Agency in 2007 to be responsible for costs beyond the original $232 million budget, HRT officials knew the budget was $8 million more.
- The IG found no evidence that HRT officials told the feds before February 2008 that the budget was deeper in the red. At the end of 2008, HRT officials announced that the project would cost $288 million.
- Within months of making that estimate, the report said, HRT officials knew it was wrong. Early this year, HRT said the figure was closer to $340 million.
No one comes out looking innocent. At various times, HRT management neglected to tell Norfolk officials and even its own board what was going on. At various times, too, Norfolk officials knew things they didn't tell the City Council.
It would be convenient - and wrong - to blame a structure that made HRT responsible for construction but not for the money and made Norfolk responsible for money but not construction. Clearly, HRT was beyond its depth in taking on the project, and Norfolk was beyond its depth in ensuring HRT knew what it was doing.
HRT's president, Michael Townes, was forced to resign. Its champion on the Norfolk City Council, Randy Wright, lost his bid for re-election. And as The Pilot's Debbie Messina, who uncovered much of the mess, wrote, several other HRT employees are gone.
Philip Shucet, former head of VDOT, was brought in specifically to right the ship. Shucet asked for the state review and said he would quickly implement 31 recommendations for changes at HRT.
Still, enormous damage to the public trust remains and must be undone. The success of Norfolk's light rail system - critical to both redevelopment and to providing a transportation alternative - depends on delivering service beyond the city limits. For that to happen, there must be no doubts about oversight or HRT's ability to handle the project.
"When you're trusted to spend the public's money... you're expected to tell the truth," Shucet said. " And to be certain, a fear of the truth always leads to a bad end."
In this case, that end should begin with an exhaustive federal investigation to make sure that anyone who committed a crime is held accountable. The state report already provides an important guide to some of the worst abuses.
Given the taxpayer dollars involved and the allegations in the report, an investigation should include every elected, appointed and hired employee of any agency involved. It shouldn't stop until the truth - bad, good or indifferent - is uncovered.

LIGHT RAIL VS THE LINEBACKER
My take on this is like the big linebacker when asked how do you so easily get to the ballcarrier. He replied " I grab a whole mess of players and throw out the ones that don't have the ball, and then i've got the ball player"
What The Federal Government should do is put every one in jail that may have had any knowledge of the light rail fiasco and throw away the presumption of innonence clause, that might be a whole mess of officials in a whole lot of cities, and then let them prove they had nothing to do with the fiasco. The people that couldn't prove their innonence that are left are the culprits. It doesn't take a linebacker to figure that out.

Going Forward
Fortunately, Shucet has done what a new CEO should do; that is, he has established a base line of competence and has set out to ensure that from when he took office, accountability, competence, and professionalism would be expected and required. There is no doubt that those conditions were lacking at HRT, and to see the reality made manifest so they can be corrected is the proper way forward. The future of light rail will now be build upon a solid foundation, and the lessons learned about fiscal oversight will be incorporated into the project going forward. The necessity for light rail in the I-264 corridor is not diminished one iota by the trials and tribulations of the past leadership of this project, and my fervent hope is that as the reforms are implemented and the ship righted and put back on course, this system can be expanded to become a vital component of our transportation system.
Just keep it out of Virginia Beach...
Mr. Barrett, if you were caught running your company in this manner, you would be prosecuted and jailed for an entire laundry list of felonies. Just because the truth is coming out is no reason to trust HRT nor is it by any means another reason to start Light Rail in the Beach WITHOUT a vote on the matter by the very people who will have to foot the bill.
The Light Rail Now at Any Cost crowd already pulled the wool over the eyes of Norfolk taxpayers-there's no way this project should advance one inch into the Beach without the taxpayers having the final say on the matter.
I have no reason whatsoever to believe anything HRT says about Light Rail or anything else for that matter-they have lied, they were caught and somebody needs to go to jail.
It's just that simple.
Of course, there's always the option of you forming a private corporation, raising the money and building it yourself.....
Run for cover
Anyone naive to believe that this Light Rail fiasco went on unbeknown to elected officials, seriously need a reality check. Political pressure, applied through pass-through political contributions, fueled this corrupt deceit. How far it goes up, only the Department of Justice can ascertain.
Without fudging and misrepresentation, there is absolutely no possible way the TIDE light rail system could qualify for the FTA "new starts" grant criteria, other than the relaxed economic development aspect. That, economic development in itself, is insufficient to warrant the federal grants.
Once the threat of a federal investigation becomes reality, tight lips will become loosened by offers of immunity for testimony. All the political spin in world is not going to shield those that hope for anonymity. The choice is "run for cover" or be left twisting in the wind.
Larceny
If a citizen is caught shoplifting or commiting a larceny of some sort for a few hundred dollards, you can bet that person will be probably spend some time in the can, and will be ordered by the court to repay the loss. However, when officials like HRT get caught with their hands in the cookie jar, these events are glossed over by city officials and rewarded for good service, i.e. Michael Townes' severance package. Citizens of Virgina Beach, prepare yourself for the eventual declaration by Mayor Sessoms that HRT's problems have been resolved, and that light rail will be supported. What a joke!
